Remittance of Payment. Each week Marketer will pay Owner for all Ethanol invoiced thirteen to nineteen (13-19) days prior to said date and that has been paid by Owner's customers. This payment will be adjusted for freight and storage costs as described above in this Section and the Marketing and Administrative Services Fee stated in Section 5 of this Agreement, and when applicable, an adjustment for value-added opportunities as stated in Section 7 below.

Remittance of Payment. All monies deducted as hereinabove provided shall be paid by the Employer to the Union together with a list of names of employees for whom the dues/service fees and initiation fees have been deducted not later than the fifteenth (15th) day of the month following that in which the deductions are made by the Employer. The Employer shall not be liable by reason of the requirements of this Section for the remittance or payment of any sums other than that constituting actual deductions made from employee wages earned.

The Employer will also provide, in electronic form, (to the extent possible) employee name, social security number, hire date, FTE status, amounts deducted, classification, work unit, hourly wage rate, employee home telephone number and designation of membership status of employees for whom dues/service fees and initiation fees have been deducted. The Employer shall designate on this list new hires, employee terminations and employees on Leave of Absence of more than thirty (30) calendar days. In both cases, this information will be provided not later than the fifteenth (15th) day of the month following that in which the deductions are made by the Employer. The Employer shall not be liable by reason of the requirements of this section for the remittance or payment of any sums other than that constituting actual deductions made from employee wages earned.

Remittance of Payment. Servicer shall segregate, report and remit to Buyer and its successors and assignees registered on Servicer's books and records, on the fifteenth (15th) and last day of each month of the year ("Remittance Date") Buyer's principal and interest collections (less any money owed Servicer), as well as any prepayment in full of any loan received by Servicer through the Cutoff Date for each loan subject to the Loan Certificate. The Cutoff Date is the preceding Remittance Date through which all principal and interest collections are accumulated and totaled for reporting and remittance purposes under this Agreement. Should either the Cutoff Date or the Remittance Date fall on a holiday, such date shall be deemed to be the business day immediately preceding the actual Cutoff Date or Remittance Date. In the event that such remittance is not received by Buyer, or its successors or assignees, by the tenth (10th) day after the applicable Remittance Date, Seller shall be subject to a late charge of 8% of the amount of such remittance not received; and such charge shall be payable on demand by Buyer.
