Termination by the Resident. This Occupation Right Agreement shall terminate upon the expiry of one calendar month’s written notice from the Resident terminating the Occupation Right Agreement for any reason PROVIDED HOWEVER that subject to clauses 3.2(j) and 3.2(k), the Resident shall continue to be liable for all payments under clause 3.
Termination by the Resident i. The Resident may terminate this Contract for any reason by submitting a Contract Cancellation Request online specifying Resident’s planned date of move-out at least 30 days prior to Resident’s planned move-out.
ii. If Resident submits a Contract Cancellation Request less than 30 days prior to Resident’s planned move-out, Resident will be charged the nightly Room and Board for each day short of a 30-day notification and pro rata rent until the Resident vacates the Room, and shall be responsible for any other term or condition of the approved release.
iii. If Resident fails to vacate the Room on the move-out date submitted on a Contract Cancellation Request form or, in the event of a relocation, three (3) days after Resident takes possession of Resident’s new space, Resident is responsible for pro rata rent until Resident vacates the Room. Any damages incurred by the University or Owner as a result of Resident’s failure to vacate the Room and a liquidated damages charge of $75.00 to cover administrative costs incurred by the University . Resident further understands and agrees that Resident will be responsible for all of University’s damages resulting from Resident’s holding over of the Apartment, as well the damages of any person who was unable to move in due to Resident’s holdover.
iv. If Resident’s admission is rescinded by the University prior to Resident’s announced Fall 2021 Move-In Date, or the scheduled move-in date for Residents entering at any other time during the academic year, there will be no liquidated damages or other fees charged.
v. If Resident terminates this Contract prior to the Resident’s scheduled move-in date while still an admitted UCR student, cancellation charges will follow the schedule below, which the Resident agrees are liquidated damages.
vi. All Contract Cancellation Requests submitted on or after Resident’s announced Fall 2021 Move-In Date, or the scheduled move-in date for Residents entering at any other time during the academic year, excepting conditions outlined above will be assessed according to the schedule below. Termination by the Resident. Resident may request termination of this Housing Contract by submitting a Contract Cancellation Request Form to Management. The Cancellation Request Form may be obtained from the Edgewood Commons Office. Said request will be processed and reviewed and the Housing Contract will only be terminated at the discretion of Management, provided that the request and supporting documentation is received prior to the end of the University’s Drop/Add period, as described in section 18, Terms of Financial Responsibility for Termination of Occupancy. In all instances, the burden of proof shall lie with the Resident to demonstrate grounds for early termination.
a. Supported Cancellation requests i. Withdrawal from FSU, for reasons other than Resident being disciplinarily dismissed.
Termination by the Resident. Agreement termination by the Resident, with thirty (30) days minimum written prior notice will be approved for the following reasons:
a. UCB non-student status due to withdrawal or termination of UCB affiliate status by Resident.
b. Marriage of the Resident subsequent to the Agreement acceptance.
c. Pregnancy with verifiable documentation.
d. An eligible Resident/replacement signs and accepts the Agreement. The Resident may request Agreement termination, however the University, in its sole discretion, will determine whether this Agreement may be terminated. For cancellation requests due to withdrawal, marriage, or pregnancy, accompanying documentation will be required. Cancellation requests from eligible Residents will only be approved when an eligible replacement accepts and signs an Agreement for the Resident’s space. Once the housing waiting list is exhausted, the chances of cancellation are slight. All requests for cancellation of the Agreement MUST BE SUBMITTED IN WRITING TO THE CAL HOUSING OFFICE USING THE “SINGLE STUDENT APARTMENT INTENT TO VACATE” FORM. This form is available at the Cal Housing Office located at 0000 Xxxxxxxx Xxx or at xxxxxxx.xxxxxxxx.xxx. Requests for Agreement cancellation will not be considered until the cancellation is requested in writing and you have submitted the appropriate supporting documents.
Termination by the Resident. By completing the application for summer residence, the resident agrees to be responsible for the room during the occupancy period outlined in their summer application. Requests to withdraw before the end of the occupancy period must be made in writing via e-mail to the Residence Office at xxxxxx.xxxxxxxxx@xxx.xxxxxxxx.xx no later than 30 days prior to the date the resident will vacate.
Termination by the Resident. 33.1 This agreement shall terminate upon the expiry of one (1) months written notice from you terminating the agreement.
33.2 You shall be liable for the Outgoings until such time as the Trust receives payment for an occupation right agreement for the unit from an incoming resident, subject to any reduction in the Outgoings pursuant to clause 35.4.
33.3 The Trust shall be entitled to recover all outstanding Service Charges as at the date you stop living in the unit.
Termination by the Resident. Note: Cancellation of this contract does not constitute withdrawal from VSU. Residents who withdraw from VSU should notify the Office of Housing and Residence Life by submitting a request for Release from Contract form.
A. Should a resident withdraw from VSU; this contract may be cancelled. This contract may be cancelled by the resident in the event of marriage, military obligations, official withdrawal from VSU and other reasons determined in the sole discretion of VSU to justify termination of the Contract. If the resident cancels the contract due to reasons indicated above before the start of the Summer I term (Maymester), the $100 will be refunded if no other financial obligations to VSU exist. If other financial obligations exist, the $100 may be applied towards those obligations. If a student is contracted for housing for the following Fall semester, the $100 deposit will be applied towards that amount due.
B. A resident who forfeits the privilege to live in the residence halls and who is asked to vacate the room as a result of the disciplinary action is not eligible for a refund of that semesters fees or the deposit.
C. Residents contracting for summer term and canceling after the residence halls officially open for the summer will be charged a minimum of 50% of that term’s housing fees. Any written request to buy out of the contract must be made to the Office of Housing and Residence Life.
D. Upon termination of contract or withdrawal from VSU, the resident has 24 hours to vacate their space. All personal property must be removed within 48 hours after a student withdraws, separates from the university, or after the residence halls close for the summer semester. A room- cleaning/removal charge will be assessed against any student who fails to remove their items or personal property within 48 hours of withdrawal or separation. Personal property left in bedrooms, hallways, stairwells, lounges, and other common areas will be considered abandoned property and will be considered property of Housing and may be donated or discarded. Please reference the Policies and Procedures page on our website for more details. VSU Housing and Residence Life will not be liable for any items left or abandoned by the residents after the 48-hour period has passed. Termination by the Resident. The Resident may terminate this Agreement immediately if Corporation breaches any material term of this Agreement, which breach has not been cured to the satisfaction of the Resident within thirty (30) days after notice of such breach.
