PERSONNEL AND EQUIPMENT. The Service Provider represents that it has secured or will secure, at its own expense, all personnel and equipment necessary to perform the services of this contract; none of whom shall be employees of, nor have any contractual relationship with the District. All of the services required hereunder will be performed by the Service Provider under its supervision, and all personnel engaged in the work shall be fully qualified and shall be authorized or permitted under law to perform such services.

PERSONNEL AND EQUIPMENT. Evaluator agrees to provide personnel with the required skills and all equipment and, expertise and resources needed to perform the above-mentioned services at no additional cost to Webb County.
PERSONNEL AND EQUIPMENT. 16.1. The Consultant has to inform PRASA about the entire personnel that the Consultant intends to use for the contract implementation, other than the experts whom CVs are included in the Appendix III. The Appendix II and/or Appendix III shall specify the minimum level of training, qualification and expertise of personnel and, where applicable, the required specialization. XXXXX is entitled to reject the personnel selected by the Consultant. 16.2. All the persons working under the project with XXXXX’s approval shall commence their activities at the date or during the period mentioned in the Appendix II and/or Appendix III or, otherwise, at the date or in the periods notified to the Consultant by PRASA or the Client Representative. 16.3. The Consultant shall: 16.3.1. Submit to the Client Representative the program proposed for the personnel deployment, within 30 days from the signing of the contract by both parties; 16.3.2. Inform the Client Representative about the arrival and departure date of each team member; 16.3.3. Submit in due time to the Client Representative, for written approval, a request for the employment of any secondary experts. 16.4. The Consultant shall adopt all the necessary measures in order to offer, and continue to offer his team, the required equipment and support in order to allow them the efficient accomplishment of their assigned duties.

The Aiding Member Entity rendering aid and assistance shall at all times have the right to withdraw any and all aid and assistance upon the order of its Local Public Health Officer or his/her designee; provided, however, that the Aiding Member Entity withdrawing such aid and assistance shall immediately notify the Local Public Health Officer of the Stricken Member Entity or his/her designee of the withdrawal of such aid and assistance and the extent of such withdrawal. Each Member Entity shall be responsible for the payment of any and all compensation owed to its personnel arising out of their participation in the activities provided under this Mutual Aid Agreement including, but not limited to, wages, salary, health insurance and fringe benefits, as applicable. Each Member Entity shall be responsible for the payment of workers' compensation and occupational disease benefits, if any are owed, to its personnel, in the event of compensable injuries or illnesses arising out of the activities provided for under this Agreement. Irrespective of any assertion that any party is a "borrowing employer" or a "loaning employer," within the meaning of the Illinois Workers' Compensation Act (820 ILCS 305) and the Workers' Occupational Diseases Act (820 ILCS 310), the party which directly employs personnel shall be responsible for payment of any workers' compensation or occupational disease benefits, if any are owed, as a result of illness or injury arising out of and in the course of the activities provided for under this Mutual Aid Agreement.

PERSONNEL AND EQUIPMENT. CONSULTANT shall provide all personnel needed to accomplish the Services hereunder. CONSULTANT shall additionally acquire, provide, maintain, and repair, at its sole cost and expense, such equipment, materials, and supplies as CONSULTANT shall reasonably require to accomplish said Services.

The Managers shall employ, train and supervise all such personnel as shall be necessary or desirable for the efficient farming, harvesting and husking of macadamia nuts in the New Orchards as described herein. The Managers may subcontract to others any portion of the work required hereunder if such work would normally be subcontracted on similar terms. Owner shall have no obligation to any party under any subcontract but shall expressly be made a third-party beneficiary of each and every subcontract. The Managers shall at all times remain primarily responsible for the satisfactory performance of all work and services and may not transfer or assign such responsibility without the prior written consent of Owner, except as provided in paragraph 12 below. b. The Managers shall comply with all requirements of federal and state law with respect to the employment of personnel, including but not limited to all insurance coverages required under workers' compensation laws. The Managers hereby indemnify and agree to hold Owner harmless from and against any and all claims, obligations, liabilities or demands with respect to and arising out of the performance of the Managers' obligations under this Contract and the employment of the Managers' personnel and agents at the New Orchards.
