Accrual - Part time Employees. Part time Employees shall be entitled pro rata to four (4) weeks of annual leave on ordinary pay at their respective rate. In addition to the payment for annual leave all Employees shall receive a loading equal to 17.5% of the Employee’s normal hourly rate for the number of hours deemed to be on annual leave. Subject to requirement for notice, accrued annual leave entitlements are payable upon termination. Annual leave will normally be paid in the usual pay cycle: i.e. in arrears; however, an Employee may request prepayment of annual leave if desired. Annual leave must not be cashed out except in accordance with this clause. The Employer and an Employee may agree to the Employee cashing out a particular amount of the Employee’s accrued annual leave provided that the following requirements are met: the cashing out of a particular amount of accrued annual leave must be by agreement between the Employer and the Employee which must: • be in writing and retained as an Employee record; and • state the amount of accrued leave to be cashed out and the payment to be made to the Employee; and • state the date on which the payment is to be made; and • be signed by the Employer and Employee and, if the Employee is under 18 years of age, the Employee’s parent or guardian; the Employee must be paid at least the full amount that would have been payable to the Employee had the Employee taken the leave at the time that it is cashed out; annual leave must not be cashed out if the cashing out would result in the Employee’s remaining accrued entitlement to annual leave being less than four weeks. Annual leave may be taken at a time determined by mutual agreement between the Employer and the Employee. Annual leave may be taken as up to and including the maximum amount of annual leave credits available or otherwise as mutually agreed. The taking of annual leave may be subject to operational considerations. Annual leave may be deferred by mutual agreement in writing between the Employer and the Employee. Notwithstanding provisions elsewhere in the Agreement, an Employee may elect, with the consent of the Employer, to take annual leave in single day periods not exceeding a total of 10 days in any calendar year at a time or times agreed between them. If, at any time, the leave credit of an Employee exceeds four (4) weeks, the Employer may direct the Employee to book in/take an amount of annual leave that will reduce the annual leave credit to less than four (4) weeks within an acc...
