Proper Use of OSS Interfaces. 3.2.1 For AT&T-13STATE, WSP agrees to utilize AT&T-13STATE electronic interfaces, as described herein, solely for the purposes of pre-order and order activity necessary for Wireless Number Portability. In addition, WSP agrees that such use will comply with AT&T-13STATE's Data Connection Security Requirements as identified in Section 8 of this Appendix. Failure to comply with such security guidelines or misuse of OSS interfaces may result in forfeiture of electronic access to OSS functionality. In addition, WSP shall be responsible for and indemnifies AT&T-13STATE against any cost, expense or liability relating to any unauthorized entry or access into, or use or manipulation of AT&T-13STATE’s OSS from WSP systems, workstations or terminals or by WSP employees, agents, or any third party gaining access through information and/or facilities obtained from or utilized by WSP and shall pay AT&T-13STATE for any and all damages caused by such unauthorized entry.

In addition, CLEC agrees that such use will comply with the summary of SBC-7STATE's Operating Practice No. 113, Protection of Electronic Information, titled "Competitive Local Exchange Carrier Security Policies and Guidelines". Failure to comply with such security guidelines may result in forfeiture of electronic access to OSS functionality. In addition, CLEC shall be responsible for and indemnifies SBC-7STATE against any cost, expense or liability relating to any unauthorized entry or access into, or use or manipulation of SBC-7STATE's OSS from CLEC systems, workstations or terminals or by CLEC employees or agents or any third party gaining access through information and/or facilities obtained from or utilized by CLEC and shall pay SBC-7STATE for any and all damages caused by such unauthorized entry. 3.2.2 For SNET region, CLEC agrees to access and utilize SNET's Enhanced Services Access Platform, (ESAP), only for the purposes described herein. CLEC agrees that its access and use of ESAP shall, at all times, comport with SNET's "Wholesale CIWin User Guide", "EF User Guide", "ESAP Installation Guide", "ESAP Help Desk Guide", "CLEC Mechanized Interface Specification", and any other guide describing the interface or interface requirements that SNET may, from time to time, provide CLEC (collectively, the "Guides"). Failure materially to adhere to any material provision of such Guides may result, among other things, in forfeiture of electronic access to SNET's OSS functionality via ESAP upon notice. In addition, CLEC shall be responsible for and indemnifies SNET against any cost, expense or liability relating to any unauthorized entry or access into, or use or manipulation of SNET's OSS or ESAP from CLEC complimentary systems, workstations or terminals or by CLEC employees or agents any third party gaining access through information and/or facilities obtained from or utilized by CLEC and shall pay SNET for any and all damages caused by such unauthorized entry.
Proper Use of OSS Interfaces. 3.4.1 For AT&T, CLEC agrees to utilize AT&T electronic interfaces, as described herein, only for the purposes of establishing and maintaining Resale Services, UNEs, local number portability and interconnection trunk orders from AT&T pursuant to this Agreement and applicable tariffs. Section 9 of the General Terms and Conditions shall apply to any disputes which arise under this Agreement, with the exception of disputes related to the improper use of or access to CPNI or any alleged non-compliance with AT&T’s security guidelines. 3.4.2 In the event AT&T has good cause to believe that CLEC has used AT&T OSS in a way that conflicts with this Agreement or Applicable Law, AT&T shall give CLEC written notice describing the alleged misuse (“Notice of Misuse”). CLEC shall immediately refrain from the alleged misuse until such time that CLEC responds in writing to AT&T’s Notice of Misuse, which shall be provided to AT&T within twenty (20) days after receipt of the Notice of Misuse. In the event CLEC agrees with AT&T’s allegation of misuse, CLEC shall refrain from the alleged misuse during the term of this Agreement. 3.4.3 Section 9 of the General Terms and Conditions shall apply to any disputes which arise under this Article, including disputes related to the alleged improper use of or access to CPNI or any alleged non-compliance with AT&T’s security guidelines. Except as otherwise set forth in this Article, CLEC's liability for improper or unauthorized use of or access to AT&T’s OSS shall be governed by Section 7.6.3 of the General Terms and Conditions of the Agreement. 3.4.4 In the event CLEC does not agree that CLEC’s use of AT&T’s OSS is inconsistent with this Agreement or Applicable Law as alleged by AT&T, then the Parties agree to the following steps: 3.4.4.1 If such alleged misuse involves improper access of pre-order applications to obtain CPNI in violation of this Agreement, Applicable Law, or involves a violation of the security guidelines contained herein, or negatively affects another OSS user’s ability to use OSS, CLEC shall continue to refrain from using the particular OSS functionality in the manner alleged by AT&T to be improper, until CLEC has implemented a mutually agreeable remedy to the alleged misuse. AT&T may invoke the dispute resolution process in Section 9 (General Terms and Conditions) to devise such remedy. 3.4.4.2 To remedy the alleged misuse for the balance of the Agreement, Parties will work together as necessary to mutually determine ...

In addition, CLEC agrees that such use will comply with AT&T MICHIGAN’s Data Connection Security Requirements as identified in Section 9.0 below of this Appendix. Failure to comply with the requirements of this Appendix, including such security guidelines, may result in forfeiture of electronic access to OSS functionality. In addition, CLEC shall be responsible for and indemnifies AT&T MICHIGAN against any cost, expense or liability relating to any unauthorized entry or access into, or use or manipulation of AT&T MICHIGAN’s OSS from CLEC systems, workstations or terminals or by CLEC employees, agents, or any Third Party gaining access through information and/or facilities obtained from or utilized by CLEC and shall pay AT&T MICHIGAN for any and all damages caused by such unauthorized entry. 3.15.2 CLEC’s access to pre-order functions will only be used to view Customer Proprietary Network Information (CPNI) of another carrier’s End User where XXXX has obtained an authorization from the End User for release of CPNI. 3.15.2.1 CLEC must maintain records of individual End Users’ authorizations for change in local Exchange Service and release of CPNI which adhere to all requirements of state and federal law, as applicable. 3.15.2.2 CLEC is solely responsible for determining whether proper authorization has been obtained and holds AT&T MICHIGAN harmless from any loss on account of CLEC’s failure to obtain proper CPNI consent from an End User. The Parties agree not to view, copy, or otherwise obtain access to the customer record information about any other carriers’ End Users without proper permission. CLEC will obtain access to End User customer record information only in strict compliance with applicable laws, rules, or regulations of the state in which the service is provided.

Section 9 of the General Terms and Conditions shall apply to any disputes which arise under this Attachment, with the exception of disputes related to the improper use of or access to CPNI or any alleged non-compliance with SBC-13STATE’s security guidelines. 3.4.2 In addition, in order to determine whether CLEC is in compliance with its obligation to properly utilize SBC-13STATE OSS pursuant to this Agreement and applicable tariffs, SBC-13STATE retains the right to audit all activities by CLEC relative to its use of any SBC-13STATE OSS and CPNI for cause. SBC 13-STATE shall give ten (10) days advance written notice of its intent to audit CLEC under this Section 3.4, CLEC shall provide SWBT with access to the requested information at an appropriate CLEC location unless otherwise agreed by the parties, in whatever format CLEC customarily maintains such information within a reasonable time following the notice, but no more than twenty-eight (28) days after the date of the notice (unless otherwise agreed by the Parties). The audit shall be at SBC-13STATE's expense. All information obtained through such an audit shall be deemed proprietary and subject to confidentiality under Section 6 of the General Terms and Conditions. 3.4.3 Section 9 of the General Terms and Conditions shall apply to any disputes which arise under this Attachment, including disputes related to the improper use of or access to CPNI or any alleged non-compliance with SBC-13STATE's security guidelines. Except as otherwise set forth in this Attachment, CLEC's liability for improper or unauthorized use of or access to SBC 13-STATE's OSS shall be governed by Section 7.7 of the General Terms and Conditions of the Agreement.
