STAND ALONE AGREEMENT. This Agreement is a comprehensive stand alone Agreement and prescribes employees terms and conditions whilst performing work under the contract the Company has in place at the Caltex Oil Refineries, Xxxxxxxx Street, Kurnell NSW 2061.Provided for purposes of meeting the no net detriment test this Agreement will be measured against the current relevant Awards: ➢ Metal and Engineering Industry (New South Wales) Award; ➢ Building &Construction Industry (State) Award. Insofar as the relevant industrial legislation allows the above relevant Award will also underpin this Agreement, provided where any inconsistency applies then the terms of this Agreement shall prevail to the extent of any inconsistency .On approval by the Industrial Commission of NSW this Agreement insofar as it relates to Company employees only, will replace Agreement IRC3969 of 2003.

STAND ALONE AGREEMENT. Except as specifically provided the terms of this Agreement shall operate to the exclusion of and shall supersede all Federal and State Awards or variations and all other industrial agreements which would otherwise operate to regulate wage rates and conditions of employment covered by this Agreement. This agreement excludes any award conditions that might otherwise apply in accordance with section 354 of the Act, to employees covered by this agreement in respect of: • rest breaks; • incentive-based payments and bonuses; • annual leave loadings; • public holidays; • monetary allowances; • loadings for working overtime or for shift work; • penalty rates; • outworker conditions; and any other award conditions specified as protected award conditions in Regulations made under the Workplace Relations Act 1996.
STAND ALONE AGREEMENT. This Agreement is a comprehensive stand alone Agreement and prescribes employees terms and conditions whilst performing work under the contract the Company has in place at the Xxxxx Xxxxx Oil Refinery. This Agreement shall override the following previously applicable Notional Agreements Preserving State Awards (“NAPSA’s”) • Metal and Engineering Industry (New South Wales) Award; • Building & Construction Industry (State) Award. This Agreement applies to the exclusion (to the extent permitted by law) of other laws, industrial instruments, awards, agreements (whether registered or unregistered), custom and practice and the like instruments or arrangements. For the purpose of this clause, the terms “award” or “awards” include a pre-reform federal award, a rationalized and/or simplified federal award, and a NAPSA. This Agreement expressly excludes and displaces the operation of any and all other matters and conditions of employment described or identified as: a preserved entitlement; a preserved notional term/entitlement; protected notional condition; protected preserved condition; preserved award term or protected award term or condition in any award, order, agreement or under State laws. These protected conditions include: • Rest Breaks; • Incentive based payments and bonuses • Annual leave loadings; • Observance of public holidays or payment in respect of those days; • Days to be substituted for public holidays; • Monetary allowances for expenses incurred in the course of employment or responsibilities or skills that are not taken into account in rates of pay for the Employee; • Disabilities associated with the performance of particular tasks or work in particular conditions or locations; • Loadings for overtime or shift work; • Penalty rates; • Outworker conditions; and • Any other matters specified in legislation or specified regulations.
STAND ALONE AGREEMENT. Except as specifically provided the terms of this Agreement shall expressly operate to the exclusion of and shall supersede all Federal Awards or variations and all other industrial agreements which would otherwise operate to regulate wage rates and conditions of employment covered by this Agreement.
STAND ALONE AGREEMENT. This is a Stand Alone Agreement however for purposes of complying with the ‘no net detriment test’ at the time of approval by the Industrial Commission of NSW this Agreement shall be measured against the: • The Asphalt and Bitumen Industry (NSW and ACT) Award.

STAND ALONE AGREEMENT. 5.1 This Agreement will operate as a standalone Agreement and operates to the complete exclusion of any other industrial instrument, including any modern award, national agreement preserving a State award, enterprise agreement or pre-reform enterprise agreement. 5.2 By virtue of the operation of section 57 of the Fair Work Xxx 0000 (Cth), no provision of any award or modern award applies to any employees to whom this Agreement applies.
STAND ALONE AGREEMENT. The parties agree that point 23.2 of the Framework Agreement constitutes a stand-alone agreement between the parties that applies regardless of whether the Framework Agreement in general is declared null and void.
