Promotional Services. Pursuant to Section 351.101(c) of Texas Tax Code, the CITY hereby engages the INSERT ENTITY NAME HERE, on the terms and conditions provided in this Agreement, for the management and supervision of certain promotional services, programs and activities that are eligible to be funded with revenue derived by City from Hotel HOT (collectively “Statutorily Authorized Promotional Programs” or “XXXX(s)”) specifically permitted under the Texas Tax Code Section 351.101(a) (1-5), as amended by the legislature during the term of this Agreement, including, advertising and solicitation for various promotional programs promoting visitor attractions, points of interest, entertainment opportunities, recreational facilities, and historical sites to attract tourists and convention delegates or registrants to the City of Copperas Cove. All Hotel HOT revenue expended by the INSERT ENTITY NAME HERE pursuant to this Agreement shall directly enhance and promote tourism and convention attendance in the City.
Promotional Services. During the term of this Agreement the Company shall, either directly, through one or more of its subsidiaries or through one or more of its third party service providers, provide and/or arrange the following promotional benefits to Sub at no additional cost to Sub (the "Promotional Services"): (a) Until termination of the Intellectual Property Agreement dated as of even date herewith between the Company and Sub (even after the term of this Agreement): (a) Company will vigorously promote Sub as its exclusive online and catalog channel for products for parents, childcare providers, infants and children under age seventeen; (b) Company agrees that neither it nor any affiliates it controls will promote in any way any other online or catalog retailer that offers products, as a material part of its business, for parents, childcare providers, infants and children under age seventeen; (c) Company agrees that Company will include prominent reference to Sub where such reference can be accomplished at a low incremental cost to the Company (by way of example, and not limitation, all the following created or manufactured or obtained after the Effective Date will contain a prominent reference to Sub: customer bags, customer receipts, labels, invoices, counter cards, in-store audio programming, emails, letterhead, and other stationary, mailers, print publications, advertising (including, without limitation, print, radio, television, billboard and the Internet, etc.)); and (d) Company agrees that it will have in-store signs promoting Sub in all Company retail stores and any retail store controlled or licensed by the Company. (b) Company shall cause its marketing and merchandising employees to assist Sub in the development of Sub's marketing and merchandising programs to be implemented by the Company; Company shall also cause its retail store personnel to execute and carry out reasonable marketing and merchandising programs of Sub.

Promotional Services. In connection with the foregoing and in accordance with the approval language contained hereunder, Xxxxxxxx agrees to cooperate with, and make himself reasonably available for up to three hours to media for Virtual Dining in conjunction with the release of the Licensed Products. Artist also agrees to monthly posting on primary social media account promoting menu items.

Promotional Services. Subject to Artist’s professional availability, Artist shall render a reasonable amount of reasonable publicity and promotion services (the “Promotional Services”) requested by Company. The Promotional Services may include, but are not limited to the following: attending premieres of the Picture, making appearances at press conferences or on television, making personal appearances, participating in interviews or photo sessions, cooperating in the photography of “behind-the-scenes” footage (which “BTS” shall be subject to written approval prior to its use) and participating in promotional tours, press junkets, home video commentary, and “added values” materials. No additional compensation shall be payable to Artist in connection with the Promotional Services, and the compensation set forth herein shall be deemed allocable to, and in consideration of, the Promotional Services. In the event that the Promotional Services requested by Company are required at a location greater than fifty (50) miles from where Artist then maintains a residence, then Company shall provide Artist and Artist’s one (1) guest with first-class transportation and travel expenses in connection with such Promotional Service in accordance with distributor’s reasonable policy and on most favored nations with all other cast.
