COMPENSATION COMPLIANCE. A. No Strike/No Lockout The Association and its members, as individuals or as a group, will not initiate, cause, permit, or participate or join in any strike, work stoppage, slowdown, picketing or any other restriction of work during the period of this Agreement. There will be no lockout of employees in the unit by the District as a consequence of any dispute arising during the period of this Agreement. In the event the Association wishes to participate in state-wide activity that could require a waiver of this section, the Association and the Superintendent will meet to discuss such an exception, including if necessary an adjustment in the school calendar. Both parties agree to make every effort to reach an accommodation acceptable to all concerned.
COMPENSATION COMPLIANCE. 1. The salaries and insurance benefits contained in this Contract are entered into subject to the limitations imposed by SHB166 (Laws of 1981) and the 1983-85 Biennial Budget Appropriations Act. Therefore, the total compensation (salaries and insurance benefits) for the Enumclaw School District employees for the duration of this Contract shall not exceed either the percentage or dollar amount of funds allowed. Salaries and insurance benefits found by SPI, state auditor, or court of law to be in violation of limitations imposed shall be adjusted to bring the District into compliance. Any such adjustments will be dealt with through the collective bargaining process.
2. Any provisions in this Contract found by the SPI or a court of law in violation of the statutes cited above shall be adjusted to bring the District into compliance with state statutes and rules and regulations promulgated therefrom. Any Contract language changes proposed to bring the District into compliance will subsequently be dealt with through the collective bargaining process.
COMPENSATION COMPLIANCE. All compensation shall be subject to normal income tax, social security and other federal withholding requirements. The parties represent, covenant, warrant and agree that all compensation paid hereunder is based solely on the fair market value of services to be provided by Resident hereunder and is not based, in any manner, on the volume or value of referrals or of services provided which are paid for directly or indirectly by federal or state health care programs.
COMPENSATION COMPLIANCE. Each Party is solely responsible for all salaries and other compensation of all its employees as well as all payroll taxes to appropriate government authorities payable as a result of services performed under this Agreement. Each party is solely responsible for all contractually required payments to its independent contractors. Each Party will comply with any applicable federal, state or local law regarding its employees, including federal or state laws or regulations regarding minimum compensation, overtime and equal opportunities for employment. Each Party warrants that its employees, while working in connection with this Agreement, will comply with any and all applicable federal, state or local law.
COMPENSATION COMPLIANCE. The Company shall fully comply with the workers compensation laws applicable to the Company and its employees. The Company further agrees to indemnify, defend, and hold the Owner harmless from any failure of the Company to comply with applicable workers compensation laws. The Owner shall have the right to offset against any amounts otherwise due to the Company under this Contract any costs incurred by the Owner resulting from any such failure to comply or resulting from Company’s failure to promptly pay to the Owner any reimbursement or indemnification arising under this section.
COMPENSATION COMPLIANCE. A. It is the intent of the parties to provide the maximum salary allocations for certificated instructional staff (non-administrator) allowed and funded by the state as applied to the local salary schedule.
B. Any additional legislated salary allocation-model increases funded after September 1st, 2005, for the subsequent school year(s) will be in addition to the above and added to the district salary schedule.
C. All employees (B.E.A. and non-B.E.A.) will be paid on the negotiated salary schedule.
D. The actual average salary paid to basic education certificated educational instructional staff shall not exceed the district's average basic education certificated education allocations for that school year as determined pursuant to RCW 28A.150.410 and 28A.400.200.

COMPENSATION COMPLIANCE. Prior to execution of this Contract, Service Provider shall submit a certificate of good standing from the Workers Compensation Board to the Society and to provide additional certificates as often as is deemed necessary by the Client during the term of this Contract.
COMPENSATION COMPLIANCE. The Contractor agrees to comply with the state laws and rules applicable to workers' compensation benefits for its employees. If the Contractor fails to comply with the Workers' Compensation Act and applicable rules when required to do so, the Town reserves the right to terminate this Agreement.
