Warranty Limitations and Exclusions. The limited warranties with respect to Systems, Parts & Components, Media & Software, (collectively, “Product” or “Products”) are subject to the following exclusions and limitations:

1) Exclusions The following situations are not covered by the warranty:
a) Normal wear and tear of the Acer Product.
b) Any defects due to repair, modification or damage to the Acer Product performed by anyone other than an AASP.
c) Any defect that results directly or indirectly from the use of parts not manufactured or sold by Acer.
d) Any defect resulting from operations that are not mentioned in the Acer Product’s user guide.
e) Minor defects of LCD displays occurring in Products equipped with LCD display technology, provided that there shall not be more than four (4) defective pixels per million pixels on a given LCD display, and provided further that, if the display panel is divided into nine (9) equal rectangular areas, there shall be one defective pixel in the central area of the display.
f) Loss or damage of the Recovery/Resource CD (RCD).
g) Any damage that occurs due to transportation, fall, weather, extreme temperatures, shock, mishandling or other misuse of or negligence to the Acer Product after purchase.
h) Any defects due to natural disasters, e.g., fire, flood damage, earthquake and irregular voltage sources.
i) When customers cannot provide the sales receipt or purchase invoice or duly completed Warranty Instructions for the Acer Product.
j) When any alterations whatsoever are made to the Warranty Documents (receipt, invoice or the Warranty Card) regarding without limitation the date of purchase, the customer’s name, the reseller’s name or the serial number.
k) This warranty applies to the purchased Acer Product only. This warranty does not extend to Expendable Parts. Expendable Parts are those items that during the normal course of Acer Product usage will require periodic replacement (eg. Notebook Batteries).
l) This warranty does not apply to any software preloaded on or otherwise sold with the Acer hardware products. All software is provided “as is” and Acer disclaims any and all warranties, express or implied, including but not limited to any implied warranty of non-infringement of third-party rights, merchantability or fitness for a particular purpose. Acer does not warrant that the software will be error free or that the software will meet your requirements.
m) Products purchased from any source other than Acer or Authorized Vendor.
n) Acer is not responsible for any damage to or loss of any programs, data or removable storage media. You are responsible for saving (backing up) any programs, data or removable storage media.

Warranty Limitations and Exclusions. The obligation of StandardAero under this Warranty is limited to the repair or replacement of the parts which failed due to defects in StandardAero’s workmanship. In the event that life limited parts covered by this Warranty are damaged beyond repair, StandardAero shall only be obligated for the value of the remaining life of such parts.

Xxxxxx+Gyr’s warranty obligations with respect to the Equipment and Software comprising the System do not apply to the extent a failure or warranty non-conformity is caused by: Customer’s or a third party’s infrastructure or data; Customer’s or a third party’s misuse of the equipment or software comprising the System; installation by Customer or a third party not in compliance with training or manuals provided by Xxxxxx+Gyr; operation, maintenance or use by Customer or third parties not in compliance with applicable training, manuals or specifications provided by Xxxxxx+Gyr; Customer’s or a third party’s neglect, modification, accident, vandalism or other intentional damage; exposure to adverse conditions exceeding performance levels required by applicable specifications; or any other limitation or exclusion described herein; data provided by Customer.

Warranty Limitations and Exclusions. 10.2.1 ALL CLAIMS ARISING UNDER THE WARRANTY MUST BE FILED BY NEXUS NO LATER THAN NINETY (90) CALENDAR DAYS AFTER THE EXPIRATION OF THE WARRANTY PERIOD (AS DEFINED IN SECTION 10.1) FOR THE PRODUCT.
10.2.2 THE WARRANTIES SET OUT IN THIS AGREEMENT, INCLUDING WITHOUT LIMITATION THE PRODUCT WARRANTY PROVIDED UNDER SECTION 10.1, ARE THE SOLE WARRANTIES PROVIDED BY AMS. AMS MAKES, AND NEXUS RECEIVES, NO OTHER WARRANTY EITHER EXPRESSED OR IMPLIED. ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, AND ALL IMPLIED WARRANTIES OF TITLE FOR ANY CONSIGNED OR NEXUS SUPPLIED MATERIALS, IF ANY, ARE EXPRESSLY DISCLAIMED AND EXCLUDED HEREFROM. FOR THE AVOIDANCE OF DOUBT, THE PROVISIONS OF THIS SECTION DO NOT DEROGATE FROM THE OTHER WARRANTIES CONTAINED IN THIS AGREEMENT.
10.2.3 UNLESS EXPRESSLY AGREED TO BY AMS IN WRITING, AMS MAKES NO WARRANTY THAT THE PRODUCTS WILL MEET ANY SPECIFICATION NOT MADE KNOWN TO AND AGREED TO BY AMS, EXCLUDING SPECIFICATIONS PROVIDED BY NEXUS IN ACCORDANCE WITH THIS AGREEMENT.

DISCOVER DISCLAIMS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ALL OTHER WARRANTIES AND/OR GUARANTEES, EXPRESS OR IMPLIED, AND, AS SUCH, THE SAME SHALL NOT APPLY TO THE BATTERIES. IN NO EVENT SHALL DISCOVER BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER FOR ANY REASON (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOSS OF USE, LOST EQUIPMENT OR LOST REVENUES) REGARDLESS OF THE LEGAL THEORY ON WHICH ANY SUCH CLAIM MAY BE MADE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, EXCEPT AS EXPRESSLY SET FORTH ABOVE, NEITHER PARTY MAKES ANY REPRESENTATIONS OR WARRANTIES CONCERNING QUALITY, PERFORMANCE OR ACCURACY OF THE SERVICES OR THE PROMOTION, THAT THE SERVICES OR THE PROMOTION WILL SATISFY GOBRANDS’ OR THE CUSTOMERS’ REQUIREMENTS OR NEEDS, AND DOES NOT ASSUME, AND EXPRESSLY DISCLAIMS, ANY LIABILITY TO ANY PERSON OR ENTITY FOR LOSS OR DAMAGE CAUSED BY ERRORS OR OMISSIONS IN THE SERVICES OR THE PROMOTION. EXCEPT AS OTHERWISE PROVIDED HEREIN, UNDER NO CIRCUMSTANCES WILL FRESHLY, GOBRANDSOR THEIR RESPECTIVE PERSONNEL, AFFILIATES OR REPRESENTATIVES BE LIABLE FOR ANY SPECIFIC PERFORMANCE OR FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL LOSS, EXPENSE OR DAMAGES OF ANY KIND OR NATURE, ARISING OUT OF OR IN ANY WAY RELATED TO THE SERVICES OR THE PROMOTION, ANY AGREEMENT OR THIS AGREEMENT, WHETHER FOR LOST GOODWILL OR PROFITS, LOSS OF BUSINESS RELATIONSHIPS, LOSS OF DATA, WORK STOPPAGE OR IMPAIRMENT OF OTHER GOODS AND WHETHER BASED ON CONTRACT, TORT, OR OTHER THEORY OF LIABILITY, EVEN IF FRESHLY OR GOBRANDS KNOWS OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGE, AND WHETHER OR NOT ANY EXCLUSIVE REMEDY FAILS OF ITS ESSENTIAL PURPOSE. REASONABLE CARE MUST BE USED TO AVOID HAZARDS. SELLER EXPRESSLY DISCLAIMS RESPONSIBILITY FOR LOSS OR DAMAGE CAUSED BY USE OF ITS PRODUCTS OTHER THAN IN ACCORDANCE WITH PROPER OPERATING PROCEDURES. Statements made by any person, including representative of Seller, which are inconsistent or in conflict with the terms of these warranties shall not be binding upon Seller unless reduced to writing and approved by an officer of Seller.
Warranty Limitations and Exclusions. Our Warranty obligations do not apply to the extentcaused by:
a. Reasonable wear and tear, or superficial defects, dents or marks that do not impact the performance or integrity of our Products;
b. Normal corrosion;
c. use of unapproved parts or unproved alterations to components to the extent prohibited by our Product Care Guidelines;
d. vandalism or misuse
e. a Force Majeure Event;
f. accidents or damage caused by you, including, but not limited to, scratching of polycarbonate roofing;
g. dirt, dust, bird excrement, animals, insects, foliage or algae growth;
h. pre-existing conditions of your home, including the structure and ground conditions;
i. someone other than us installing, altering, removing, re-installing or repairing any part of your Product;
j. Where the Archgola is outside of either marine, industrial or geothermal zone, a failure to clean it every six (6) months.
k. Where the Archgola is in a marine zone (i.e. within 500m of the sea or salt water lake), a failure to clean residual salt at least every two (2) months.
l. Where the Archgola is in an industrial zone, a failure to clean residual chemicals from any industrial pollution by washing at least every three (3) months.
m. Where the Archgola is in a geothermal area, a failure to clean the frame every three (3) three months.
n. The powder coated surfaces must not be exposed to any caustic or spirit based cleaners under any circumstances. Nothing in this warranty limits or voids any supplier or manufacturer’s warranty which provides you with additional and/or greater warranty rights set out in this Warranty information. We will assign to you any Manufacturer Warranties relating to the Products and/or Services we supply to you which exceed our warranty periods set forth in these “Warranty Details”.
