Beta Test. During Phase 2, Supplier will install one copy of the object code version at up to four (4) Beta test sites as designated and agreed upon by both parties. Prior to the end of Phase 1, Supplier and CA will develop mutually agreeable Beta test criteria which will define the conditions under which a given Product has successfully completed the Beta test Phase. Beta test site testers will sign standard evaluation licensing agreements with the appropriate disclaimers, at reduced licensing rates to be agreed to by Supplier and CA.
Beta Test. 2.1. The User acknowledges that the Service is in a beta testing phase and under continuous development. The content and features of the Service may therefor vary from time to time and Company makes no warranties except as explicitly set out in these General Terms and Conditions.
2.2. The User acknowledges that the beta test is limited to vehicle depots in certain geographical areas.
2.3. For the purpose of evaluating, improving and further developing the Service, Company may ask the User to participate in voluntary surveys and interviews.
Beta Test. 3.1 The Beta Test will run from 12:00:00 on 21 August 2019 until 23:30:30 on 6 September 0000 Xxxxxxxxx Eastern Standard Time (AEST) (herein referred to as ‘Beta Period’). The Beta Period may be extended or reduced at the discretion of Xxxxxxx.Xxxx. Individuals who have been invited by an existing full-time Xxxxxxx.Xxxx employee can sign up to take part in the Beta Test when they sign up for a Xxxxxxx.Xxxx Monthly Plan during the Beta Period. At the end of the Beta Period, Beta Users will continue to enjoy their xxxx waiver as stipulated or the services under the Xxxxxxx.Xxxx Monthly Plan are terminated in accordance with the Standard Form of Agreement .
3.2 Beta Users must sign the Beta Test Non-Disclosure Agreement and sign up for the Xxxxxxx.Xxxx Monthly Plan with the unique Beta Test promotional code sent to them in order to participate in the Beta Test. By participating in this Beta Test, the Beta User acknowledges that they have read, understood and agree to be legally bound by this Beta Test Agreement, the Standard Form of Agreement and the Non-Disclosure Agreement. By participating in this Beta Test, Beta Users are also fully aware that the Xxxxxxx.Xxxx experience may be incomplete and have information that may not be completely accurate. There may also be bugs and issues that they are asked to report through the feedback forms shared by Xxxxxxx.Xxxx. This includes but is not limited to the Xxxxxxx.Xxxx Monthly Plan, Xxxxxxx.Xxxx app, services, packaging and communications. Beta Users also acknowledge that they may be contacted by Xxxxxxx.Xxxx in relation to this Beta Test and any feedback they submit to Xxxxxxx.Xxxx for the purposes of this Beta Test
3.3 In signing the Beta Test Non-Disclosure Agreement, Beta User's fully agree that they cannot share any details, links and any other information relating to Xxxxxxx.Xxxx and any of their services including the Xxxxxxx.Xxxx app or any documents or agreements to which the Beta User is given access as part of the Beta Test.
Beta Test. As soon as practicable after Lessee selects the fundamental communications technology that it intends to use for the System, Lessee shall conduct a test (the “Beta Test”) of such communications technology in rural Colorado, in a specific geographic area jointly approved by the Parties (the “Beta Test Market”), to validate the technology in accordance with Lessor’s technical specifications. The Beta Test will include no less than five base station transmitters, and will be designed so that upon its successful completion, the System will be ready for operational service for live customers. Lessor shall provide Lessee with access to GSAT Spectrum in the Beta Test Market, subject to the requirements and limitations of the Communications Laws and Lessor’s and its affiliates’ obligations to their existing mobile satellite service subscribers, and Lessor shall use commercially reasonable efforts to obtain all required approvals and/or waivers from the FCC and any other necessary governmental bodies in order for Lessee to commence the Beta Test. Based on findings from the Beta Test, the Parties will work together to develop the processes and procedures to be used for build out of the System within the Lessee Markets. Lessee will be responsible for all costs incurred in connection with the Beta Test, except that Lessor will pay for the costs of its own employees and contractors (including their travel costs) that are needed to facilitate the Beta Test. Lessee will use its best efforts to cause the technology tested in the Beta Test to function for its intended purpose and comply with all of Lessor’s technical specifications and all Communications Laws.
Beta Test. In consideration for receiving the Product for testing, Customer agrees to participate in a Beta Test for the Product and will notify AM of all problems encountered and ideas for enhancements developed during the period of this Agreement.
Beta Test. SSG agrees to work jointly with the Customer to plan, implement, deploy, and support the installation and operation of the Integrated Product at the Turning Stone Resort & Casino (TSRC) in Verona, NY. The installation and operation of the Integrated Product will be designated as a "Beta Test" with the intent of evaluating the Pokermatic and SSG technology and acceptability of the combined product to the gaming public. The Beta Test, which will commence within one hundred twenty (120) days of the Effective Date, will consist of between two and four Pokermatic Tables and run for no less than 30 days and up to 90 days, at the discretion of TSRC, with no associated fees to TSRC. SSG represents and warrants that TSRC has been made aware of the details of this Paragraph II(c) and that specific Beta Test planning and execution activities will be negotiated by and between SSG, Customer, and TSRC and will be incorporated in a separate agreement. The parties will work in good faith to finalize and sign the separate agreement with TSRC simultaneously with the execution of this Agreement.
Beta Test. TEST GAMES. LODGENET agrees to undertake beta testing at two operational hotel properties (each of which shall also be a Licensed Hotel) to ascertain the technical, operational and marketing compatibility of the N64 and the N64 Controller prototypes with LODGENET's Hotel Guest System. NINTENDO agrees to supply to LODGENET a sufficient number of prototypes for use during the beta test only. LODGENET is authorized to install and utilize the Test Games during the beta test in Rooms of the Licensed Hotels for a period of not more than sixty (60) days. In the event LODGENET or the Licensed Hotels elect to charge for use of the Test Games during the beta test, LODGENET shall pay royalties to NINTENDO with respect to the use of the Test Games as specified at Section 8 herein.
