PLANT INSPECTION. The Owner or his/her authorized representative may inspect, at its source, any specified material or assembly to be used in the work. Manufacturing plants may be inspected from time to time for the purpose of determining compliance with specified manufacturing methods or materials to be used in the work and to obtain samples required for his/her acceptance of the material or assembly. Should the Owner conduct plant inspections, the following conditions shall exist:

a. The Owner shall have the cooperation and assistance of the Contractor and the producer with whom he has contracted for materials.
b. The Owner shall have full entry at all reasonable times to such parts of the plant that concern the manufacture or production of the materials being furnished.
c. If required by the Owner, the Contractor shall arrange for adequate office or working space that may be reasonably needed for conducting plant inspections. Office or working space should be conveniently located with respect to the plant. It is understood and agreed that the Owner shall have the right to retest any material which has been tested and approved at the source of supply after it has been delivered to the site. The Owner shall have the right to reject only material which, when retested, does not meet the requirements of the contract, plans, or specifications.
PLANT INSPECTION. Arthrex shall have the right to have qualified Arthrex employees, contractors or agents present at Bovie's manufacturing facility, at mutually agreeable times during normal business hours to (i) observe Bovie's manufacture of Products; (ii) inspect Bovie's facility and manufacturing procedures, as such relate to Products manufactured hereunder, and quality assurance/control procedures for compliance with (A) QSR, including GMP, as well as 180- 9001 registrations (provided and for such time that such standards remain valid) and EN 46001 certification, (B) ETL standards for testing and evaluation of each of the Products and (C) compliance with the ED Medical Device Directives in connection with the CE Marking; and (iii) inspect Bovie's inventory, work-in-process, raw materials, QSR records and such other matters as may be pertinent to proper quality assurance of Products to be delivered under the terms of this Agreement.

Manufacturing plants may be inspected from time to time for the purpose of determining compliance with specified manufacturing methods or materials to be used in the work and to obtain samples required for acceptance of the material or assembly.
a. The RPR shall have the cooperation and assistance of the Contractor and the producer with whom the Contractor has contracted for materials.
b. The RPR shall have full entry at all reasonable times to such parts of the plant that concern the manufacture or production of the materials being furnished.
c. If required by the RPR, the Contractor shall arrange for adequate office or working space that may be reasonably needed for conducting plant inspections. Place office or working space in a convenient location with respect to the plant.
PLANT INSPECTION. County or its designated representative may inspect the production of material, or the manufacture of products at the source of supply. Plant inspection, however, shall not be undertaken until County is assured of the cooperation and assistance of both Contractor and the material producer. County or its authorized representative shall have free entry at all times to such parts of the plant as concerns the manufacture or production of the materials. Adequate facilities shall be furnished free of charge to make the necessary inspection. County assumes no obligation to inspect materials at the source of supply.
PLANT INSPECTION. DSM PTG shall promptly notify SHC whenever a request for a plant inspection is received from the FDA that relates in any way to Licensed Product, and shall promptly advise SHC of any scheduled or unscheduled FDA inspection and the results thereof. A copy of Form 483 observations or other applicable reports, which apply to Licensed Product and redacted as deemed necessary by DSM PTG to protect proprietary information, shall be supplied to SHC upon its request, within ten business days of the request. DSM PTG shall promptly take steps to remedy any valid deficiencies found by the FDA inspectors relating to the manufacture, sterilization and packaging of Licensed Product, and to respond in writing to the Form 483 observations. DSM PTG shall provide SHC with a copy of its responses to any Form 483 observations relating to the Licensed Product in advance of their submission to FDA, redacted of any proprietary information, and shall notify SHC of the date such responses are filed with the FDA.
PLANT INSPECTION. If the Department inspects materials at the source, the following conditions shall be met:
(a) The Department shall have the cooperation and assistance of the Design-Builder and producer of the Materials.
(b) The Department shall have full access to parts of the plant that concern the manufacture or production of the Materials being furnished.
(c) For Materials accepted under a quality assurance plan, the Design-Builder or producer shall furnish equipment and maintain a plant laboratory at locations approved for plant processing of Materials. The Design-Builder or producer shall use the laboratory and equipment to perform quality control testing. The laboratory shall be of weatherproof construction, tightly floored and roofed, and shall have adequate lighting, heating, running water, ventilation, and electrical service. The ambient temperature shall be maintained between 68 degrees F and 86 degrees F and thermostatically controlled. The laboratory shall be equipped with a telephone, intercom, or other electronic communication system connecting the laboratory and scale house if the facilities are not in close proximity to each other. The laboratory shall be constructed in accordance with the requirements of local building codes. The Design-Builder or producer shall furnish, install, maintain, and replace, as conditions necessitate, testing equipment specified by the appropriate ASTM, AASHTO method, or VTM being used and provide necessary office equipment and supplies to facilitate keeping records and generating test reports. The Design-Builder or producer’s technician shall maintain current copies of test procedures performed in the laboratory. The Design-Builder shall calibrate or verify all balances, scales, and weights associated with testing performed as specified in AASHTO R18. The Design-Builder or producer shall also provide and maintain an approved test stand for accessing truck beds for the purpose of sampling and inspection. Cast iron grinding pots and rubber mauls will be furnished by the Department where required. The Department may approve a single laboratory to service more than one plant belonging to the same Design-Builder or producer. PLANT INSPECTION. In addition to quality audits by Customer as provided in the Quality Agreement, Customer shall have the right to have qualified Customer employees present at Supplier’s manufacturing facility, at mutually agreeable times during normal business hours, to (i) observe Supplier’s installation and qualification of equipment and processes and manufacture of Products; (ii) inspect Supplier’s facility and manufacturing procedures as relates to Products manufactured hereunder, and quality assurance/control procedures for compliance with GMP; and (iii) inspect Supplier’s inventory, work-in-process, raw materials, GMP records, and such other matters as may be pertinent to proper quality assurance of Products to be delivered under the terms of this Agreement. Customer’s personnel and/or duly authorized representatives exercising this right of inspection shall comply with all applicable Supplier rules and regulations provided by Supplier to Customer. PLANT INSPECTION. The shell boiler plant shall be subjected to a plant inspection within the limits fixed by the employ- er/user in his risk assessment/safety evaluation. The plant inspection consists of an inspection of good order and a technical inspection.
5.1.1 Inspection of good order During the inspection of good order (cf. TRBS 1201 and TRBS 1201-2) it shall be checked whether the mode of operation (e.g. pressure and temperature) corresponds to the intended mode of opera- tion laid down in the risk assessment/safety evaluation and the requirements of the permission. In this case, the orderly documentation of maintenance work shall be checked as to which extent the safety of pressure-retaining walls of the pressurized plant or the plant component has been influenced. During the inspection of good order within periodic inspections, the documentation shall be examined for availability and conclusiveness with special emphasis to be placed on former inspections. In the case of periodic inspections of good order it shall especially ascertained whether
(1) the type or the mode of operation has been changed since the last inspection according to statements made by the employer/user (not only safety relevant changes)
(2) maintenance work has been performed according to statements made by the employer/user, which may impair plant safety
(3) the prescriptions, if any, laid down by the authorities in the licence or permission have been satisfied
(4) the required documents (e.g. documentation on former inspections, such as inspection prior to putting into service*, periodic inspections, inspections as ordered, and specific inspections under the responsibility of the manufacturer) are available
(5) the requirements as to type, extent and periods of inspection have been defined and satisfied. Where changes were made on the plant, the respective documentation for the changed plant compo- nent shall be submitted. During the inspection of good order the documents submitted for the inspection prior to first putting into service*, upon an essential change or change of equipment and facilities need only be examined to the extent required for performing the technical inspection. During the inspection of good order the operational records shall be checked for observance of the prescriptions, e.g. laid down in operating instructions.
