Protection of Property and Persons. The Contractor is responsible for initiating, maintaining, and supervising all necessary or required safety programs. The Contractor must comply with all applicable laws, regulations, ordinances, orders or laws of federal, state, county or local governments. The Contractor will indemnify the owner for all property loss or damage to the Borrower caused by his/her employees or his/her direct or indirect subcontractors.

Protection of Property and Persons. The Contractor shall protect its Work and all Materials and Equipment through Final Completion in accordance with standard industry methods so that the work or workers of other trades will not mar it during installation. The Contractor shall have full responsibility to install, protect and maintain all Materials and Equipment in proper condition and forthwith repair, replace and make good any damage thereto until Final Completion. The Contractor shall also temporarily protect any permanently installed work that may be damaged during the course of Contractor’s Work. The Contractor, and not the Owner’s Representative or the Owner, shall be responsible for any loss or damage that shall or may happen to the Work or any part or parts thereof or for any of the Materials and Equipment or other things used and employed in finishing and completing the Work, or for injury to any person or persons, whether workers or members of the public, or for damage to property resulting from the acts, omissions, fault or default of the Contractor in connection with its obligations hereunder. The Contractor shall properly remedy all damage or loss to any property caused in whole or in part by the Contractor, any of its Subcontractors or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. The foregoing obligations are in addition to the Contractor’s indemnification obligations set forth elsewhere herein and in Article 8 of the Contract.
Protection of Property and Persons. Contractor shall take all necessary precautions during the progress of the Work to protect all persons and the property of others from injury, loss or damage including, without limiting Contractor's duties, any precautions directed by DLC in the event of an emergency situation or other such circumstance where DLC reasonably believes a threat to safety exists. Contractor shall assume full responsibility for all tools, equipment and materials to be used in connection with the Work. If any equipment and/or materials needed in the performance of the Work under the Agreement are furnished by DLC, Contractor agrees to be solely responsible for all of DLC's equipment and materials hereunder from the time the same are delivered to Contractor until installation has been completed and accepted, and to indemnify, protect and hold DLC harmless from any loss of or damage (i) arising out of the use by Contractor of such equipment or material and (ii) to such equipment and materials. . However, if materials provided by DLC are defective upon delivery or do not function upon installation through no fault of the Contractor’s handling of the materials, Contractor shall notify DLC immediately and the obligations under this section shall not apply to said materials.

At points where the Contractor's operations are adjacent to properties of railway, telegraph, telephone, water, gas, or other pipeline or power companies, or are adjacent to other property, work shall not be commenced until all arrangements necessary for the protection of the interests of the Owner as well as any interest that a third party may have therein, have been made. All utility companies shall be advised by the Contractor of the work proposed under this Contract and of the necessary adjustments to their respective installations. The Contractor shall communicate with all utility companies at least three (3) days in advance before commencing any work in areas where utilities are located. The Contractor shall be on the alert for any additional utilities which he may encounter in the course of the operations. If additional utilities are discovered, the Contractor shall immediately take steps to protect the utility and notify the Engineer and the utility owner. In case of damage to any utilities by the Contractor, either above or below the ground, the Contractor shall restore such utilities to a condition equal to that existing before the damage was done. Any and all costs incurred for such restoration shall be borne entirely by the Contractor. The Contractor shall take into consideration the adjustments of installations by public utilities in areas within the limits of the contract in preparing his proposal. No additional compensation will be allowed for work interruptions, changes in handling, excavation, drainage and paving, changes in types of equipment used, etc. caused by others performing work within the limits of the contract.
