ASSOCIATION RIGHT. No grievance, except a Step 1 grievance, may be settled unless the ASSOCIATION is afforded an opportunity to be present at any settlement conference, and provided that any settlement made shall not be inconsistent with the terms of this Agreement between the VILLAGE and the ASSOCIATION. It is acknowledged that the ASSOCIATION has the right to exercise its discretion to refuse to process an employee's unmeritorious grievance.
ASSOCIATION RIGHT. 1. Whenever by mutual agreement between the Association and the Board or its representatives, any representative of the Association or any member is scheduled to participate in formal negotiation procedures pursuant to Chapter 123, P1974, he shall suffer no loss of pay. Negotiations shall, whenever possible, be scheduled at times other than regular school hours. 2. The Board agrees to furnish to the Association, through its representative, any public information that is requested, in accordance with Board Policy. 3. The Association shall have the right to use the school facilities for meetings, provided the facility is not already scheduled for use. 4. The Association shall have the right to use school facilities and equipment, including word processing machines, duplication equipment, calculation machines, and all types of audio-visual equipment at reasonable times, when such equipment is not otherwise in use. 5. Whenever any representative of the Association participates during working hours in negotiations or grievance procedures, he shall suffer no loss in pay nor shall he be required to use personal business days provided the Board of Education or its designated representatives and the Association mutually agree to the meeting and the number of Supervisors acting as representatives. 6. The rights and privileges of the Association and its representatives as set forth in this Agreement shall be granted only to the Association as the exclusive representative of the Supervisors.
ASSOCIATION RIGHT. The Association, on behalf of its Bargaining Unit, has exclusive control over the management of the grievance process, including whether to file and/or proceed with the alleged grievance, also to include settlements and appeals, of any grievance or grievance arbitration award. The grievant has a right to be represented at all stages of the grievance procedure by a person selected or approved by the Association. Under the Public Employee Relations Act, individuals have a right to process grievances without Association representation up to, but not including, Step IV arbitration. However, when a Bargaining Unit Member is not represented by the Association, the Association shall have the right to be present and to state its view at all stages of the grievance procedure.

  • ASSOCIATION RIGHTS 2.01 The Association shall have the right to use school buildings for membership meetings, provided the building principal is notified, except in the case of urgent necessity, no less than twenty-four (24) hours in advance of the time and place of such meetings, and the use does not interfere with the previously scheduled use of the building. The Association shall keep the school buildings in good order and in the condition as the same now are, with reasonable use and natural wear and tear expected. 2.02 Upon reasonable request of the Association, the Association shall have the right to use school equipment, such as typewriters, copying machines, duplicating equipment, calculating machines and audio-visual equipment, provided such use is made on school property and does not interfere with the school use of such equipment. Borrowed equipment must be returned in the same condition as when borrowed taking into consideration normal wear of such equipment. The Association shall pay for all consumable supplies. 2.03 The Association shall have the right to the use of the school mail service to the extent such use does not interfere with the school use of such service. No device, code or other insignia may be affixed to said mailbox identifying either members or non-members of the Association. If such a device, code or other insignia is so affixed, the administration shall have the right to remove it. 2.04 The Association shall have the non-exclusive use of any bulletin board presently located in a teachers’ lounge or other non-public area as designated by the principal, provided that any material posted shall be designated as Association material. 2.05 The Association may use telephones as designated by the principal in any building to carry out Association business. Any fees or toll call charges shall be reimbursed to the Board by the Association. These calls are not to be made at times that interfere with duties assigned by the Board and Administration. 2.06 Representatives of the Association shall be permitted to discuss organizational matters with members of the bargaining unit as long as such discussion does not interfere with duties assigned by the Board and the Administration. Representatives of the Association who are not employees of the Board shall first report to the principal’s office and otherwise comply with all conditions required of other visitors. 2.07 The Association shall: A. Be provided with copies of all Board agendas, minutes and other written public information. Such information shall be sent to the Association President electronically at the same time it is sent to Board members. B. Be placed on the agenda of Board meetings, when requested, for the purpose of communications with the Board. C. Be given each September the name, address and phone number of each member of the bargaining unit and within one (1) week after official Board action employing new teachers, the names and addresses of all such new teachers.

  • ASSOCIATION RIGHTS AND PRIVILEGES A. There will be no reprisals of any kind taken against any teacher solely by reason of his/her membership in the Association or for participation in any of its lawful activities. B. The Association will be provided with copies of minutes of public session official Board meetings. The Board will be provided copies of minutes of public session meetings of the Association. C. The Association may request and shall be given a place on the agenda of all regular Board meetings for brief reports and announcements. D. The Superintendent shall be available upon reasonable request to meet with representatives of the Association. E. The principal of each school shall be available upon reasonable request of Association representatives to discuss questions relating to the implementation of this Agreement in his/her school. F. The Association will be provided with the names and addresses of all new teachers and all retiring teachers as soon as such information is available. G. The Association will have the right to have placed in the Superintendent’s packet for all new teachers a letter prepared by the Association which informs said teachers that the Association is recognized as the exclusive negotiating representative for all teachers in the Xxxxxx County Public School System. H. The Association shall be given a place on the agenda of the orientation program for new teachers to explain the function and benefits of membership. I. In order for the Association to properly fulfill this Agreement for the benefit of all teachers and the welfare of the school system, the Association representative may visit schools and talk with teachers, provided that the exercise of this right will not interfere with the educational program. The Association representative will check in at the front office of the school upon his/her arrival. J. The Association shall continue to use school buildings without cost at reasonable times for meetings provided the use of the building shall not result in any additional cost to the Board. The principal of the building in question will be notified in advance of the time and place of all such meetings. K. The Association representative will have the right to schedule meetings of the teachers before or after school work days or at any other times which do not disrupt the normal school program. L. There will be bulletin board space of appropriate size reserved for the Association, in an appropriate place in each school building, for the purpose of displaying notices, circulars, and such material. Copies of all such material will be given to the building principal, but his/her advance approval will not be required. M. The Association will have the right to place Association notices, circulars, and other materials in all teachers’ mailboxes. Copies of all such material will be given to the building principal and Superintendent, but his/her advance approval will not be required. The Association will also have the right to use the interschool mail to distribute prepackaged and labeled material, and its office shall be a designated stop on the interschool mail distribution route for delivery of interschool mail, so long as the Association office is on a regular route. N. No teacher will be prevented from wearing pins or other identification of membership in the Association. O. Teachers shall be allowed to attend professional meetings with the approval of the Superintendent. P. The rights and/or privileges granted to the Association in this section will not be granted to any other teachers’ group or organization during the term of this Agreement. Q. Officers and members of the Association recognize that school equipment, time, and materials are intended primarily for the use of pupils. R. Unless a teacher requests that his/her address and phone number not be distributed, the Association faculty representative shall be provided with a faculty list, including home addresses and telephone numbers, by September 15. S. Association officers and/or representatives shall be permitted to draw upon a total of fifty

  • Association Establishment and all other expenses of the Association and also similar expenses of the Maintenance In-charge looking after the common purposes, until handing over the same to the Association.

  • Association Dues The District agrees to deduct Association dues from the paycheck of each employee who individually and voluntarily authorize dues deductions. Employees’ authorizations will be in writing in a form agreed upon by the Association and the District. Said deduction shall be in nine substantially equal amounts during the school year beginning on or after October 15 of the corresponding school year. A schedule of deductions shall be provided to employees on or about September 1st. Authorizations shall continue from year to year unless revoked by the employee in writing prior to July 1 of any year. Dues deducted from employees’ wages will be transmitted to the Association following each corresponding payroll deduction. The Association will annually certify to the Superintendent the amount of Association dues. The following shall also apply: A. The Association shall provide payroll at District’s Business Office, dues deductions covered under this paragraph by October 1 of the contract year in which the deduction applies for all existing members as of said date, otherwise the employees' previous year deductions shall continue in force for the entire contract year unless terminated by the employee by the dates set forth herein. Deductions for any new employee hired prior to the date of said report shall also be included in the report. B. The form in which the Association reports union dues for existing membership must include, at minimum, employee name, social security number, and total unions dues to be deducted for the corresponding contract year. The report shall list employees alphabetically by last name. C. The form in which the Association reports union dues for new members must include, at minimum, employee name, social security number, total unions dues to be deducted for the corresponding contract year, and signed employee authorization. D. The District payroll office shall make changes to union dues not more than once in any contract year. However, union dues to individual employees may be adjusted as necessary due to changes in employment status with proper notification and reporting from the Association as outlined herein. If an employee elects to become a member after the Association Dues are submitted by the Association, the employee shall be responsible for paying any additional fees directly to the Association. E. The District shall provide the Association a list of all support staff covered under the collective bargaining agreement upon request of the Association, but not more than once per month.

  • Association Leave The Association shall be allowed to use up to 5 days of leave each school year for use by teachers who are officers or agents of the Association. The Association shall reimburse Unified School District 434 for the loss of use of the teacher taking such leave by paying the daily cost of a substitute teacher. The Association shall notify the Superintendent not less than 5 calendar days in advance of using such leave.

  • Union Rights Section 1 The employees and the Union, as their exclusive bargaining representative, shall have and enjoy all the rights and privileges granted to them by Act 379 of the Michigan Public Acts of 1965 as amended from time to time and by other applicable statutes now or hereafter enacted except as expressly limited by the terms of this Agreement. Section 2 The Board agrees to furnish the Union in response to reasonable requests from time to time, all available information concerning the financial resources of the District, tentative budgetary requirements and allocations and other such information as will assist the Union in developing intelligent, accurate, informed and constructive programs on behalf of the food service staff and customers, together with information which may be necessary for the Union to process any grievance or complaint. Such requests must be in writing and specifically designate the material requested. For materials not normally mass produced a reasonable cost/charge may be required. Section 3 The Union and its members shall have the right to use school building facilities at all reasonable hours for meetings, providing such use does not interfere with previous building commitments. Section 4 Duplicating machinery shall be available for Union use. Materials used solely for the benefit of the Union shall be paid for by the Union. Materials used for preparation of items of mutual and common use shall be provided without cost by the Board. Section 5 The Union shall appoint stewards and alternate stewards. No xxxxxxx or alternate, regardless of when selected, shall function as such until the Board has been notified in writing by the president of the local Union, chairperson of the unit, or an international Union or council officer of her/his election. Section 6 Stewards and their alternates and other Union officials shall be permitted to engage in contract negotiations and adjustment of grievances subject to the limitations set forth in this Agreement. Section 7 Any xxxxxxx or alternate xxxxxxx having an individual grievance in connection with her/his own work may ask that another xxxxxxx or alternate or Union official assist her/him in adjusting the grievance with her/his supervisor. Section 8 Bulletin boards shall be erected in a conspicuous place for the purpose of posting notices of Union business or activities. In no case shall obscene or scurrilous printed or written matter be placed on any bulletin board. All materials posted on bulletin boards shall indicate the organization responsible for the material and clearly indicate the author's identity. Bulletin boards used for the above purpose shall be in areas not commonly frequented by students. Section 9 All notices required to be given by this Agreement shall be sufficient if mailed to the Board by ordinary mail to such address as the Board shall direct in writing. All notices required to be given to the Union by this Agreement shall be mailed to the Union by ordinary mail, addressed to 0000 Xxxxxx Xxxx, Suite C, Flint, Michigan 48507, or to such other address as the Union shall direct in writing. All notices to be given to an employee under this Agreement shall be mailed to her/his last address recorded in the Board's office. It shall be the responsibility of employees to notify the Board and their immediate supervisor of any change of address and phone number within ten (10) days of such change. If the employee does not do this, the Board's obligation is fulfilled and shall not be a factor in a grievance.
