BIDDING OR NEGOTIATION PHASE. 2.5.1 ( Multiple Rounds of Bids) Add to the end: “The bidding may include two or more rounds of soliciting, receiving, and processing bids. The number of bids will be set in the Owner’s discretion. As part of Basic Services, the Architect shall attend as many as two pre-bid conferences with prospective bidders. The services shall include modification of the drawings, specifications and other documents. To the extent required by law or requested by the Owner, the bidding may provide for multiprime and single prime bids.”

BIDDING OR NEGOTIATION PHASE. 2.4.7.1 The Professional shall attend the Owner’s pre-bid meetings with potential bidders and be available to respond to questions and/or issue addenda regarding the Construction Documents. 2.4.7.2 The Professional shall submit to the Owner a Corrected/Conformance Document Set incorporating all design review comments, pre-bid inquiries, and other modifications made after the 100% complete Construction Documents have been submitted to the Owner. 2.4.7.3 The Professional shall assist the Owner with pre-qualification or “Best Value” analyses of potential bidders if applicable. 2.4.7.4 The Professional shall assist upon Owner’s request in reviewing bids to determine whether such bids are responsive to Owner’s request for bids. 2.4.7.5 In the event Owner does not receive bids within Owner’s budget for the Project, and the Project must be re-designed, the Professional shall revise the Construction Documents as needed to bring the Project’s Construction Cost within the Owner’s budget.

BIDDING OR NEGOTIATION PHASE. .1 Upon written approval to proceed with the Bidding or Negotiation Phase by Owner, Designer shall assist Owner in obtaining bids or proposals, and in awarding and preparing construction contracts. .2 The date for receipt of bids shall be established by Owner. .3 In the event that the lowest responsive and responsible bid received exceeds the MACC, Designer shall revise the Construction Documents, if requested by Owner, in order to bring the construction cost within the bid target at no additional expense to Owner. Owner in this event agrees to cooperate with Designer and permit reasonable and necessary reductions in the scope of the Project. Alternatively, Owner may increase the MACC and proceed with the award of the construction contract, with no change in the Basic Services Fee. .4 Should the lowest responsive and responsible bid received be more than twenty percent (20%) less than Designer’s most current estimate of cost of construction accepted by Owner, Owner may require: (1) redesign and rebid of the Construction Documents to include any scope previously removed, with no additional expense to Owner; (2) additional bid packages to add back the scope removed, with no additional expense to Owner; or (3) the execution of a Supplement to the Agreement reducing the MACC to actual bid amount plus appropriate contingency and the Basic Services Fee based on the revised MACC. The reduction of the Basic Services Fee shall only apply for the Construction Document Phase through the Close-Out Phase.
BIDDING OR NEGOTIATION PHASE. 1.4.1 The Consultant, following the Owner's approval of the Construction Documents and of the latest Statement of Probable Construction Cost, shall assist the Owner in obtaining bids or negotiated proposals, and assist in awarding and preparing contracts for construction. 1.4.2 The Consultant shall submit the Contract Documents to the State Fire Marshal, independent code and plan review organizations, and other government authorities having regulatory review, filling out all filing applications as necessary. The Owner will pay for all permit, and review fees. The Consultant also shall set up and attend all necessary or suggested preliminary review meetings with authorities. 1.4.3 After the Owner accepts the Construction Documents and the latest Statement of Probable Construction Cost /GMP, <the Consultant shall assemble the Construction Documents for distribution to potential bidders.> the Consultant shall prepare complete bid packages for the Contractor’s use for each portion of the Work to be bid separately and, if the Work is done in phases, complete sets of bid packages for each phase. Such acceptance of the Construction Documents by the Owner shall not constitute approval for the adequacy of the Construction Documents and shall not relieve the Consultant of the responsibility for design deficiencies, errors, or omissions. 1.4.4 The Consultant shall provide written interpretations and clarifications of the Construction Documents, preparing and distributing to the Contractor any addenda to the Construction Documents required for the pricing of the Work. The Owner shall review all addenda prior to issue by the Consultant. No addenda shall be issued less than forty-eight hours before bids are due. 1.4.5 Provide such other reasonable assistance to the Contractor and Owner, including reviews of alternate materials, assemblies or other “Prior Approval” requests from contractors, subcontractors and suppliers. 1.4.6 If requested, assist the Owner in awarding and preparing contracts for construction. 1.4.7 If the Owner requests such advice from the Consultant, the Consultant shall advise the Owner on the selection of the Contractor and acceptability of subcontractors and material suppliers proposed by the Contractor if a pre-qualification process is used.
BIDDING OR NEGOTIATION PHASE. 2.5.1 The Architect, following the Owner’s approval of the Construction Documents and of the latest preliminary estimate of construction costs as provided by the Contractor; shall assist the Owner and Contractor in obtaining bids or negotiated proposals and assist in preparing contracts for construction. 2.5.2 In the event the lowest responsive and responsible bid (or bids) exceeds either the funds appropriated for the Project or the final estimates provided by the Contractor pursuant to Paragraph 2.5.1 of this Agreement, the Architect, in consultation with the Contractor and at the direction of Owner, shall provide such modification in the Construction Documents as necessary to bring the cost of the Project within the Project’s budget as established by the Owner and the Contractor’s final estimates, as the Owner shall determine. The Architect shall be appropriately compensated by the Owner for the modification in the Construction Documents.
