Unauthorized Occupancy. This Contract and your accommodation cannot, under any circumstances, be assigned, “sublet,” lent out, or otherwise to any person other than you. Unauthorized assignments will be considered a breach of the Contract and will result in the eviction of you and the other person(s) occupying the room. If you wish to withdraw from residence, you must consult with the Student Residences administration office first. If you are temporarily or permanently alone in a room or suite with more than one bed space (AVM suite or a double room in MSH or UCR), the second room / bed space is not to be utilized in any way before the arrival of the other occupant(s). Any sign of usage in an unassigned room /bed space may result in additional cleaning charges to the original occupant(s).

Unauthorized Occupancy. If you refuse to vacate a room or residence when no longer authorized to remain in NDNU housing, you will be liable for any costs incurred by NDNU in removing such student, including attorneys’ fees, court costs, or storage fees. You may not remain as a guest in someone else’s room after checking out. Occupying a room or residence without authorization may result in withdrawal of current and/or future housing privileges and/or referral to the Office of the Xxxxxxx. Additionally, if you or your guest occupies a room or residence without authorization, you will be charged an administrative fee of $100 for unauthorized occupancy for each day or portion thereof until the space is completely vacated. Cancelling or Terminating Your Residence Agreement You can cancel your assignment up until the time you accept your key and/or move into housing with the payment of an administrative fee (shown below). If you wish to terminate your contract after you have picked up your key or moved into housing, you will need to apply to terminate by filing a Termination of Occupancy Form. There may be administrative fees and/or housing charges required for terminating your contract and vacating your residence early (see Terminating your Agreement below). The administrative fees are determined by the date that you cancel your assignment or fail to move into housing. Subject to the payment of the administrative fees described below, NDNU will credit any housing charges for the cancelled period. Pre-occupancy Cancellation Dates and Administrative Fees NDNU has established certain administrative fees (the “administrative fees”) to compensate NDNU for the cost of administering requests for particular exceptions to the terms of this Agreement, and in some instances to reflect the damages NDNU is likely to suffer as a result of noncompliance with this Agreement. By signing this Agreement, you agree that the administrative fees are a reasonable estimate of the additional administrative costs that will be incurred by NDNU in these circumstances, and the administrative fees are presumed to be the amount of damage or expense NDNU will sustain, since it would be impracticable or extremely difficult to fix the actual cost or expense. Unauthorized Occupancy. If any of Licensee’s Facilities are found occupying any portion of any of the Burlington Fiber System other than as set forth in Exhibit A the City may, without prejudice to its other rights or remedies under this Agreement, require Licensee to remove the unauthorized occupancy within ten (10) days of receipt of written notice from the City regarding Licensee’s unauthorized use and the City may assess an unauthorized occupancy fee at the rate of five hundred dollars ($500.00) per day for each day of the unauthorized occupancy after expiration of such ten (10) day notice. In addition, if at the end of such ten (10) day period, Licensee has not removed the unauthorized occupancy, the City may, at its sole option, remove Licensee’s Facilities at Licensee’s expense and the City shall be indemnified by Licensee for such work; provided however that if such unauthorized occupancy results in a threat to the public’s safety health or welfare or imminent threat of interruption of fiber services the City may remove Licensee’s Facilities without notice.. No act or failure to act by the City with regard to said unlicensed use shall be deemed as ratification of the unlicensed use.

Unauthorized Occupancy. If the Resident occupies the Premises without written authorization before the Check-In Date, during a University break period (except as expressly permitted under this Contract), after the Termination Date, or after the Resident is no longer eligible to occupy University Housing, the Resident shall be deemed to be in breach of this Contract and the University shall be entitled to those remedies for breach of this Contract set forth in Section “J” below, including without limitation the right to revoke the Resident's privilege to occupy any University Housing, to exercise all remedies available at law or in equity to regain possession of the Premises and obtain damages from the Resident for such breach. Without limiting the preceding sentence, the Resident agrees that he/she shall be obligated to pay $200.00 per day for each day or part thereof in which the Resident occupies the Premises without University authorization until the Resident has completely vacated the Premises and returned all keys to the Housing Customer Service Center designated for the Premises.
