Proportionate Payment. Each sum appropriated by the Security Agent in accordance with the Finance Documents in or towards payment of a particular part of the Liabilities shall to the extent of that appropriation discharge the Assignor’s obligations in respect of that part of the Liabilities both to any Finance Party to which the same is owed, and to the Security Agent.
Proportionate Payment. Prior to the commencement of each Lease Year, Landlord shall give Tenant a written estimate of Tenant’s share of such Common Area Costs for the ensuing Lease Year. Tenant shall pay such estimated amount to Landlord in equal monthly installments, in advance. Within one hundred sixty (160) days after the end of each calendar quarter, Landlord shall furnish to Tenant a statement showing in reasonable detail the costs and expenses incurred by Landlord for the operation and maintenance of the Common Areas during such Lease Year, and the parties shall promptly make any payment or allowance necessary to adjust Tenant’s estimated payment to Tenant’s actual Proportionate Share of Common Area Costs as shown by such quarterly statement.
Proportionate Payment. Payments of compensation for variations of part of a foot shall be pro-rated accordingly.
Proportionate Payment. (a) The first sentence of Section 14.05(a) of the lease form shall read, in its entirety, as follows:
Proportionate Payment. When the insured asset is a set of table service, collections or sets in general, the amount to be indemnified will be calculated in proportion to the stolen or damaged units with respect to their total value.
Proportionate Payment. 11.7.1 When an employee leaves the employment of the Company or when the employee's services are terminated by the Company during the course of any qualifying twelve monthly period after at least one month of such service, proportionate payment shall be made at the appropriate rate of wage prescribed by Clause 4 hereof for 2.93 hours for each complete week of continuous service this does not apply to Casual Employees.
11.7.2 An employee whose employment is terminated by the Company for any reason other than malingering, inefficiency, neglect of duty or misconduct shall be entitled to a payment of any loading applicable to the employee.
11.7.3 An employee who leaves the employment of the Company or who is summarily dismissed by the employer shall not be entitled to payment of the loading prescribed in 11.6.1 of this clause.
Proportionate Payment. (a) Tenant's proportionate share of such common area charges shall be determined in the same manner as is provided in Section 5.02 of this Lease relating to computing Xxxxxx's share of real estate taxes.
(b) Landlord may, at its option, give Tenant a written estimate of Xxxxxx's share of such common area charges and Tenant shall pay such estimated common area charges as provided in Article XV. If Landlord elects not to estimate, Tenant shall pay its share of such common area charges at such intervals as Landlord may elect to bill Tenant.
Proportionate Payment. (a) Tenant’s Proportionate Share of Operating Expenses shall be that portion thereof which the Floor Area of the Premises bears to the Floor Area of the premises leased and leasable to tenants in the Shopping Center.
(b) Prior to January 1 of each Lease Year, commencing with January 1, 1998, landlord shall give Tenant a written estimate of Tenant’s Proportionate Share (defined below) for the ensuing calendar year of Operating Expenses in excess of Operating Expenses for the Base Year. Tenant shall pay such estimated amount to Landlord in equal monthly installments, in advance without deduction or offset. In the event that actual Operating Expenses experienced during any calendar year shall be greater or lesser than the estimates used by Landlord for calculating Tenant’s monthly installments, Landlord may revise its estimates and Tenant’s monthly installments thereof. Any changes to Tenant’s monthly installment payments shall be effective with the first full calendar month following Tenant’s receipt of notice from Landlord setting forth such revisions. Within ninety (90) days after the end of each such calendar year, Landlord shall furnish to Tenant a statement (the “Statement”) showing in reasonable detail the costs and expenses incurred by Landlord for the operation and maintenance of the Common Areas during such calendar year, and the parties shall make any adjustment necessary to place Tenant’s proportionate share on a calendar year basis. Any additional amount due from Tenant shall be paid by Tenant to Landlord within ten (10) days after the date of Tenant’s receipt of Landlord’s invoice therefor. Any amount due Tenant shall be credited against installments next coming due under this Section 5.5 or, if at the end of the Lease Term and Tenant is not in default, shall be refunded to Tenant.
(c) Tenant shall have the right, on reasonable advance written notice to Landlord, to audit Landlord’s books with respect to Operating Expenses on no more than one occasion in any calendar year. Tenant may take exception to matters included in the Operating Expenses by sending written notice specifying such exception and the reasons therefor to Landlord no later than thirty (30) days after Landlord makes such records available for examination. Proportionate Payment. When an employee (not being a casual employee) leaves the employment of his employer, or when his services are terminated by the employer during the course of any qualifying twelve monthly period, proportionate payments shall be made on the basis of one twelfth of the payment prescribed by sub-clause (g) of this clause for that employment.
