COMMISSION ANALYSIS. The Commission has reviewed the Notice and the accompanying materials filed under seal. The Amendment does not materially affect the underlying financial analysis of the Existing Agreement. Thus, the Commission finds that the Existing Agreement, as amended, comports with the provisions applicable to rates for competitive products in 39 U.S.C. § 3633(a) and 39 C.F.R. § 3015.7. The Postal Service states that the Amendment shall become effective two business days after the date that the Commission completes its review. Notice at 1. The Existing Agreement, as amended, is set to expire three years after the initial effective date unless, among other things, either party terminates the contract with 90 days’ written notice to the other party or it is renewed by mutual agreement.3 If the Existing Agreement, as amended, is terminated prior to the scheduled expiration date, the Postal Service shall promptly notify the Commission. In conclusion, the Commission approves the Existing Agreement, as amended. COMMISSION ANALYSIS. The Commission’s responsibilities in this case are to determine whether the instant contract: (1) is functionally equivalent to the IBRS 3 baseline contract; and (2) satisfies the requirements of 39 U.S.C. § 3633 and applicable Commission rules (39 CFR 3015.5 and 3015.7). The Commission’s assessment of the functional equivalence of the instant contract to the IBRS 3 baseline contract leads it to conclude that the two contracts share similar costs and market characteristics. The revision to Article 15 and the addition of Article 30 are minor differences that do not fundamentally alter either the service the Postal Service will provide under the contract or the structure of the contract. Cost considerations. The Commission reviews competitive products to ensure they meet the applicable requirements of 39 CFR 3015.5 and 3015.7, as well as 39 U.S.C. § 3633. The Commission has reviewed the financial analyses underlying the instant contract and the PR Comments. Based on the information provided, the Commission finds the contract submitted should cover its attributable costs (39 U.S.C. § 3633(a)(2)), not lead to the subsidization of competitive products by market dominant products (39 U.S.C. § 3633(a)(1)), and have a positive effect on competitive products’ contribution to institutional costs (39 U.S.C. § 3633(a)(3)). Thus, a preliminary review of the proposed contract indicates that it comports with the provisions applicable to rates for competitive products in 39 U.S.C. § 3633.

The Commission analyzes a market dominant negotiated service agreement (NSA) under 39 U.S.C. § 3622(c)(10), which requires that a market dominant NSA: (1) improves the net financial position of the Postal Service or enhances the performance of operational functions; (2) will not cause unreasonable harm to the marketplace; and (3) will be available on public and reasonable terms to similarly situated mailers. Pursuant to 39 U.S.C. § 407(d)(2), the Postal Service is required to provide the Commission with a copy of a contract with foreign agencies related to providing international postal and/or delivery services. The Revised Agreement revised various articles and annexes of the contract. Notice at 1-2. The Commission concludes that the Revised Agreement is substantially similar to the Existing Agreement and the differences between them do not fundamentally alter the service the Postal Service will provide under the Existing Agreement or the structure of the Existing Agreement. Nor should the differences in the Revised Agreement affect the costs and revenue of the Existing Agreement. Thus, the Commission finds that the Revised Agreement comports with the statutory and regulatory provisions applicable to rates for market dominant products.   • Statistical Analysis 31 F-tests and t-tests will be used to analyze OV and Quality Acceptance data. The F-test is a 32 comparison of variances to determine if the OV and Quality Acceptance population variances 33 are equal. The t-test is a comparison of means to determine if the OV and Quality Acceptance 34 population means are equal. In addition to these two types of analyses, independent verification 35 and observation verification will also be used to validate the Quality Acceptance test results.

  • COMPENSATION ANALYSIS After the expiration of the second (2nd) Renewal Term of this Agreement, if any, a Compensation Analysis may be performed.   • Test Reports Should a test report (“Test Report”) be required on the purchase order, the Test Report must be signed or stamped by an authorized representative of the supplier. It must contain, as a minimum, supplier name and address, Buyer part number, purchase order number, quantity, date shipped, heat/lot number, all acceptance criteria for specification and list all of the specifications i.e. MIL-P, AMS, ASTM, etc. which would apply to the shipment. All material shipped is to be the latest revision available. All Test Reports to reference revision level of material shipped.

  • Evaluation Reports Where a formal evaluation of an employee's performance is carried out, the employee shall be provided with a copy to read and review. Provision shall be made on the evaluation form for an employee to sign it. The form shall provide for the employee's signature in two (2) places, one indicating that the employee has read and accepts the evaluation, and the other indicating that the employee disagrees with the evaluation. The employee shall sign in one of the places provided within seven (7) calendar days. No employee may initiate a grievance regarding the contents of an evaluation report unless the signature indicates disagreement with the evaluation. The employee shall receive a copy of the evaluation report at the time of signing. An evaluation report shall not be changed after an employee has signed it, without the knowledge of the employee, and any such changes shall be subject to the grievance procedure.
