Agency Shop Election. Effective January 1, 2004, if at any time during the term of the Memorandum of Understanding, 30 percent of the employees represented by this Bargaining Unit sign a petition to request an agency shop agreement, the Union shall have the right to conduct a secret ballot election at any time during the term of the Memorandum of Understanding to determine whether a majority of the employees in the Bargaining Unit, who vote, are in favor of an agency fee agreement as provided in G.C. 3502.
Agency Shop Election. An agency shop shall be implemented in the General Supervisory Unit only after certification of a secret ballot election, conducted by the California State Mediation and Conciliation Service, in which a simple majority of those voting vote to implement an agency shop. Such election shall be held as soon as is administratively feasible.
a. An election to implement the provision of this section shall not prohibit or restrict an election to rescind this provision as provided by Section 3502.5 of the Government Code.
b. The Union and the County mutually agree that the election provided for in Subsection b. of Section 3502.5 of the Government Code:
(1) Shall be determined by a simple majority of those voting; and
(2) Shall be conducted following election security procedures that apply to the conduct of employee representation elections that are subject to Chapter 2.79 of the Sacramento County Code.
c. All employees in classifications included in the General Supervisory Unit, on a date thirty (30) days prior to the holding of the election, shall be eligible to vote in such election.

Effective upon Board approval of MOU, if at any time during the term of the Memorandum of Understanding, 30 percent of the employees represented by this Bargaining Unit sign a petition to request an agency shop agreement, the ADDA shall have the right to conduct a secret ballot election at any time during the term of the Memorandum of Understanding to determine whether a majority of the employees in the Bargaining Unit, who vote, are in favor of an agency fee agreement as provided in G.C. 3502.5 This election shall be administered by the Employee Relations Commission. The Employee Relations Commission shall notify the County and the ADDA of the results of the election. The ADDA shall pay for the cost of the election. If a majority of the employees in the Bargaining Unit who cast ballots, vote in favor of an agency shop fee, the ADDA shall notify the County of its intent to implement an agency shop agreement. Immediately, thereafter, the ADDA shall notify all employees in the Bargaining Unit that they will be required, as a condition of continued employment, either to join the ADDA, or to pay the Union a service fee as provided in G.C. 3502.5(a). If the majority of the employees in the Bargaining Unit, who vote, do not vote in favor of agency shop, the MOU provisions of maintenance of membership set forth in Section 2 shall apply for the term of this MOU.

Such elections shall be held as soon as is administratively feasible.

Agency Shop Election. An agency shop arrangement shall be placed in effect upon a signed petition of 30 percent of the employees in the Unit requesting an agency shop agreement and an election to implement an agency fee arrangement. Further, such agreement shall be effective upon the approval of a majority of employees who cast ballots and vote in a secret ballot election at any time during the term of this Memorandum of Understanding to determine whether a majority of the employees in this bargaining unit are in favor of the agency fee agreement as provided in G.C. 3502.5(a) and (b). This election shall be administered by the Employee Relations Commission. The Employee Relations Commission shall notify the County and the Union of the result of the election. The Union shall be responsible for the cost of the election. The parties will encourage the Employee Relations Commission to establish election procedures which are designed to produce the maximum possible participation in the election. If a majority of those voting do vote in favor of an agency shop, then the Union shall notify the County, and the County shall immediately thereafter notify all employees in the bargaining unit that they will then be required, as a condition of continued employment, either to join the Union or to pay a Fair Share Fee equal to the Union dues or pay the Union an Agency Fee as provided in G.C. 3502.5(a). It is mutually agreed by the parties that this Unit shall be covered by the agency shop provisions if a majority of the Unit members voting so vote at the election. If a majority is not secured by vote, the provisions of maintenance of membership set forth in Section 2 shall apply for the term of this Memorandum of Understanding.

Immediately thereafter the Union shall notify all employees in the Bargaining Unit that they will be required, as a condition of continued employment either to join the Union or to pay the Union a service fee as provided in Government Code Section 3502.5(a). If a majority of the employees in the Bargaining Unit who vote do not vote in favor of agency shop, the MOU provisions for maintenance of membership set forth in Section 2 shall apply for the term of this MOU.
Agency Shop Election. The Union shall have the right during the term of this Agreement to call for one secret ballot election among all eligible employees in the Supervisory Unit to determine the employees’ desire to be covered by a full agency shop. Eligible employees shall include all regular employees covered by the Agreement in the specified Unit in the bi‐weekly pay period immediately preceeding the Union’s written request. The secret ballot election shall be supervised by the State Mediation and Conciliation Service. In the event a majority of the regular employees in the specified Unit vote in the affirmative for the full agency shop, the parties shall amend this Agreement to include such a provision for that Unit.
