Provision of Transportation Services. The MCP shall ensure transportation pick-up is completed not more than 15 minutes before or 15 minutes after the pre-scheduled pick-up time, ensuring the member is on time for their appointment. Following a scheduled appointment, transportation pick-up shall be completed no more than 30 minutes after a request for pick-up following a scheduled appointment. The vendor shall attempt to contact the member if he/she does not respond at pick-up.
a. The transportation vendor shall not leave the pick-up location prior to the pre-scheduled pick-up time.
b. The MCP shall identify and accommodate any special transportation assistance needs of their members (e.g., door-to-door assistance, attendant support, member-specific timeliness requirements). Member-specific needs shall be communicated to the transportation vendor and updated as frequently as is needed to support the member’s needs. Where applicable, these needs shall be documented in the member’s care plan.
c. The MCP shall submit a plan for the provision of transportation services during winter snow and other weather emergencies, specifying identification, triage, transportation of consumers requiring critical services, notification to consumers of canceled transportation and rescheduling. The plan shall specify the snow emergency level and any other weather-related criteria that require a change to scheduled transportation. The MCP shall notify the Contract Administrator immediately when transportation is canceled in accordance with the plan.

i. The ability to help the member transfer between the pick-up location and the vehicle, to enter and exit the vehicle, and to transfer between the vehicle and the destination location safely;
ii. Sensitivity to aging adults living with disabilities;
iii. The ability to safely operate, secure, and transport a wheelchair or other assistive device;
iv. Maintain vehicles equipped with fasteners to secure wheelchairs and prevent movement, and a stable access ramp or hydraulic lift; and
v. The capacity to meet individual member needs when transporting.
d. When the Driver App is active, User requests for Transportation Services may appear to a Driver via the Driver App if the Driver is available and in the vicinity of the User. If a Driver accepts a User’s request for Transportation Services, the Uber Services will provide certain User Information to such Driver via the Driver App, including the User’s first name and pickup location. In order to enhance User satisfaction with the Uber mobile application and a Driver’s Transportation Services, it is recommended that Driver waits at least ten (10) minutes for a User to show up at the requested pick-up location. The Driver will obtain the destination from the User, either in person upon pickup or from the Driver App if the User elects to enter such destination via Uber’s mobile application. Customer acknowledges and agrees that once a Driver has accepted a User’s request for Transportation Services, Uber’s mobile application may provide certain information about the Driver to the User, including the Driver’s first name, contact information, Customer entity name, photo and location, and the Driver’s Vehicle’s make and license plate number. Customer shall not, and shall ensure that all Drivers do not, contact any Users or use any User’s personal data for any reason other than for the purposes of fulfilling Transportation Services. As between Uber and Customer, Customer acknowledges and agrees that: (a) Customer and its Drivers are solely responsible for determining the most effective, efficient and safe manner to perform each instance of Transportation Services; and (b) except for the Uber Services or any Uber Devices (if applicable), Customer shall provide all necessary equipment, tools and other materials, at Customer’s own expense, necessary to perform Transportation Services. Customer understands and agrees that Customer and each Driver have a legal obligation under the Americans with Disabilities Act and similar state laws to transport Users with Service Animals (as defined by applicable state and federal law), including guide dogs for the blind and visually impaired Users, and there is no exception to this obligation for allergies or religious objections. Customer’s or any Driver’s knowing failure to transport a User with a Service Animal shall constitute a material breach of this Agreement. You acknowledge and agree that once you have accepted a User’s request for Transportation Services, Uber’s mobile application may provide certain information about you to the User, including your first name, contact information, photo and location, and your Vehicle’s make and license plate number. You shall not contact any Users or use any User’s personal data for any reason other than for the purposes of fulfilling Transportation Services. As between Company and you, you acknowledge and agree that: (a) you shall be solely responsible for determining the most effective, efficient and safe manner to perform each instance of Transportation Services; and (b) except for the Uber Services or any Company Devices (if applicable), you shall provide all necessary equipment, tools and other materials, at your own expense, necessary to perform Transportation Services.

Driver acknowledges and agrees that once he or she has accepted (either directly or via any of Uber’s Affiliates in the Territory acting as an agent) a User’s request for Transportation Services, the Uber Services may provide certain information about Driver to the User, including Driver’s first name, contact information, Transportation Company entity name, photo and location, and Driver’s Vehicle make and license plate number. Driver shall not contact Users or use any User’s personal data for any reason other than for the purposes of fulfilling Transportation Services. Driver agrees that his or her contact and/or insurance information may be released to a User upon such User’s reasonable request. Driver may not, unless specifically consented to by a User, transport or allow inside any Vehicle individuals other than a User and any individuals authorized by such User during the performance of Transportation Services for such User. Driver shall transport all Users directly to their specified destination, as directed by the applicable User, without unauthorized interruption or unauthorized stops. Without limitation, Driver shall ensure that in respect of each Vehicle used by Driver for the performance of Transportation Services that Driver, without limitation: (a) maintains at all times a valid Ministry of Transport Test Certificate for such Vehicle including, where applicable, in accordance with the terms of any relevant license; and (b) that Vehicle is maintained at all times in a safe and roadworthy condition.

2.2.2. If a Driver accepts a User’s request for Transportation Services, the GT Services will provide certain User or User Passenger Information to such Driver via the Driver App, including the User or User Passenger’s first name and pick-up location.
2.2.3. In order to enhance User satisfaction with the GT App and the Transportation Services, it is recommended that the Driver wait at least 10 minutes for a User to show up at the pick-up location.
2.2.4. The Driver will obtain the destination from the Driver App.
2.2.5. The TSP acknowledges and agrees that once a Driver has accepted a User’s request for Transportation Services, the GT App may provide certain information about the Driver to the User, including the Driver’s first name, contact information, photo and the Vehicle being used by the Driver including make, location, and license plate number.
2.2.6. The TSP shall not, and shall ensure that all Drivers do not, contact any User or User Passenger or use any User or User Passenger’s personal data for any reason other than for the purposes of fulfilling Transportation Services.
2.2.7. As between GT and the TSP, the TSP acknowledges and agrees that:(a) the TSP and its Drivers are solely responsible for determining the most effective, efficient and safe manner to perform each instance of Transportation Services; and (b) except for the GT Services, the TSP shall ensure all necessary equipment, tools and other materials are available, at the TSP’s own expense, to perform the Transportation Services.
Provision of Transportation Services. During the effectiveness period of this Agreement, Party B agrees to provide Party A with the transportation of goods and Party A agrees to receive such Transportation Services from Party B.
