QUALIFICATION OF PERSONNEL. The TAC shall employ or subcontract to all qualified personnel needed to accomplish the range of work requirements specified in this Scope of Work. Qualification of all personnel (including subcontractor personnel) is based on the degree of significant experience and education or practical equivalency. The TAC shall identify the key personnel team to be associated with the BPA including those individuals assigned to the following roles: • Project Manager • Task Manager/Lead • Technical support personnel • Key staff support personnel Any change in TAC personnel requires approval in writing from the CO prior to new personnel charging to and working on a TO. Proposed substitutions should have comparable qualifications to those of the persons being replaced. The TAC shall provide an explanation of the circumstances necessitating the proposed substitution, complete resumes for the proposed substitutes, and any additional information requested by the CO or COR(s). No direct cost reimbursement will be made by the BLM for training TAC personnel, except as agreed to, in writing, by the CO. When responding to a BPA Call, the TAC shall provide resumes (limited to two pages per individual) for the individuals from the key personnel team that the TAC anticipates will perform work under the BPA Call and a description of his/her given role. If the COR questions the qualifications or competence of any person performing under a BPA Call, the burden of proof of sustaining that the person is qualified, as prescribed herein, shall be upon the TAC. The CO may require the removal of an employee performing work under the BPA when the COR deems the employee to be unresponsive, careless or insubordinate and whose continued employment would be contrary to the public interest or inconsistent with the best interest of the BLM.
QUALIFICATION OF PERSONNEL. The Distributor undertakes to assign qualified personnel to the sale, service and installation of the Products. Any new member joining the Distributor and assigned to the installation of STS's Products shall be trained by the people who have been trained according to the terms and conditions set forth in article 4.2 above.
QUALIFICATION OF PERSONNEL. NMS shall ensure that (i) the Implementation Services and all other services performed by NMS under this Agreement, including any Legacy Information Systems Integration Services, (collectively, "NMS Services") will be performed by persons who are employees or authorized personnel of NMS, each of whom will have entered into a proprietary rights assignment and confidentiality agreement with NMS; (ii) each person assigned to perform the NMS Services shall have the proper skill, training and background so as to be able to perform the such services in a competent and professional manner; and (iii) all work product and any other materials, documentation and other items delivered under this Agreement shall have been completed in a thorough and professional manner in conformance with any specifications applicable thereto.
QUALIFICATION OF PERSONNEL. When required by statute, regulation, certification of governing body, or the Sellers internal Quality Managements Systems, the Seller shall ensure only Qualified Personnel perform process and/or services related to the product and/or services provided to the Buyer.
QUALIFICATION OF PERSONNEL. SMCO suppliers and any sub-contractors will assure the competency of any/all personnel involved in activities performed on behalf of SMCO or our customer. Where special certification of personnel is required, this should be made available to SMCO or our customers upon request.
QUALIFICATION OF PERSONNEL. Assima shall assign Personnel that possess the appropriate knowledge, skills, expertise, and training to perform the Services in accordance with this Agreement and the applicable SOW. For each individual included in its Personnel, Assima shall, to the extent permissible under applicable law, conduct a security background check that includes investigation and identification of all criminal convictions and criminal charges pending against such individual during the immediately preceding five (5) years. At Customer’s expense, Assima shall perform such other types of verification as Customer reasonably requests. At the request of Customer, Assima shall deliver a written certification to Customer that it has performed, and the subject individual has passed, the verification procedures set forth in this Section. In addition, Assima shall be responsible for obtaining all necessary work authorizations for its Personnel at no charge to Customer.
QUALIFICATION OF PERSONNEL. This provision is applicable to Orders for services only.
10.1 No person objected to by Buyer shall be assigned by Seller to perform services hereunder, and upon receipt of a written request from Buyer for the replacement of any such person, such person shall be removed and a satisfactory replacement furnished. However, the Seller shall not remove, reassign, or transfer any Seller employee acceptable to Buyer without the written permission of the Buyer during the term of this Contract.
10.2 If, within the first twenty-four (24) hours of assignment, any of the Seller's personnel prove to be unsatisfactory within the discretion of the Buyer, no charge will be made to Buyer for the time worked or services rendered during this period by such personnel. Seller shall save and hold Buyer harmless from any and all liability from the exercise of its discretion.
10.3 If objections to the qualifications of the Seller's personnel are not raised by Buyer within the first five (5) working days, said personnel will be considered qualified for the assignment, provided, however, at any time after expiration of the above first five (5) working day period Seller further shall withdraw and replace immediately any personnel that Buyer deems unacceptable, even though such personnel have been approved previously by Buyer and provided, further, that in this event, the Seller shall be entitled to payment for services of the personnel up to the date Buyer requests the personnel to be withdrawn. If Seller's personnel who are acceptable to Buyer subsequent to the five (5) working day trial period resign or are acceptable to Buyer subsequent to the five (5) working day trial period resign or discontinue employment for other reasons, such personnel shall be immediately replaced by the Seller without additional cost to Buyer except as otherwise provided in this Contract. Seller shall be entitled to payment for services of personnel who discontinue employment up to and including the date of such discontinuance.
10.4 Buyer reserves the right to terminate the services of one or all of the Seller's personnel on twenty-four (24) hours notice.
10.5 In the event that Engineering Services are required as stated in Exhibit A "Parts Price List" seller shall complete all required documentation as stated in Exhibit B "Pro-6088".
QUALIFICATION OF PERSONNEL. The parties represent, warrant, and agree that:
(a) all of their Personnel who provide Marine Spill Response Services will have satisfied the minimum appropriate level of Hazardous Waste Operations and Emergency Response (“Hazwoper”) requirements commensurate with the federal or province regulations as applicable; and
(b) all vessel Personnel utilized by Providing Party will be duly licensed and registered under the laws and regulations of the registry of their vessels for their respective positions.
QUALIFICATION OF PERSONNEL. Only qualified/certified personnel shall be used based on process specification requirements. Records shall be maintained of the personnel qualifications/certifications. Our company reserves the right to review and approve the Suppliers Quality Management System.
QUALIFICATION OF PERSONNEL a) The CONSULTANT shall employ only persons duly licensed or registered in the appropriate category in responsible charge of all elements of the SERVICES, for which Illinois Statutes require license or registration, and further shall employ only well qualified persons in responsible charge of any elements of the SERVICES, all subject to DEPARTMENT approval.
b) The CONSULTANT’S KEY PERSONNEL specified by name in the AGREEMENT shall be considered essential to the SERVICES being performed. If, for any reason, substitution of a key person becomes necessary, the CONSULTANT shall provide advance written notification of the substitution to the BUREAU CHIEF. Such written notification shall include the proposed successor’s name and resume of their qualifications. The DEPARTMENT shall have the right to approve or reject the proposed successor.
c) The CONSULTANT shall report within 15 WORKING DAYS that a key person is no longer employed by the consultant and hence will no longer be available to perform SERVICES on the PROJECT. The CONSULTANT shall provide the successor’s name and resume expeditiously, but within 60 days of the key person no longer being available.
d) The CONSULTANT’S failure to comply with this section may result in termination of the AGREEMENT and/or loss of prequalification.
