Transfers to Positions Within the Bargaining Unit An employee temporarily or permanently transferred or promoted to a higher classification shall receive the commencement rate of pay for the new classification, commensurate with qualifications, or the next higher rate of pay on the wage grid which is equal to or greater than the employee’s present rate of pay. Full-time employees who agree to temporarily transfer to a lower classification at the request of the Employer, shall continue to receive present rate of pay plus any increases to that rate required by the Agreement. An exchange of job duties may take place if (a) both employees agree; the respective employee’s supervisors agree; and the positions are in the same classification. Such transfers shall be for the time period agreed upon among the parties involved.

Transfers to Positions Outside the Bargaining Unit. (a) Transfers to Non-Union Positions with the Corporation of the City of Guelph: An employee may accept a transfer to a non-Union position with the Corporation of the City of Guelph, outside of the scope of the CUPE 973 collective agreement, on one (1) occasion for a period of up to fifteen (15) months within a thirty-six (36) month period. The employee’s accumulated seniority within the bargaining unit would be retained at the time of the transfer but they would not accumulate seniority, while in the non-Union position. When they return to their Union position the employee would have their seniority at the time of the transfer and begin to accumulate seniority again. For clarity, individuals who transfer into non-Union positions will not accumulate seniority while in the non-Union position and as a result, their ranking on the seniority list may change.

  • Transfer and Seniority Outside Bargaining Unit No employee shall be transferred to a position outside the bargaining unit without his consent. If an employee is transferred to a position outside of the bargaining unit, he shall retain his seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. If such an employee returns to the bargaining unit within twelve (12) months, he shall be placed in a job consistent with his seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.
