Restrictions on Use of the Software. (a) No Distribution. Customer may not distribute or sublicense the Software to any person.
Restrictions on Use of the Software. You are prohibited from causing or permitting the reverse engineering, disassembly or decompilation of any of the Software. You are also prohibited from using the Software to provide service bureau data processing services or to otherwise provide data processing services to third parties. You may not allow the Software to be used by, or disclose all or any part of the Software to, any person except Your Personnel; however, You can allow use of the input and/or output visual displays of or from the Software by third parties on a “need to know” basis, as You reasonably determine. You may not allow the Software, in whole or in part, to be exported outside of the United States of America, in any manner or by any means, without in each instance obtaining Our prior written consent and, if required, a validated export license from the Office of Export Administration within the U.S. Department of Commerce and such other appropriate United States governmental authorities.

Customer will not allow the Software to be used by, or disclose all or any part of the Software to, any person except Customer Employees. Without limiting the foregoing, Customer is permitted to allow use of the input and/or output sensory displays of or from the Software by third parties on a strict “need to know” basis, and such use will not be deemed a non-permitted disclosure of the Software. Customer will not allow the Software, in whole or in part, to be exported outside of the United States of America, in any manner or by any means, without in each instance obtaining SunGard Public Sector’s prior written consent and, if required, a validated export license from the Office of Export Administration within the U.S. Department of Commerce and such other appropriate United States governmental authorities.
Restrictions on Use of the Software. You may use the Software only as expressly permitted in this Agreement. In doing so, You must comply with any technical limitations in the Software that only allow you to use it in certain ways. You will not:
(A) distribute, rent, sell, transfer, assign, loan or grant any rights in the Software or any portion thereof in any form to any other party;
(B) use the Software in any manner that is not an internal use which expressly excludes any (i) use as an information technology resource for an unrelated third party, or (ii) illegal activity; or
(C) disassemble, de-compile, reverse engineer, modify, make derivative works of, or otherwise change the Software, in whole or in part.
Restrictions on Use of the Software. You shall permit only authorized users, who possess rightfully, to use the Software or to view the Documentation. Except as expressly authorized by this Agreement, you shall not make available the Software, Documentation, or if applicable, any license key to any third party. You will use your best efforts to cooperate with and assist Xxxxxxxxx in identifying and preventing any unauthorized use, copying, or disclosure of the Software, Documentation, or any portion thereof.
Restrictions on Use of the Software. The Software shall be used solely in connection with Mobile Banking and may not be used by you for any other reason. You may not grant any sublicenses to the Software. You agree that you will not:
(i) modify, change, alter, revise, translate, or create any derivative works of the Fiserv Software;
(ii) decompile, disassemble, reverse engineer or otherwise attempt to derive the source code for the Fiserv Software;
(iii) copy or reproduce all or any part of the technology or Fiserv Software;
(iv) interfere, or attempt to interfere with the technology or Fiserv Software;
(v) redistribute, sell, rent, lease, sublicense, or otherwise transfer rights to the Fiserv Software; or
(vi) remove or alter any proprietary notices, legends, symbols or labels in the Fiserv Software, including, but not limited to, any trademark, logo or copyright. The Software does not include various third party operating systems and applications that will be required to use the Software. You will be solely responsible for such third party software. You acknowledge that the Software contains trade secrets and other proprietary and confidential information, whether or not the Software contains any copyright or other proprietary notice. You agree to take commercially reasonable precautions to protect the confidentiality of the Software. You agree that you:
(a) will not print, copy, or duplicate any portion of the Software,
(b) will not alter any copyright notices on the Software,
(c) will not make the Software available in any form to anyone except your agents for purposes specifically related to your authorized use,
(d) will take appropriate action with any persons permitted access to the Software to inform them of the confidential nature thereof and to obtain their compliance with the terms of this Paragraph,
(e) only will use the Software for your personal use and not for the benefit of any other person or entity, and
(f) will comply with all of our procedures and requirements for use of the Software. The provisions of this section will survive termination of this Agreement.
Restrictions on Use of the Software. This Licence does not prevent you from using the Software for benchmarking purposes. However, you shall ensure that any and all benchmarking data relating to the Software, and any other results of your use or testing of the Software which are indicative of its performance, efficacy, reliability or quality, shall not be used to disparage ARM, its products or services, or in a manner that, in ARM's reasonable judgment, may diminish or otherwise damage the reputation of ARM.

You will not, nor will it authorize or assist others to: (a) circumvent, disable or otherwise interfere with security-related features of the Software or features that enforce limitations on use of the Software and/or violate or abuse password protections governing access to the Software; (b) disassemble, reverse engineer or decompile all or any portion of the Software or otherwise discern the source code of the Software; (c) take any action that imposes or may impose, as determined in Approveit’s sole discretion, a disproportionately large load of incoming requests on the Software infrastructure; (d) use the Software on a service bureau or time sharing basis or to provide services to third parties; (e) distribute, copy, rent, lease, sublicense, assign, transmit, sell or otherwise transfer the Software or any of your rights therein; (f) modify, translate, alter, export, adapt, translate, enhance, customize, or otherwise create derivative works of, the Software or any part thereof; (g) interfere or attempt to interfere with the integrity or proper working of the Software; (h) use the Software in any unlawful manner or in breach of these Terms; (i) use Approveit’s name, logo or trademarks without prior written consent; (j) use the Software in order to conduct any comparisons, competitive analysis, penetration testing, vulnerability assessment, aimed identified security vulnerability, or other benchmarking activities, either alone or in connection with any other Software or hardware without the prior written consent of Approveit; (k) use the Software to design or develop any competing product or service that competes with the Software; (l) use, send, upload, post, transmit or introduce any device, code, routine or other item (including without limitation bots, viruses, worms, and Trojan horses) that interferes (or attempts to interfere) with the operation or integrity of the Software, nor any content that is unlawful, infringing, defamatory, deceptive, obscene fraudulent, harassing, pornographic, or abusive; and/or (m) use the Software other than as permitted herein.
Restrictions on Use of the Software. (i) SEATS, INSTALLATION AND LICENSE KEYS: Your use of the Software is limited to the specific number of Seats issued to you by NXP. For each Seat, NXP will make a License Key available to you to enable use of the Software, or certain components or optional functionality in the Software, as applicable. You shall only install and use the Software and License Keys on computers, or virtual machines running on computers, which are owned by you (or which are in your exclusive possession under an equipment finance arrangement) and which are either; (i) located at your premises; or (ii) portable computers which shall remain in the possession and control of your employees when outside such premises. Each Seat and License Key shall be limited or locked to a single item of your personal computer hardware (also known as host ID) on which the Seat or License Key is initially installed, except where NXP may separately agree to authorize the transfer (also known as re-hosting) of such Seat or License Key to another host ID.
