Litter Abatement. Franchisee shall use due care to prevent Garbage or Recyclable Materials from being spilled or scattered during the Collection or transportation process. If any Garbage or Recyclable Materials are spilled during Collection, Franchisee shall promptly clean up all spilled materials. Each collection vehicle shall carry a broom, shovel and oil spill kit at all times for this purpose.
Litter Abatement. 599 A. Minimization of Spills. FRANCHISEE shall use due care to prevent vehicle oil, fuel, hydraulic fluid, 600 and other substances that may leak from vehicles from being spilled or scattered during Collection 601 and Transportation operations, in accordance with Applicable Law. If any Construction and 602 Demolition Debris is spilled or scattered during Collection or Transportation operations, 603 FRANCHISEE shall promptly clean up all spilled and scattered materials. 604 FRANCHISEE shall not transfer loads from one vehicle to another on any public street, unless it is 605 necessary to do so because of mechanical failure, hot load (combustion of material in the truck), 606 accidental damage to a vehicle, or unless approved by CITY. 607 If FRANCHISEE fails to perform some or all of the requirements described in this Section, 608 FRANCHISEE shall pay CITY Liquidated Damages as described in Section 11.4 and Exhibit A.

Contractor shall discuss instances of repeated spillage not caused by it operation with the customer of the premises where spillage occurs, and Contractor shall report such instances to City. Contractor shall cover all containers at the pickup location before transporting materials to prevent permitted materials from escaping during transportation.

Contractor shall conduct public outreach and staff training to Customers on best management practices for litter abatement at no extra charge. Such best management practices include, without limitation: Closing Container lids and right sizing service: Contractor staff will tag overfull Containers with Courtesy Notices, which will serve as outreach and education to the Customer. Photos of the Container will be taken by drivers, attached to the Customer’s account, and will be available to outreach and Customer service staff in order to demonstrate to the Customer where a problem exists. Outreach to Customer on importance of bagging lightweight materials such as plastic bags, film plastics, foam peanuts, and other materials that can easily become litter due to their lightweight nature. Driver training on litter reduction techniques and litter removal best management practices. Affixing signage to the back of Contractor trucks which provides a phone number for residents to report material spills.

Contractor shall cover all open Drop Boxes at the pickup location before Transporting materials to the Approved Facility. Contractor shall conduct public outreach and staff training to Customers on best management practices for litter abatement as part of the public outreach program. Such best management practices include, without limitation:
