Sponsor’s Responsibilities. The Sponsor will have the responsibility of conducting the psychoeducational evaluation of students referred for potential placement within exceptional student education in accordance with federal and state mandates. The School agrees that the Sponsor will perform psychoeducational evaluations of students initially referred for placement within exceptional student education without fee. The School will be billed for those services not covered by the administrative fee at the actual cost of these services. The School may obtain independent evaluations of students at the School’s expense. These evaluations may be considered in determining eligibility but will not necessarily substitute for an evaluation conducted by the Sponsor’s district personnel in a manner and timeframe consistent with that of all other schools in the district. The Sponsor will monitor the School for ESE compliance with applicable federal, state and local policies and procedures.

The School may obtain independent evaluations of students at their expense. These evaluations shall be considered but will not necessarily substitute for an evaluation conducted by Sponsor district personnel in a manner and timeframe consistent with that of all other schools in the district. b) The Sponsor will provide a Staffing Specialist to serve as the Local Education Agency (LEA) when an IEP meeting is conducted to consider an initial placement, a change in placement, a dismissal from a program, or a change in personnel assignments or reassignments. However, the administrator or designee in charge at the School will serve as the LEA Representative at annual and interim IEP, Educational Plans (EP), and 504 meetings, which the School shall conduct. c) The Sponsor may participate in all IEP meetings at the School and will serve as the Local Educational Agency (LEA) Representative when attending. The Sponsor will be responsible for the review of the Matrix of Services form following the completion or revision of an IEP. The Sponsor will make final determinations of the Matrix of Services scores. d) The Sponsor shall provide exceptional student administration services to the School, pursuant to §1002.33, F.S. The School will be billed for services not covered by the administration fee at the actual cost of the services.

Acquire all title to land and easements for Project. e. Comply with all North Dakota laws governing the requirements for competitive bids, advertising, and awarding of contracts for construction of Project. f. Maintain a Project file containing relevant documents and correspondence generated during the course of Project. Commission is not responsible for maintaining a Project file. g. Provide a progress report to Commission at least every four years if the term of Project exceeds four years. h. Notify Commission of any changes to Project funding, including additional funding or funding sources. Cost-share may be modified based on the revised local share. i. Prior to signature, inform Commission and any other relevant party regarding Project of any errors, misinterpretations, changes, modifications, miscalculations, incorrect Project descriptions, or any other information stated herein that is inaccurate. j. Notify Commission of litigation related to Project. If Project becomes the subject of litigation before all funds have been disbursed, the Secretary may withhold funds until the litigation is concluded.

Sponsor’s Responsibilities. The Responsible Local Official (RLO), who represents the Sponsor, must confirm that the final inspection has been performed (in accordance with Chapter 15), all required reports have been submitted, and the terms of the construction contract have been satisfied. The Sponsor also needs to determine if additional payments are to be made to contractors, consultants, or others. For consultant contracts greater than $300,000, the Sponsor must ensure an audit is performed on both the consultant and sub-consultant contracts (regardless of sub-consultant contract value). Fees paid to conduct contract audits are reimbursable projects costs (23 CFR 140.803 and 140.807). Guidance is provided in OMB Circular A-87 Cost Principles for State, Local and Indian Tribal Governments1, OMB Circular A-133 Audits of States, Local Governments and Non- Profit Organizations2, and the AASHTO Uniform Audit and Accounting Guide3. Upon completion of applicable audits, the Sponsor must notify the RLPL in writing that the project is complete, including providing an estimate of the final reimbursement request as well as items identified in the following sections. When the Sponsor considers the project complete, the RLO must request an RLPL site visit along with assistance in completing NYS 1446-LA, Final Acceptance of Locally Administered Federal-Aid Project.
