Vacation Pay and Holidays. Buyer shall credit to each Transferred Employee all unpaid vacation and holiday pay for calendar year 2005 that the Transferred Employee is entitled to use for calendar year 2005 but has not used as of the Effective Time and shall assume all liability for the payment of such amounts pursuant to the Seller vacation and holiday pay policies listed in Schedule 5.15(e) to the extent such vacation and holidays are taken in calendar year 2005; provided, however, that no credit under this Section 8.3(e) shall duplicate credit under Section 8.3(c).

Vacation Pay and Holidays a. The Employee shall be entitled to an annual vacation leave of three (3) weeks at full pay. The time for such vacation shall be selected by the Employee and approved by the Employer and can be accrued up to twelve (12) weeks total- in lieu of the vacation leave herein before specified, the Employee may elect to receive payment for the whole or any portion of the vacation time to which he is entitled, such vacation time to be valued at the amount of the Basic Salary earned by the Employee during an equivalent period of time. b. The Employee shall, in addition, be entitled to holidays on the following days with full pay, plus any additional holidays granted to other executive employees: New Year's Day Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day One (1) Floating Holiday
Vacation Pay and Holidays. Buyer shall credit to each Transferred Employee all unpaid vacation and holiday pay for calendar year 2006 that the Transferred Employee is entitled to use for calendar year 2006 but has not used as of the Effective Time and shall assume all Seller's liability to each Transferred Employee with respect to such unpaid vacation and holiday pay; provided, however, that no credit under this Section 8.3(e) shall duplicate credit under Section 8.3(c); provided, further, however, that if the Cut-Off Date occurs on or after October 28, 2006, then Buyer shall not credit any unpaid vacation pay for calendar year 2006. Buyer and Seller acknowledge and agree that in accordance with Buyer's policies, no Store Employees shall be entitled to use any accrued vacation time during the months of November and December and that any unused vacation time will be forfeited, and Buyer shall have no obligation to make any payment in respect thereof, at the end of the calendar year.

  • Vacation, Sick Leave and Holidays Executive shall be entitled to four (4) weeks (28 business days) of vacation, and also sick leave and holidays at full pay in accordance with the Company’s policies established and in effect from time to time.

  • Vacation and Holidays Executive will receive four weeks of paid vacation each year in addition to all holidays observed by the Company and its subsidiaries. Executive may carry over, in the aggregate, up to four weeks of unused vacation to a subsequent year. Any unused vacation time in excess of four weeks will not accumulate or carry over from one calendar year to the next. Each calendar year, Executive shall take not less than one (1) week vacation.

  • OVERTIME AND HOLIDAY PAY 5.3.1 All hours worked by an employee in excess of eight (8) hours per shift and in excess of forty (40) straight time hours per week shall be paid for at the rate of one and one-half times the straight time rate. All hours worked by an employee in excess of ten (10) hours per shift and all hours worked on Sunday shall be paid at the rate of double the straight time rate. 5.3.2 Additional holidays recognized in the Construction Industry in each geographical area will be observed on all work covered by this Appendix.

The foregoing, however, shall not be construed to require the Company to establish any such plans or to prevent the modification or termination of such plans once established.

  • Vacation; Sick Leave During the Employment Term, the Executive shall be entitled to not less than four (4) weeks of vacation during each calendar year and sick leave in accordance with the Company’s policies and practices with respect to its executives.
