Third Party Software and Services. Company acknowledges that Third Party Products may constitute part of the Licensed System. Company’s use of Third Party Products shall be subject to the terms and conditions of this Agreement; provided, however, access, use, maintenance and support of Third Party Products made available to Company after an applicable License Effective Date may be conditioned upon Company’s execution of an agreement with the applicable Third Party Provider (“Third Party Agreement”) which would provide for certain rights and obligations between the Company and the Third Party Provider (“Direct Third Party Product”), in which case the terms of the Third Party Agreement will also apply to Company’s use of the particular Third Party Product. Notwithstanding the foregoing sentences of this Section 2.3, Company acknowledges that BNYM is not responsible for, nor does BNYM warrant the performance or other features of, nor can it fix errors or defects in, third party software and services and BNYM’s sole obligation with respect to third party software and services is to inform the third party of any errors, defects, deficiencies or other matters regarding the third party software and services of which BNYM is made aware by Company and to request and pursue in a commercially reasonable manner remediation of the errors, defects or deficiencies by the third party to the extent BNYM reasonably determines remediation to be available pursuant to the terms of BNYM’s agreement with the third party.
Third Party Software and Services. Use of software or services other than those provided by Axon is governed by the terms, if any, entered into between Customer and the respective third-party provider, including, without limitation, the terms applicable to such software or services located at xxx.xxxx.xxx/xxxxx-xxxxx- and-conditions, if any.

Third Party Software and Services. This Section 3.5 applies to Third- Party Software and Services offered by ESO. Refer to the product table following the Agreement for applicability.
3.5.1. ESO neither accepts liability for, nor warrants the functionality, utility, availability, reliability or accuracy of, Third-Party Software or Third-Party Services. The Third-Party Software “EMS1 Academy” and/or “FireRescue1 Academy” and/or “EMS1 & FireRescue1 Academy – Implementation and Configuration” and/or “Learning Management System” and/or “EVALS Implementation” (collectively, “Education”) is offered by ESO in collaboration with Xxxxxxx, f/k/a The Praetorian Group. If Customer subscribes to Education, Customer acknowledges and agrees to the terms and conditions of the Praetorian license agreement, located at xxxx://xxx.xxxxxxxxxxxxxxxxx.xxx/LMS-Master-Service-Agreement, which shall supersede this Agreement as it applies to Customer’s use of Education and any Customer Data stored therein.
Third Party Software and Services. (1) Third Party Software and Services means;
(a) Google Docs or Google Apps (hereinafter, "Google Software"), or
(b) Evernote Software or Evernote Service (hereinafter, "Evernote Software"), or
(c) Salesforce CRM (hereinafter, "Salesforce CRM")
(2) Google Software is a service provided by Google Inc., and Evernote Software is a service provided by Evernote Corporation, not by PFU. Google Software and Evernote Software shall not constitute any part of the Software. PFU shall not be responsible for providing any support service or maintenance service of Google
Third Party Software and Services. Customer is required to purchase directly from third party providers other related third party software licenses and services necessary to support the Hosted Web Services environment, including, but not limited to, secure certificates.

Third Party Software and Services. If Liberty anticipates using any software developed or otherwise owned by a third party, including but not limited to the Genelco Software (together with any and all associated documentation, "Third Party Software"), to provide any Base Services or Additional Services, Liberty shall identify in writing to UFL: (1) the nature of the Third Party Software, (2) its owner, (3) any restrictions or royalty terms applicable to Liberty's or UFL's use of the Third Party Software, (4) the source of Liberty's authority to employ the Third Party Software in the provision of Base Services or Additional Services, (5) any modifications to the Third Party Software made by or for Liberty and whether such modifications or enhancements are owned by Liberty or the third party vendor of the Software, and (6) whether the object and/or source code (and appropriate use license) for the Third Party Software will be delivered to UFL by Liberty upon termination or expiration of this Agreement. The Third Party Software as of the date of this Agreement is set forth on Exhibit N. If Liberty anticipates using any services provided by a third party to provide any Base Services or Additional Services, Liberty shall identify in writing to UFL: (1) the nature of the third party service and (2) the identity and address of the entity, person or persons providing such service. On a quarterly basis, within the first two weeks of each calendar quarter, Liberty shall deliver to UFL a written update of all information required to be provided pursuant to this Section 4.06.

In connection with your use of the Cloud Services, solely as a convenience for you and solely at your election, Cloudcontainers may make available to you the use of certain third party software and/or services (“Third Party Software and Services”). Cloudcontainers is not liable or responsible for claims, damages, losses or any other complaints arising out of or related to your use of such Third Party Software and Services. Your use of any Third Party Software and Services are subject to the terms and conditions directly between you and the applicable third party vendor and at your own risk. You hereby acknowledge that no purchase or license of any Third Party Software and Services is required to use the Cloud Services.
