Right to Perform Services for Others. Avis recognizes that WizCom personnel providing Services to Avis under this Agreement may perform services similar to the Services from time to time for other customers; provided, however, that such personnel shall remain bound by the confidentiality provisions of this Agreement, and shall not disclose Avis Confidential Information except as provided in this Agreement.
Right to Perform Services for Others. Each Party recognizes that IBM personnel providing Services to ACE under this Agreement may perform similar services for others and this Agreement shall not prevent IBM from using the personnel and equipment provided to ACE under this Agreement for such purposes. IBM may perform its obligations through its subsidiaries, Affiliates or through the use of IBM-selected independent contractors; provided, however, that IBM shall not be relieved of its obligations under this Agreement by use of such subsidiaries, Affiliates, or subcontractors.

Customer acknowledges that PDF Solutions has extensive expertise, experience, technology and proprietary products and tools in the area of electronic design and yield improvement and that PDF Solutions intends to utilize such expertise, experience, products and tools in providing consulting services and other services to other clients. Subject to PDF Solutions' compliance with the confidentiality provisions stated herein, nothing in this Agreement shall restrict or limit PDF Solutions from providing integration technology or services to any other entity in any industry, including the semiconductor and electronics industries. Customer agrees that, except as otherwise agreed in this Agreement, PDF Solutions and its employees may provide design consulting services similar in nature to the Services and Technology for any third parties both during and after the term of this Agreement. Subject to the limitations placed on PDF Solutions by this Agreement, PDF Solutions may in its sole discretion develop, use, market, license, offer for sale, or sell any software, application or product that is similar or related to that which was developed by PDF Solutions for Customer hereunder.

Right to Perform Services for Others. ADT recognizes that IFOX's personnel providing Services to ADT under this Agreement may perform similar services from time-to-time for other persons, and this Agreement will not prevent IFOX from using such personnel (or any Equipment other than that the Equipment excluded below) for the purpose of performing such similar services for such third parties (collectively, "Competing Services"), including competitors of ADT; provided, however, that (i) IFOX complies with its obligations concerning ADT's Confidential Information and Proprietary Rights, and (ii) IFOX does not use the IBM Mainframe, any Third Party Software not procured by IFOX under an enterprise license, Application Software, or any property or services for which ADT has reimbursed IFOX in full hereunder (collectively, "ADT Resources") to provide or perform any Competing Services; it being agreed that all ADT Resources shall be dedicated solely and exclusively to ADT and IFOX's performance of the Services for ADT hereunder, and for no other purpose whatsoever. Similarly, ADT is retaining IFOX to perform the Services and any Additional Services on a non-exclusive basis, and ADT may, during the Term, and without waiving any default by IFOX hereunder, itself internally perform and/or retain third party suppliers, including, but not limited to, competitors of IFOX, to perform any service, function, responsibility, activity or task that is within the scope of the Services or would constitute an Additional Service hereunder.
Right to Perform Services for Others. AIRLINE may exercise on behalf of any other Air Transportation Company having an operating agreement or permit with NOAB any of the rights granted AIRLINE herein, so long as AIRLINE is concurrently exercising those same rights in the operation of AIRLINE's own Air Transportation Business at the Airport, subject to the provisions of Article 7.06, Article 15 and other provisions of this Agreement with respect to the NOAB Rules and Regulations and Operating Directives for Xxxxx Xxxxxxxxx New Orleans International Airport.
