Schedule of Fees and Charges. We will charge you, and you agree to pay, the fees and charges set forth in the Schedule of Fees and Charges below. We generally deduct fees and charges from the Card Account at the time a fee or charge is incurred. You will be charged a fee for a balance inquiry at an ATM even if you don’t complete a funds transfer. The owners of ATMs or other networks may impose an additional charge to use their terminals. Such other fees and charges may be deducted from your Card Account. If you request a service that is not included in the Schedule of Fees and Charges, if there is a fee for such service it will be disclosed at that time, and you agree that any such fee may be deducted from your Card Account. Schedule of Fees and Charges. 8.1 The Parties acknowledge and agree that, in relation to the schedule of Regulated Fees and Charges attached hereto as Schedule E (the “Regulated Fees and Charges Schedule”):
(a) the current Regulated Fees and Charges are as indicated in the column titled “Description”;
(b) the current Regulated Fees and Charges rates are as indicated in the column titled “Current Rate”;
(c) certain of the Regulated Fees and Charges will be implemented and/or increased during the Term as indicated in the column titled “Interim Rate”; and
(d) the Regulated Fees and Charges will be further adjusted on Financial Close as indicated in the column titled “Financial Close” and will be adjusted thereafter in accordance with the principles set out in Section F.6 of Schedule C. Since final capital and operating costs will be determined during the Term, the Financial Close adjustment will also take into consideration the level of Airport Infrastructure Charge required to make the Project financially viable and such other factors as may be relevant in that regard including, without limitation, the Base Case Financial Model reflecting the Target IRR and servicing of Bermuda Subordinated Debt.

If you create your own checks, or obtain them from someone else, and we cannot accurately verify your signature on an item by comparing it with an item that posted to your account, you are responsible for any losses that may result from our inability to use that check to verify your signature. You may not write items or other withdrawal orders on your account which order payment in a foreign currency. A foreign instrument may be returned unpaid much later (sometimes several months after we process the foreign instrument) than instruments that are drawn on banks located in the United States. You bear all the risks of a late return. We may decide not to credit a foreign instrument to your account until we receive the proceeds in cleared funds from the paying bank. If we do provide credit, such credit is provisional and we may reverse the credit at any time if the foreign instrument is returned unpaid or is initially paid but then subsequently returned for fraud or any other reason. You agree that we may use the current exchange rate and we may charge your account for the full value of the foreign instrument, including any applicable fees, which may result in a loss to you. You are responsible for all fees incurred including exchange rate, our collection fee, and other charges assessed by the payor bank. You understand that foreign instruments sent for collection are sent solely for you and at your risk and that we are not liable for any event in the collection process which is beyond our control including a default by any banks or agents involved in the collection process or for loss of the foreign instrument in transit.
