Reference to Industrial Instruments. This Agreement represents the total and only wages and conditions of employment for Employees covered by this Agreement. This Agreement constitutes the entire Agreement between the Parties as to its subject matter and supersedes all prior representations and agreements in connection with that subject matter. As such, any prior contracts of employment, understandings, agreements, conditions of employment, entitlements, wage rates and/or allowances between the Company and its Employees, express or implied, cease to have any effect or application and are replaced in total by this Agreement. For abundant caution and to avoid any doubt, clauses from any Awards (Federal or State) that have not been expressly incorporated into this Agreement have no relevance to the employment relationship between the Company and its Employees.
Reference to Industrial Instruments. This agreement will stand alone without any further reference to or reliance on any Award including but not limited to, the AWU Construction and Maintenance Award 2002. For abundant caution and to avoid any doubt, clauses from this Award that have not been expressly incorporated into this Workplace Agreement have no relevance to the employment relationship between Boral Concrete and its employees.
Reference to Industrial Instruments. This Agreement will operate to the exclusion of any award including but not limited to, the Modern Cement, Lime and Quarrying Award 2020, the Premixed Concrete Award 2020 and the Road Transport and Distribution Award 2020 and will be deemed to cover the field in respect of all wages and working conditions of the employees as against any other award or workplace agreement made under the Fair Work Act 2009. This Agreement shall be read and interpreted in conjunction with the National Employment Standards (NES) provided that where there is any inconsistency between this Agreement and the NES, the more beneficial provision to an employee shall take precedence.
Reference to Industrial Instruments. (a) This Agreement wholly incorporates the provisions of the Concrete Products Award 2020 and Manufacturing and Associated Industries and Occupations Award 2020 (Awards). (b) Where there is any inconsistency between this Agreement and the terms of the Award incorporated in this Agreement by virtue of clause 3.2 (a) above, this Agreement shall take precedence to the extent of any inconsistency. For the avoidance of doubt, the terms of this Agreement will replace or modify, to the extent of any inconsistency, all protected Award conditions within the meaning of the Fair Work Act 2009 (Cth), which would otherwise apply to the Employees’ employment including rest breaks, incentive-based payments and bonuses, annual leave loadings, State public holidays
Reference to Industrial Instruments. 2.5.1 This Agreement represents the total and only wages and conditions of employment for Boral Country Vic’s concrete and quarry employees covered by this Agreement. This Agreement constitutes the entire agreement between the parties as to its subject matter and supersedes all prior representations and agreements in connection with that subject matter, As such, any prior contracts of employment, understandings, agreements, conditions of employment, entitlements, wage rates and/or allowances between the Employer and its employees, express or implied, cease to have any effect or application and are replaced in total by this Agreement. For abundant caution and to avoid any doubt, clauses from any Awards (Federal or State) that have not been expressly incorporated into this Workplace Agreement have no relevance to the employment relationship between Boral Country Vic. and its employees. 2.5.2 This Agreement replaces and operates to the exclusion of any clauses which fall within the definition ofprotected conditions” in Schedule 8 of the WRA as amended from time to time that might otherwise apply to your employment by operation of the WRA. Protected Conditions means protected award conditions, protected notional conditions and protected preserved conditions as those terms are defined in the WRA. Protected Conditions include but are not limited to rest breaks, incentive based payments and bonuses, annual leave loadings, public holidays, certain expense and work related allowances, overtime and shift penalties, penalty rates, outworker conditions, and provisions that are incidental or machinery to such conditions.
Reference to Industrial Instruments. This Workplace Agreement will stand alone without any further reference to or reliance on any Award including but not limited to, the Concrete Batching Plants Award 1999. For abundant caution and to avoid any doubt, clauses from this Award that have not been expressly incorporated into this Workplace Agreement have no relevance to the employment relationship between Alsafe Premix Concrete Pty Ltd and its employees.

Reference to Industrial Instruments. This Workplace Agreement will stand alone without any further reference to or reliance on any Award including but not limited to, the Quarrying and Lime Processing Award 20011. Any term of the Award which contains prohibited content is deemed not to be incorporated into this Agreement.
