Website Notice. The Settlement Administrator will establish and maintain the Settlement Website. The Settlement Website will be dedicated to the Settlement. On the Settlement Website will be posted the Long Form Notice, the Claim Form, a copy of this Agreement, the Preliminary Approval Order, and any other materials the Parties agree to include. The Settlement Website shall also provide for the straightforward and user-friendly online submission of Claim Forms, and instructions as to how to access the case docket via PACER or in person at any of the Court’s locations. The Settlement Website shall also state the date of the Fairness Hearing, that the date may change without further notice, and that Settlement Class Members should be advised to check the Settlement Website or the Court’s PACER site to confirm that the date has not been changed. These documents and information shall be available on the Settlement Website no later than the Notice Deadline and remain until 30 days after distribution of all Settlement Awards. The Settlement Website shall not include any advertising and shall not bear or include Defendant’s logo or trademarks.

The Settlement Administrator will establish and maintain a Settlement Website using a domain name dedicated to the Settlement, posted on which will be the Website Notice and other settlement-related documents. The Mail Notice shall direct recipients to the location of the Website Notice. The Settlement Website will be established no later than 30 calendar days following the date of this Order and shall remain active at least until the date of Final Approval.

The Claims Administrator shall post on the website a long form of the Notice in a Question and Answer format which sets forth the details of the settlement, and the rights of Settlement Class members to participate in the Settlement, to exclude themselves, or to object to the settlement.
Website Notice. By the Settlement Notice Date, the Claims Administrator shall maintain and administer a dedicated settlement website (www. .com) containing class information and related documents, along with information necessary to file a claim, and an electronic version of the Claim Form members can download, complete and submit electronically. At a minimum, such documents shall include the Settlement Agreement and Exhibits, the Notice, the Q & A Form Notice, the Preliminary Approval Order, a downloadable Claim Form for anyone wanting to print a hard copy and mail in the Claim Form, the operative complaint, and when filed, the Final Approval Order.
Website Notice. Within five (5) business days of entry of the Preliminary Approval order, the Settlement Administrator will post the Website Notice in a user- accessible format on the Settlement Website.
4.4.1. Class Counsel, Defendants’ Counsel, and the Settlement Administrator will jointly select the domain name for the Settlement Website.
4.4.2. The Settlement Website will include the claims forms and Opt-Out Form; answers to frequently asked questions; a list of important deadlines; case documents; and the contact information for the Settlement Administrator and Class Counsel. Defendants’ Counsel and Class Counsel must agree to any additions or revisions to the Settlement Website design or content.
4.4.3. The Settlement Website will remain active for at least one hundred eighty (180) days following the Effective Date of the Settlement, or until ninety (90) days after the second distribution in § 2.5. However, the Settlement Administrator will disable online submissions through the claim form and the Opt-Out Form immediately following the Claims Deadline and the Objection and Exclusion Deadline.

The Claims Administrator will establish a Settlement Website for the purposes of disseminating the Class Notice, this Agreement, information relating to filing a claim, opting out of the Settlement, objecting to the Settlement, deadlines relating to the Settlement, pleadings and other information relevant to the Settlement, to Class Members. The Claims Administrator shall establish the Settlement Website within 30 days of: (i) Preliminary Approval in this Action or (ii) preliminary approval of the settlement in In re Nutella Marketing and Sales Practices Litigation, whichever is later. In the event that the court does not approve the settlement in In re Nutella Marketing and Sales Practices Litigation, the Settling Parties in this Action shall meet and confer regarding an amended form of Website Notice. The Settlement Website also shall contain an electronic Claim Form to allow on-line submission of claims as well as a Claim Form which can be downloaded, printed and mailed to the Claims Administrator.
