Advertising Fee. You must pay to us a weekly Advertising Fee in an amount equal to 3% of Gross Sales. We reserve the right to increase this percentage upon 60 days written notice to you, provided, however, that we may not increase the Advertising Fee by more than 1/2% per year and that the Advertising Fee will not exceed 4% for the initial term of this Agreement. These fees are not held by us in trust and become our property to be spent in accordance with Paragraph 8 of this Agreement.
Advertising Fee. You must pay an advertising fee of 5% of the Gross Receipts each month.
Advertising Fee. An advertising fee (the “Fee”) will be paid by Customer to Host Provider as compensation for setting up, placing, and operating a specific Advertisement on the Host Site pursuant to the terms hereof. The Fee shall be set forth in the applicable Insertion Order (attached hereto as Exhibit “A” and incorporated herein by this reference), and due upon execution thereof by the parties.
Advertising Fee. Xxxxxx’s annual contribution toward Landlord’s cost of promoting the Center. Tenant’s Advertising Fee shall be payable at the initial annual rate of $4.50 multiplied by the Store Floor Area of the Premises. The Advertising Fee is payable on a calendar year basis and is subject to annual increase, effective January 1 following the Commencement Date and on each January 1 thereafter, by three percent (3%) per annum. (Section 14.1).
Advertising Fee. City and Contractor agree that the fee for Contractor advertising on the City’s transit vehicles shall be determined in accordance with the following. Subsection A - Fee The Contractor agrees to pay to the City $650/month/Bus for the thirty six-month term of the contract, for advertising utilized on both sides of one transit bus in the City of Minot, based on the fee structure outlined in Appendix #2 and based upon the fleet inventory, as the same may change from time to time. The current fleet inventory as of the effective date of this agreement is attached as Appendix #3. Payments shall be made monthly. The City shall provide an invoice by the 15th of each month with payment due no later than the last day of that month. All payments shall be made to City at the following address: Public Works Department, City of Minot, PO Box 5006, Minot, ND 58702 and shall specify by reference that said payment is applicable to the Transit Department. The obligation of Contractor to make payments shall be absolute and unconditional in all events notwithstanding any dispute between City and Contractor or between Contractor and any other person or entity. Contractor shall make all payments required hereunder when due and shall not withhold any payment pending final resolution of such dispute nor shall Contractor assert any right of set off or counterclaim against its obligation to make such payments.
Advertising Fee. Commencing with the calendar month in which the Go Live Date occurs, LendingTree shall pay to CNBC.xxx x xonthly fee of $125,000 (the "Advertising Fee") as compensation for the positioning provided to LendingTree hereunder and the Marketing Support described in Section 11. By way of example, if the Click-Through Fee is $150,000, LendingTree shall pay CNBC.xxx x xotal of $150,000 (the $125,000 Advertising Fee and a $25,000 additional Click-Through Fee); if the Click-Through Fee is $100,000, LendingTree shall only pay CNBC.xxx x xotal of $125,000 (the $125,000 Advertising Fee). In the event that the aggregate monthly Click-Through Fee exceeds the Advertising Fee, LendingTree shall pay to CNBC.xxx xxx additional Click-Through Fee amount, which amount shall be calculated as specified in subsection (a) above. The Advertising Fee shall be due and payable monthly in advance no later than the fifth day of the applicable month; provided, that with respect to the first month in which the Advertising Fee is payable, it shall be due and payable five (5) days after the Go Live Date. For overdue amounts due and payable hereunder, LendingTree shall pay a late charge at the rate of the lesser of 1.5% per month or the maximum rate allowed by law.
Advertising Fee. 3.1 The Advertiser will pay DFW-CAI the Advertising Fee. DFW- CAI will issue an invoice for the Advertising Fee to the Advertiser at the time the Advertiser agrees to purchase the advertising, unless payment is received with the advertising order. The Advertiser must pay the Advertising Fee within 30 days of the date of the invoice from CAI. All advertising fees must be paid prior to the fulfillment of the advertisement.
Advertising Fee. In addition to Franchisee’s obligation to pay a Continuing Royalty as set forth above, Franchisee shall pay to Franchisor, for national advertising and for the preservation, promotion and enhancement of the value of all franchises and goodwill attached thereto, a sum equal to one- quarter of one percent (.25%) of Franchisee’s monthly Gross Sales as hereinafter defined.
Advertising Fee. (a) For each Location, Franchisee shall pay to Franchisor a monthly Advertising Fee equal to the amount set forth opposite the ranges of monthly Gross Revenues attributable to the Location in the following table, but not less than $690 per Location per month. (b) The Advertising Fee is payable on the first day of each month and shall be collected by Franchisor from the Depository Checking Account on the fifth business day of the month following the month in which the Gross Revenues upon which the Advertising Fee is based were earned. With respect to Seasonal Locations, the per Location Advertising Fee is payable only for months during which such Seasonal Locations are operated for 15 calendar days or more. With respect to Subdivision Sales Offices, Satellite Offices and Administrative Offices, there shall be no separate Advertising Fee. However, for the purpose of determining the Gross Revenues attributable to each of Franchisee1 s Locations, Gross Revenues received by Subdivision Sales Offices or Satellite Offices shall be deemed part of the Gross Revenues attributable to Franchisee1s nearest Location, or such other Location that Franchisor shall determine in its sole discretion. Advertising Fees are the property of Franchisor and may be deposited by Franchisor into its general operating account.
(c) On a national basis, Franchisor may impose an additional assessment upon all of its franchisees for special designated advertising or promotional activities (so long as such assessment is not in substance merely an increase in the general Advertising Fee referred to in paragraph 5.03(a) hereof), if franchisees owning two-thirds of all of its franchised Locations agree to such additional assessment by affirmative vote.
(d) In its sole discretion, Franchisor shall have the right to reduce the per Location Advertising Fee set forth in subparagraph 5.03(a) above and upon not less than 30 days’ prior written notice, to restore said per Location Advertising Fee to an amount that shall not exceed the per Location Advertising Fee specified in subparagraph 5.03(a) above, as adjusted in accordance with the Consumer Price Index.
(e) Franchisor shall expend, for the purposes of national, regional or local advertising, cooperative advertising, market research, public relations and promotional campaigns designed to promote and enhance the value of the Servi...
Advertising Fee. Licensee agrees to pay to Licensor each Year --------------- during the Term of this Agreement an Advertising Fee in an amount equal to the greater of (1) *** of the Minimum Net Sales Requirements, or (2) *** of the actual Net Sales. Payments equal to *** of one fourth (1/4) of the Minimum Net Sales Requirements shall be payable concurrently with the quarter-annual payments of GMR. To the extent that the actual Net Sales for any quarter exceeds one-fourth (1/4) of the Minimum Net Sales Requirements for the Year, then Licensee shall pay to Licensor an amount equal to *** of such excess concurrently with the payment of Royalties for such quarter. Licensor shall actively advertise and promote the Trademarks in the Territory during the Term, using the Advertising Fee together with similar fees received from other licensees.
