Use of System. Purchaser will not use electrical energy generated by the System for the purposes of heating a swimming pool within the meaning of Section 48 of the Internal Revenue Code.

Use of System. The Use of System Charges at the Commencement Date shall be the relevant HV tariff as notified by the Company in accordance with the Relevant Charging Statement. The Company has not contributed to the cost of this Connection.
Use of System. (a) Subject to the terms and conditions of this Agreement, the Agency grants to User a non- exclusive right to use the System, including any updates and enhancements to the System, the Output of the System and the User Instructions and other documentation for the System that may be provided to User by the Agency. The term “System” and any other capitalized term not defined in the text of this Agreement will have the meaning set forth in the Glossary attached to this Agreement as Exhibit A. User will cause data to be entered into the System only with respect to potential loss mitigation actions (e.g., special forbearance, loan modification, pre-foreclosure sale, deed in lieu of foreclosure). User’s use of the System is subject to the provisions of the User Instructions and such other instructions as may be communicated by the Agency from time to time in writing. Except to the extent otherwise provided in this Agreement or consented to by the Agency in writing, User will not permit any third parties to use the System, either directly or indirectly through User.
(b) User access to the System is dependent upon the eAuthentication system, which will require the User Security Administrator and specific employees or agents of the User to specify a user ID and password as part of the sign-on procedure. User agrees to immediately notify the Agency (i) if User terminates the employment or agency of any of its authorized users, and (ii) in the event of any loss, theft or unauthorized disclosure or use of any user ID or password. Individual user IDs and passwords may not be transferred between employees and agents, and User shall ensure that such transfers do not occur. User will permit the Agency, from time to time and upon at least fifteen (15) days' notice to User, to audit or review User's controls and procedures related to access to the System. User agrees to provide the Agency with a list of the names of its authorized users of the System with their user IDs.
(c) Where User data or other materials reside on the System, the Agency will use reasonable care to avoid loss, alteration or improper access to User data and other materials. User shall be responsible for implementing appropriate procedures to protect data and other materials and shall be responsible for security breaches caused by its employees, agents or contractors, including without limitation, any access or entry into the System or any third party system not covered by this Agreement. Use of System. You must install and use the System in accordance with the terms of this Agreement and the User Manual. Your use of the System is subject to any conditions and qualifications set out in this Agreement and the User Manual.
Use of System. 4.1 Subject to the terms of this Agreement, the Company shall convey electricity through the Distribution System to each Exit Point and from each Entry Point relating to a Metering Point or Metering Points registered to the User under the Master Registration Agreement, subject to any arrangements made between the respective Customers and the Company and the requirements (if any) of the respective Customers agreed between such Customers and the Company up to the Maximum Capacity (if any), and subject to such variations (if any) as may be permitted by the Regulations.
4.2 The obligation of the Company to convey electricity to a particular Exit Point or from a particular Entry Point pursuant to Clause 4.1 is in each case subject to:
4.2.1 there being a Connection Agreement in full force and effect relating to the connection of the relevant Customer’s Installation or that the terms in Schedule 2, or other terms having the same effect as those terms, have been incorporated into the relevant Contract;
4.2.2 the Company receiving confirmation that a Meter Operator, Data Collector and Data Aggregator, which in each case has been Accredited, have been appointed for each Metering Point relating to Customers to be supplied through such Exit Point or Entry Point (except that no Meter Operator is required to be appointed in relation to an Unmetered Supply) ;
4.2.3 subject to Clause 12.9, the Company receiving confirmation that metering equipment has been installed in accordance with Clause 12;
4.2.4 where applicable, the Company receiving confirmation that the User has given notice of that Exit Point or Entry Point (as the case may be) to NGET pursuant to the Connection and Use of System Code and the Grid Code (where appropriate); and
4.2.5 the Company not being entitled under Schedule 6 of the Act to De-energise an Exit Point or Entry Point.
4.3 In addition to the conditions set out in Clause 4.2, the obligation of the Company to convey electricity to an Exit Point is also subject to:
4.3.1 the User being validly registered under the Master Registration Agreement in respect of each Metering Point relating to Demand Customers to be supplied by the User through such Exit Point;
4.3.2 the User being authorised by its Electricity Supply Licence to supply electricity to each of the premises to be supplied with electricity through such Exit Point;

The term “System” and any other capitalized term not defined in the text of this Agreement will have the meaning set forth in the Glossary attached to this Agreement as Exhibit A. User will cause data to be entered into the System only with respect to potential mortgage loans for which an application or an inquiry has been made to User by a potential borrower. User’s use of the System is subject to the provisions of the User Instructions and such other instructions as may be communicated by Rural Development from time-to-time in writing, including, without limitation, restrictions on the types of Loan Applications which may be entered into the System and limitations on the marketing of the System or use of the System to prescreen potential borrowers. Except to the extent otherwise provided in this Agreement or consented to by Rural Development in writing, User will not permit any third parties to use the System, either directly or indirectly through User.

Use of System. Supplier acknowledges that in order to perform the Services it may be required to use CenturyLink’s computer systems to access drawings or for other reasons necessary for the performance of the Services (collectively, the “Computer Systems”). Supplier will comply with CenturyLink’s system, security and network requirements in connection with the Computer Systems as they may be revised from time to time. Supplier and all of Supplier's employees, agents and subcontractors that will be using the Computer Systems (collectively, “Authorized Users”) must be appropriately trained in the Computer Systems in accordance with CenturyLink’s requirements.
Use of System. The right to use the NGC GB Transmission System shall commence on and Use of System Charges shall be payable by the User from the date hereof.
