CDOT. The CDOT project manager (PM), who has the responsibility for that project, will authorize the employee to be placed on the Project. Such authorization should be documented, at minimum via email correspondence. The date reflected within the PM authorization correspondence will serve as reference to any billing rate approval. The PM will then direct the Consultant to contact CDOT Audit Liaison, Xxxxxx Xxxxxx (Xxxxxx.Xxxxxx@xxxxx.xx.xx) and inform him of the PM approval (submit a copy of authorizing correspondence) if that added employee is not on their MPA. The Consultant will then prepare all required submittals for billing rate approval. Consultant employee may begin work, as directed by CDOT PM. .

CDOT. 1. Has developed a list, with assistance from CNHP, TNC, FWS, CDOW, and recognized field experts, of declining species that a) CDOT could impact in projects on the Eastern Plains over the next 20 years, b) could be federally listed under the ESA in the next 20 years, and c) could benefit from and potentially satisfy ESA section 7 via a conservation/mitigation banking program.
2. Has collected, with assistance from CDOW, CNHP, and TNC, and consultation with FWS, the best available scientific and commercial data on the habitat and range of and potential impacts to the species listed in Appendix A and a number of other species that could be included once mitigation sites are identified. CDOT, TNC, and CNHP verified and/or refined that information in consultation with recognized field experts in each of several taxonomic groups, to supplement the best available data. This combined information was used to perform GIS analyses and create range estimates and future impact estimates.
3. Has evaluated, using best available data and expertise, impacts to habitats (and thus the target species) on a comprehensive rather than on an individual or site basis.
4. Will develop drafts of appropriate ESA compliance documents including biological information on all species covered by this MOA, their range and status, estimated potential direct, indirect, and cumulative effects from CDOT projects over the next 20 years, and suggested proactive conservation measures to be implemented to minimize future impacts. Such measures may include funds for purchase and oversight of real property interests for conservation purposes, as well as Best Management Practices (BMPs) to minimize effects from transportation development on species subject to this MOA. Such compliance documents will be submitted to the FWS by FHWA/CDOT.

CDOT has goals to improve safety, mobility, access, and rural connectivity to transit services.
CDOT has undertaken a multi-year project to create a comprehensive geographic information system (GIS) map of all of its property ownership. CDOT hired a full-time Property Management GIS specialist to further and expedite the project. The end goal of the project is to have a publicly accessible map that shows all excess and remainder parcels available for sale that also aids the agency in tracking maintenance activities.
CDOT in coordination and cooperation with Owner, shall identify and track the Relocation status of Owner’s Utilities on a Utility matrix (“Utility Matrix”). Utility Matrices shall be updated by CDOT as Utilities are identified and Relocated and will reflect changes, clarifications, corrections or developments with respect to each Utility’s conflict status. Updated Owner-specific Utility Matrices will be provided to Owner upon request. CDOT and Owner shall meet regularly to verify whether, based upon then-current Project Plans, a Utility requires Relocation and to determine the possibility of Relocating any Utility prior to notice of Project Commencement. If at any time a Utility Matrix provided to Owner fails to identify Owner utilities that Owner knows or should reasonably know may be in conflict with a Project, Owner shall notify CDOT of such unidentified Owner utility and provide all documentation with respect thereto, and the Owner utility will be added to the Utility Matrix.
CDOT will provide design and construction management for the Project and will oversee the Design Builder who shall perform the construction in accordance with the approved design plans and technical specifications and/or administer the construction, all in accordance with the terms and conditions of the D-B Contract. Such administration shall include, but not be limited to, inspection and testing; approving sources of materials; performing required plant and shop inspections; documentation of contract payments; preparing and approving pay estimates; preparing, approving and securing the funding for contract modification orders and minor contract revisions; processing, investigating and, if appropriate, disputing contractor claims; construction supervision of the contractor and subcontractors under the D-B Contract in relation to the construction schedule and other requirements of the D-B Contract; enforcing the rights and remedies of CDOT under the D-B Contract; and meeting requirements of applicable federal and state laws and regulations.
