Reconsideration Procedure. If a Sessional Academic Staff Member who has been disciplined wishes to request a reconsideration of the decision, the Faculty Association shall contact Human Resources, who shall arrange for a meeting to be held with the University's representative, the Faculty Association and the Sessional Academic Staff Member.
Reconsideration Procedure. Within thirty (30) days of receipt of the Advice of Rating Form (Appendix G) in accordance with Articles 5.1, 6.2 and 6.3, the following procedure shall apply:
Reconsideration Procedure. (1) An employee or exempt supervisor of the employee who disagrees with the decision of the Evaluation Committee may request a reconsideration of the decision provided that the request is submitted within ten (10) working days of receipt of the decision. The employee or exempt supervisor must complete a reconsideration form in accordance with the instructions of the form. The employee or exempt supervisor, as applicable must review the reconsideration request and provide written commentary either supporting or not supporting the request. The form shall then be submitted to the Compensation & Benefits Manager who will forward it on to members of the Reconsideration Committee and coordinate the review.
(2) The Reconsideration Committee shall review the request and reach a decision through consensus. The Reconsideration committee shall communicate its decision to the employee and the exempt supervisor as soon as possible, providing reasons for the decision.
Reconsideration Procedure. 4.1 Within sixty (60) days of a job evaluation in accordance with Articles 3.2 and 3.3, the following procedure shall apply:
a) The incumbent(s)/union and/or the supervisor/employer may request reconsideration of the job evaluation by completing and submitting a Job Evaluation Reconsideration Form, stating the reason(s) for disagreeing with the evaluation of the job.
b) Additional information may be requested by the committee from the incumbent and the supervisor.
Reconsideration Procedure. Within twenty (20) working days of receipt of the Advice of Rating Form, the following procedure shall apply:
(a) The incumbent(s)/Union and/or the Supervisor/Employer may request reconsideration of the job rating by completing and submitting a Reconsideration Form, stating the reason(s) for disagreeing with the rating of the job.
(b) The incumbent(s) and the Supervisor may make presentations to the Committee.
Reconsideration Procedure. (a) Within twenty (20) working days of receipt of the Advice of Rating Form, the incumbent(s) or the supervisor(s) may request reconsideration of the job rating by completing and submitting a Reconsideration Form stating the reason(s) for disagreeing with the rating of the job.
(b) The incumbent(s) and the supervisor(s) may make presentations to a joint meeting of the HR Designate/UJEC Members
(c) The HR Designate/UJEC Members shall consider the reconsideration request and make a decision which shall be final and binding upon the Parties and all employees affected.
(d) The rating of the job shall determine the pay grade for the job.
i. If the pay grade of the job increases as a result of the review, such increases shall be paid to each incumbent effective the date stamp on the Reconsideration Form.
ii. If the pay grade of the job decreases as a result of the review, the incumbent(s) shall be red-circled and shall continue to be paid at the red-circled wage rate notwithstanding the implementation of the new schedule for the position; and further that the “red- circling” wage protection shall cease when the position is filled by another person, or the wage rate under the new schedule that would be paid to the incumbent(s) is equal to or greater than the “red-circled” rate.
(a) The HR Designate/UJEC shall inform both the incumbent(s) and the supervisor(s) of its decision using the Review Decision Form.
Reconsideration Procedure. 7.1 Within thirty (30) days of receipt of the Advice of Rating Form (Appendix E) in accordance with Articles 5.1, 6.2 and 6.3, the following procedure shall apply:
a) The Employer, the Union, the incumbent(s) and/or the supervisor may request reconsideration of the job description and/or the job rating by completing and submitting a Reconsideration Form (Appendix F), stating the reason(s) for disagreeing with the job description and/or the rating of the job.
b) The Employer, the Union, the incumbent(s) and/or the supervisor may make a presentation to the JJE Committee.
c) The JJE Committee shall consider the reconsideration request and make a decision that shall be final and binding upon the parties and all employees affected.
d) The JJE Committee shall inform all parties of its decision using the Review Decision Form (Appendix G).
Reconsideration Procedure. Definitions
5.1 Request for Reconsideration - The terms "request for reconsideration" or "request" as used in this Article refer to a request filed by an employee for reconsideration of an alleged violation, misapplication, or misinterpretation of a specific written CSU policy governing working conditions or work rules.
5.2 Employee - The term "employee" as used in this Article refers to a:
a. permanent employee
b. probationary employee
c. temporary employee who alleges that he/she has been directly wronged by a violation of a specific written CSU policy governing working conditions or work rules.
Reconsideration Procedure. 6.1 Within twenty eight (28) days of receipt of the Advice of Rating Form (Appendix”C”), the following procedure shall apply:
a) The incumbent(s) and/or the Employer and/or the Union may request reconsideration of the job rating by completing and submitting to both co-chairs of the JJEC, a Reconsideration Form (Appendix “B”), stating the reason(s) for disagreeing with the rating of the job.
b) The JJEC shall meet and consider the reconsideration request and make a decision which shall be final and binding upon the parties and all employees affected.
c) The Committee shall inform both the incumbent(s) and the supervisor of its decision using the Review Decision Form. (Appendix “E”)
d) As a result of the reconsideration, if a job is rated at a pay grade with a salary range higher than the current salary range for the job, the incumbent’s wage rate shall be adjusted to the higher pay grade on the new salary schedule, retroactive to the date the Reconsideration Form was submitted. The incumbent(s) shall retain the same position on any increment grid.
Reconsideration Procedure. Either the Manager or the incumbent(s) may request reconsideration of the job description and/or job rating by completing and submitting a Job Evaluation Reconsideration form, stating the reason(s) for disagreeing with the job description and/or rating of the job. Any such request must be submitted within thirty (30) PBC working days of the receipt of the Advice of Rating. Both the Manager and the incumbent(s) will be permitted to make a presentation to the Committee. The JJEC will consider the request and make a decision within sixty (60) calendar days, which will be considered final and binding on the parties and all employees affected. The Committee will inform both the incumbent(s) and the Manager of its decision and the reasons for it, in writing.
