Where an employee in a redundant position refuses to accept a transfer for which he/she is qualified, the employee shall be terminated with the appropriate severance pay as stated in Article 13.14 below.
Where an employee representative makes a written requirement for payment of piece-work to the enterprise or its representative, the enterprise must reply to such requirement within six work- days.
Where an employee applies for a leave of absence without pay, it will be granted subject to approval of the Employer.
Where an off-duty employee is called-out and has already been compensated for the three (3) hours of pay outlined in Article 10.01, said employee is not eligible for the three (3) hours of pay again unless more than three (3) hours has elapsed between the start of the first incident and the commencement of the second incident of call-out.
Where an excess employee agrees to transfer to a position of a lower substantive classification level, the employee will continue to receive their existing salary for the remainder of the retention period.
77.8 Notice of termination All excess employees will receive four weeks notice of termination. Excess employees who are over 45 years of age or with greater than 5 years service with CASA will receive five weeks notice of termination. This notice period may be paid in lieu.
77.9 Assistance with career transition
Where an employee’s employment terminates during a period of annualisation (as per clause 9.1), the employer shall provide the employee with two weeks written notice of any monies owed/owing as follows:
Where an employee qualifies for bereavement leave, during a leave of absence and/or vacation, there shall be no deduction from vacation credits for such absence. The period of vacation so displaced shall either be added to the vacation period or reinstated for use at a later date, at the employee's option, and with approval of the Manager of Facility Services or designate.
Where an. Occasional Teacher is a replacement for a teacher who is paid mileage for an assignment which involves travel between two or more schools within the Board's jurisdiction, then the Occasional Teacher shall be similarly reimbursed for mileage in accordance with current rates.
Where an employee has use of a City of Prospect Motor Vehicle, the employee may retain the right to use such vehicle while on paid parental leave subject to the Director’s approval.
Where an employee agrees to extend a shift and this includes a normal meal- break, the employee will be entitled to a meal allowance of $7.97. This subclause shall not apply where the employee has been advised of the necessity to work overtime on the previous day or earlier.
