Reference and Background Checks. This offer of employment with the Company is contingent upon the Company’s satisfactory completion of reference and background checks, proof of Executive’s authorization to work in the United States and Executive’s execution of the provided Confidential Information Agreement.

Reference and Background Checks. The Department has the right to require Contractor to conduct reference checks, background checks, and criminal history checks on Contractor Staff who are on-site at a Department facility or who may have access to sensitive information in providing the Services. The Department has the right to reject any proposed Staff as a result of information produced by checks or other sources of information. Contractor agrees that any Contractor employee, assistant, agent, or Subcontractor employee, agent or contractor performing work under this Contract may be required: (i) to pass a fingerprint-based background check in accordance with the Department requirements; and (ii) provide results of a criminal background investigation in the form of a letter of attestation. Contractor shall pay the costs of the background and fingerprint checks and investigations. Contractor shall comply with the Department instructions on submitting fingerprints and other information to the Department in order to complete these checks. Such an investigation as described above may include, but not be limited to, criminal history records checks. Contractor must provide proof that it performed the above-described checks upon request by the Department. Results of the checks and investigations and/or failure of Contractor to cooperate fully may be grounds for termination of this Contract. Failure of a Contractor employee, agent or Subcontractor employee, agent or contractor to cooperate with a background check will result in the Department’s rejection of such person and may result, in the Department’s discretion, in the immediate termination of the Contract.
Reference and Background Checks. Due to the confidential nature of the information and materials which will be accessible to Contractor, the Counties shall have the right to conduct reference and background checks on Contractor Staff to be used to provide the Services. The Counties reserve the right in their sole discretion to reject any proposed Staff as a result of information produced by such reference checks, background checks, or additional sources of information. In addition, Contractor shall conduct its own reference and background checks for at least five previous years on Staff or their substitutes to be used to provide the Services. Contractor further agrees to cooperate fully with the Counties in completion of these requirements.

Results of the checks and investigations and/or failure of Contractor to cooperate fully may be grounds for termination of this Contract. Failure of a Contractor employee, agent or Subcontractor employee, agent or contractor to cooperate with WSP during the background checks (including but not limited to fingerprint-based background check) as described above will result in WSP’s rejection of such person and may result, in WSP’s discretion, in the immediate termination of the Contract.

The Exchange reserves the right in its sole discretion to reject any proposed Staff as a result of information produced by such reference checks, background checks, or additional sources of information. Both Contractor and the Exchange agree to maintain the confidentiality of information gathered under this provision and use it solely to promote the security of the Project or System or for other purposes as required by federal or State laws or regulations.

AOC reserves the right in its sole discretion to reject any proposed Staff as a result of information produced by such reference or background checks or additional sources of information. Contractor agrees that, as a requirement of this Contract, Contractor, and any employee, assistant, agent, or Subcontractor of Contractor completing work under this Contract, may be required to provide results of a criminal background investigation. Such an investigation may include, but not be limited to, fingerprinting and criminal history records checks. Contractor further agrees to cooperate fully with AOC in completion of this requirement. Results of the investigation and/or failure of Contractor to cooperate fully may be grounds for termination of this Contract.

Reference and Background Checks. 4.6.1 DSHS shall have the right to conduct reference checks and background checks, and to elicit information from additional sources on managing Employees and Persons with an Ownership or Control Interest. If DSHS determines that a Person with an Ownership or Control Interest is on a Medicaid exclusion list based on information produced by such checks and screenings, or other sources of such information, DSHS reserves the right in its sole discretion to immediately terminate this Contract or exercise its other remedies. 4.6.2 In accordance with RCW 74.39A.056, Contractor shall: (a) conduct background checks and screenings on Individual Providers as required under RCW 74.39A, RCW 43.43.830 through 43.43.842, 43.20A.710, the rules adopted by DSHS, and federal laws and regulations; or (b) verify that a background check has been conducted for each Individual Provider and that the background check is still valid in accordance with DSHS rules. Contractor shall also conduct background checks and reference checks on Individual Providers in accordance with the terms of the RFP and Response. 4.6.3 Contractor shall also conduct background checks on Internal Employees and Subcontractors that provide Critical Services. Contractor shall use an external screening agency to perform such background checks and reference checks, and Contractor represents and warrants that such procedures are and shall be at least consistent with good industry practices. Contractor shall provide DSHS with the results of such background and reference checks. DSHS reserves the right in its sole discretion to reject any proposed Internal Employees and Subcontractors that provide Critical Services as a result of information produced by such background checks and reference checks or additional sources of information. Contractor agrees that, as a requirement of this Contract, any Internal Employees and Subcontractors that provide Critical Services may be required to, and, if required by DSHS, shall: (i) pass a fingerprint-based background check in accordance with DSHS requirements; and
