Use Defined. Tenant/Operator and Owner agree that Tenant/Operator’s use of the Restricted Property (the “Use”) shall be in a manner consistent with both (i) Tenant/Operator’s conditional use application and the conditional use permit issued by the City of New Orleans, including the provisions issued by the City Planning Commission, and (ii) each of the following conditions: (a) Tenant/Operator shall maintain on a daily basis a clean sidewalk area in front and on the sides and rear of the Tenant/Operator’s portion of the Restricted Property that is kept free from trash, debris and obstruction. (b) Tenant/Operator shall not seek a video poker license and shall not allow the operation of video poker or other wagering, gaming or gambling operations or equipment on the Property. (c) Tenant/Operator shall operate, during all hours of operation of the Property, a complete with staff on the Restricted Property using a full program similar in nature to the program proposed at the time of the Application and attached hereto as Exhibit A and made part hereof. (e) Tenant/Operator shall serve alcoholic beverages only in conjunction with table service of meals. The use of “to-go” cups for all alcoholic beverages shall be prohibited. (f) Tenant/Operator shall not play, or allow to be played, any recorded music or excessive noise that will be audible outside of the building and there shall be no live (amplified) music or entertainment allowed at any time. (g) Tenant/Operator agrees that all signage visible from the exterior of the building will not be back-lit, illuminated or of a neon nature and that promotional signage will not be visible from the sidewalk through the windows or any façade of the building. Tenant/Operator further agrees that the all exterior signage must meet with the approval of the Historic District Landmarks Commission and be appropriately scaled for the Street corridor. (h) Hours of operation shall be limited to 11:00 am until 10:00 pm Sunday through Thursday and 11:00 am until 11:00 pm on Friday, and Saturday. ??? Use Defined. The Premises shall be used for the purposes set forth in the Lease Summary only and for no other purpose or use. Tenant shall operate its business at the Premises under the trade name set forth in the Lease Summary and shall not change its trade name without Landlord's prior written consent. Notwithstanding the foregoing, subject to Landlord's prior written consent, in the event Tenant changes the trade name of a majority of its stores in California, Tenant shall change the trade name of its store located at the Premises to such trade name. Tenant shall not conduct any sidewalk sale, auction, distress sale, or going-out-of-business sale on the Premises, without the prior written consent of Landlord. Tenant shall use the Premises in such a way as not to annoy other tenants of the Shopping Center or create a nuisance or cause the cancellation of any insurance policy covering the Premises. Tenant shall keep the Premises, front and rear walkways adjacent to the Premises and any service delivery facilities allocated for the use of Tenant, clean and free from rubbish and dirt at all times and shall store all trash and garbage within the Premises or in designated garbage areas.
Use Defined. When the sporthall is unmanned, access to the pool and changing rooms is not permitted, as is the hot tub and sauna. The sport hall is only for rent when the sports center is unmanned. There are no requirements for a minimum number in defined times and the rental price does not depend on the number. All consumption of alcohol, intoxicants and nicotine products is prohibited in and around the sport center and the person responsible is responsible for following the rules and regulations. Katla Youth and leisure association have a priority in organizes exercises and use of the sport center. It is important, however, that this is done in consultation and that all parties are satisfied.

Tenant shall not use any portion of the Premises for a discount department store, “dollar” store, firearms and/or ammunition store establishment, charity thrift shop or the like, adult book store or adult entertainment establishment, or any liquor store which sells single beers or hard liquor in containers holding less than one pint except as permitted by state or local statute, regulation or permit (provided the foregoing shall not limit or restrict the operation of a brewery including a restaurant and/or bar/tasting room).
