RELIEF FOR COMPLAINANTS. A. Complainant 1: Within 30 days of the completion and signing of a release, FBC shall pay Complainant 1 $2,580.00. Contemporaneously with making the payment, FBC shall confirm the disbursement of funds via email to Xxxxxxx Xxxx at Xxxxxxx.Xxxx@xxxxx.xxx. B. Complainant 2: Within 30 days of the completion and signing of a release, FBC shall pay Complainant 2 $22,500.00. Contemporaneously with making the payment, FBC shall confirm the disbursement of funds via email to Xxxxxxx Xxxx at Xxxxxxx.Xxxx@xxxxx.xxx. 1 As used in this MOA, language assistance services refer to oral services. C. FBC represents that there are no references in the personnel file of Complainant 2 to the charges of Title VI discrimination filed against FBC or FBC Courts, Complainant 2’s participation in this investigation, or any references to Complainant 2’s internal complaints with FBC or FBC Courts or complaints filed with the Texas Judicial Branch Certification Commission. In addition, absent advance written approval from DOJ, FBC shall not make any future reference to this investigation, this agreement, or the related complaints in any of the files that FBC or FBC Courts maintains regarding Complainant 2 or any employment databases it uses to store information about workers’ qualifications or eligibility for employment opportunities, except as required to comply with this agreement or applicable local, state, or federal law. D. Unless required by local, state, or federal law, FBC will offer no explanation for why it will not provide additional employment information to prospective employers or any other entity regarding Complainant 2 other than to state that it is the policy of FBC to provide only the dates of employment and salary history in response to such a request for an employment reference. E. FBC and FBC Courts shall not retaliate against any complainant in this matter in any way, including, but not limited to, by refusing to offer them employment, business, and/or contracting opportunities based on any complainant engaging in protected activities or behavior.

To show compliance with paragraph X00, Xxxxxxxxxxx will provide a photocopy of the check and the overnight tracking information to the Department within thirty (30) days of the effective date of this Agreement. Respondents will pay Complainant FHANC the sum total of Four Thousand Three Hundred Thirty-Three Dollars ($4,333.00) in the form of a business check payable to “Fair Housing Advocates of Northern California” and will deliver the check via overnight mail with tracking capability within fourteen (14) days of the effective date of this Agreement to Complainant FHANC at the following address: Xxxxxxxx Xxxxxxx, 00 Xxxxxx Xxxxx, Xxxx Xxxxxx XX 00000. To show compliance with paragraph X00, Xxxxxxxxxxx will provide a photocopy of the check and the overnight tracking information to the Department within thirty (30) days of the effective date of this Agreement. The photocopies should be sent to the Department at the email address specified in paragraph I23 of this Agreement. Redacted Name 17. Respondents represent that it is their policy to provide a neutral landlord reference in response to any and all inquiries. Respondents agree to provide such a neutral landlord reference in response to any and all inquiries regarding Complainant Redacted Name tenancy. Said neutral reference will confirm: 1) that Complainant previously resided at the subject property; and 2) the dates of Complainant Redacted Name prior tenancy at the subject property. To show compliance with paragraph F17, within thirty days of receiving a request by the Department to provide a copy of any landlord reference given regarding Complainant Redacted Name tenancy, Respondent EAH will provide a copy of the reference to Complainants’ representative and the Department at the email addresses specified in paragraph I23 of this Agreement.
RELIEF FOR COMPLAINANTS. 15. Respondent Canyon View Capital agrees to pay Complainants six thousand dollars ($6,000.00), for which a Form 1099 will be issued to Complainants. Respondent agrees to pay the $6,000 amount via a certified check made payable to “Redacted Name ” within ten (10) calendar days of the Effective Date of this Agreement. A copy of the check shall be sent to the Conciliator, Xxxxx X. Xxxxxxx, via electronic mail at xxxxx.x.xxxxxxx@xxx.xxx. 16. Respondents Canyon View Capital and Springdale Ridge Property Investors, LLC agree to forgive any and all debts allegedly owed by Complainants to Respondents. Respondents Canyon View Capital and Springdale Ridge Property Investors, LLC agree to provide Complainants a zero-dollar ($0) balance statement within ten (10) calendar days of the Effective Date of this Agreement. A copy of the statement will be sent to the Conciliator, Xxxxx X. Xxxxxxx, via electronic mail at xxxxx.x.xxxxxxx@xxx.xxx. Respondents Canyon View Capital and Springdale Ridge Property Investors, LLC agree that any collection efforts that have been initiated by Respondents will be discontinued, at Respondents’ expense, immediately upon signing this Agreement, but no later than ten (10) calendar days of the Effective Date of this Agreement. In addition, Respondents Canyon View Capital and Springdale Ridge Property Investors, LLC will take the steps necessary to remove any record of current or former debts allegedly owed by Complainants to Respondents with any public agency or private entity including, but not limited to, any rent-reporting service or credit bureau including Experian, Equifax and TransUnion, or any other credit bureau to which Respondents reported the Complainants. In executing such record correction, Respondents will submit to the credit reporting agencies a statement that any record indicating Complainants have failed to make a payment to Respondents is inaccurate. 17. Canyon View Capital will file a Satisfaction of Judgment in the Circuit Court of Washington County, Arkansas Civil Division case number 72CV-19-484 no later than ten (10) calendar days after the Effective Date of this Agreement.

Payment will be in the form of a certified check or business check made payable to "Attorney Client Trust Account of Legal Aid Society of San Diego, lnc.," and mailed to Xxxxxx Xxxxxx, Staff Attorney, Legal Aid Society of San Diego, Inc., 000 Xxxxx Xxxxxx Xxxxxx, Xxx Xxxxx, XX 00000. Mission Cove Seniors Housing Associates, LP will provide a copy of the check to the Department within thirty (30) days of the effective date of this Agreement. 18. Within ten (10) days of the effective date of this Agreement, ConAm Management Corporation, as the agent for Mission Cove Seniors Housing Associates, LP, agrees to rescind on behalf of Mission Cove Seniors Housing Associates, LP, via written notice to Complainants, the noise complaint dated June 21, 2019, issued to Complainants. ConAm Management Corporation, as the agent for Mission Cove Seniors Housing Associates, LP, will provide a copy of the notice to the Department within thirty (30) days of the effective date of this Agreement. RELIEF FOR COMPLAINANTS. Within ten days (10) days of receiving a Closing Letter from the Commission, Respondent agrees to pay Complainants the sum of $1,409.44, without any deductions, to reimburse Complainants for the following expenses: $1,200 December rent $32.34 December utilities $80.80 December water and sewer $96.30 Deducted from Complainants’ rental deposit for 9 credit reports ($10.70 per report) Respondent agrees the check will be made out to Xxxx Xxxxxxx and Xxx Xxxxx and will be mailed to Complainants at the address listed on page one of this Agreement. Respondent also agree to send a copy of the settlement check to the Commission within ten (10) days of issuing the check.
