ReopeningThis Agreement shall be considered reopened only as to those subjects which such court decisions and/or legislation requires reopening.
ReopeningTo ensure the health and safety of all workers at the workplace, the Employer shall delay the reopening of State offices until at least January 1, 2022.
ReopeningEither party may reopen this Agreement during 2021, only with regard to Section 16.1 and Appendix A for 2022 and 2023, by giving advance written notice to the other party as provided in this Section. Such written notice must be given not later than July 15, 2021. If such notice is given, the parties will negotiate during the period from August 1, 2021 to October 31, 2021. Any tentatively agreed changes must be ratified by the Union, and submitted by the County Human Resources Department for consideration on the County Board of Commissioners agenda, not later than 30 days after the end of the above negotiation period.
Reopening. The signatories acknowledge that in the event that activity and use limitations provided in this environmental covenant fail to serve their intended purpose - including prevention of exposure to contamination - DNR may reopen its review and regulatory oversight of the contaminant condition on the property as provided under the terms of this covenant, IC chapter 455I, and applicable DNR administrative rules.
ReopeningThe parties agree that this Section may be reopened for negotiations at either party’s request should any future law or regulation either contains requirements that make the above guidelines impossible to implement or allow additional flexibility in the staffs’ work year that either party may wish to negotiate.

Reopening. This Agreement may be reopened and modified at any time during its term upon mutual consent of the parties in writing, provided that: The parties agree to reopen the medical portion of the Health and Welfare for each year of the Agreement for implementation of state, federal, and ACA related changes to the medical benefits. The reopener will not result in a reduction of the health insurance allocation covered in this Agreement.

If this Agreement is reopened as provided above, each party will have the same rights as in negotiations for a renewal agreement at the end of the term of this Agreement, including the right to invoke Michigan Public Act 312 arbitration, except that negotiations, and Act 312 arbitration if applicable, will be limited to salaries under Section 13.1 for 2022 and 2023.
