SEP Description. The Parties agree that the Discharger’s payment of the SEP Amount is a SEP, and that the SEP Amount shall be treated as a suspended administrative civil liability for purposes of this Stipulated Order. The Discharger’s SEP obligations shall be satisfactorily completed, and the SEP amount will be permanently suspended, upon SFEI’s written notification to the Regional Water Board and the Discharger acknowledging that the Regional Monitoring Program received payment of the SEP Amount from the Discharger and that the payment will be spent on the project described in Section III, paragraph 1.b.i and Attachment B in accordance with the terms of this Stipulated Order. SFEI’s annual and quarterly financial reports to the Regional Water Board shall be considered a final post-project accounting of expenditures.

SEP Description. The SEP is the Watershed Rangers Program managed by KIDS for the BAY (SEP Implementer). The SEP will provide disadvantaged schools in Richmond with trash cleanup projects that raise awareness of watershed health and social behaviors that contribute to non-point source pollution. The SEP will integrate green stormwater infrastructure into a traffic improvement project. Stormwater runoff from adjacent streets will flow into a landscaped area for treatment as a stormwater best management practice prior to discharge into the subsurface storm drain system. SEP Description. The Fryer Creek Habitat Enhancement Project is to address issues identified in the Sonoma Creek Watershed Sediment Total Maximum Daily Load (TMDL). The SEP is designed to improve upland and aquatic wildlife habitat for native fisheries and preserve special-status species. Planting trees, shrubs, and grasses will help sequester carbon and enhance habitat for red-legged frogs, western pond turtles, existing warm water fisheries, and possibly Chinook salmon or steelhead. The planting of native species to stabilize the channel and banks will reduce erosion and sediment inputs to the stream channel, displace or reduce the prevalence of aquatic non-native weeds, filter and slow adjacent surface storm water runoff to prevent sediment build up, and to decrease intrusive sediment removal project impacts. Water quality monitoring and comparison to other watershed tributaries will provide critical indicators of stream health and help steer watershed management practices.

The San Francisco Estuary Institute’s annual and quarterly financial reports to the Regional Water Board shall be considered a final post-project accounting of expenditures.

SEP Description. The purpose of the SEP is to provide Exclusionary Fencing to reduce pollutants at three creek crossings (bridges) in the Santa Xxxx area. The construction of exclusionary structures under three bridges will reduce water quality impacts including litter, human waste, soap, hazardous materials, and sedimentation created from chronic homeless encampments adjacent to creeks. The three bridges are within the Santa Xxxx Creek watershed, tributary to the Laguna de Santa Xxxx. Pollutants to be mitigated include, but are not limited to nutrients, bacteria, trash, and sediment. This SEP is part of an on-going effort by the Discharger to reduce impacts to water quality and repair, operate and maintain its public structures and is beyond that required by law and separate from projects designed to bring the Discharger into compliance. Detailed plans and a budget for achieving the completion of the SEP are provided in the SEP description attached hereto as “Attachment A.” The implementation schedule for completion of the SEP is as follows: Obtain CEQA Clearance Within 2 months of issuance of this Order Project Bid Within 4 months of issuance of this Order Award contract Within 6 months of issuance of this Order Complete Construction Within 11 months of issuance of this Order Submit Final Report: SEP Completion Within 12 months of issuance of this Order Confirmation that the SEP has been completed in its entirety shall be submitted by the Discharger to the Designated Regional Water Board Representative no later than 12 months of issuance of this Order (the “SEP Completion Date”) as indicated in the schedule above.
SEP Description. The Dischargers will fund a portion of a project known as the Mad River Estuary Floodplain Habitat and Public Access Enhancement Project (Project). The 9.3-acre project area is located in McKinleyville, on property owned by the McKinleyville Community Services District. CalTrout is the project applicant and lead agency for the SEP. The Project consists of two separate components. The primary component is the design and implementation of a 4.25-acre off- channel, floodplain and salmonid habitat restoration site to replace a pair of decommissioned percolation ponds adjacent to the river. This component of the Project will improve water quality by increasing floodplain connectivity, off-channel habitat, and riparian forest for the sake of migratory birds, Coho and Chinook Salmon (both federally listed as endangered species), and Steelhead. The second component includes design and implementation of accessible trails and other public access amenities, which are compliant with the Americans with Disabilities Act (ADA), to expand recreational opportunities in McKinleyville. The Dischargers will apply the SEP Amount to the floodplain restoration component of the Project, specifically wetland monitoring and post-construction revegetation. SEP funds directed towards wetland monitoring will fund a California Rapid Assessment Method (CRAM) wetland survey, which includes field sampling, data analysis, and the technical memorandum summarizing wetland monitoring. SEP funds directed towards post-construction revegetation will fully fund the required materials for revegetation and partially fund the revegetation effort performed by the California Conservation Corps (CCC). Staff reviewed the Project proposal and concluded that the Project meets the requirements of a SEP, pursuant to the State Water Board’s 2017 Policy on Supplemental Environmental Projects (SEP Policy), under the Environmental Restoration and Protection category. The Project will serve to improve and protect water quality and beneficial uses of the Mad River by expanding terrestrial and estuarine habitat and enhancing the spawning and migratory patterns of anadromous fish.
SEP Description. The goal of the Litter Control Measures is to reduce the trash and litter loading from land-side activities into harbor waters. The SEP consists of installation of trash skimmers and media filters and debris screens in storm drain inlets. Trash skimmers will focus on reducing floating trash and other materials around marinas and harbors. Media filters and debris screens installed in stormdrain inlets will remove surface runoff pollutants and prevent litter from entering the storm drain system. This SEP is to reduce pollutants from making their way to the same receiving waters as those ultimately affected by the effluent exceedances at POLA’s Facility.
