CONDITION OF SERVICES. The Subrecipient agrees to the following: a) The SERVICES shall benefit City residents. b) The Subrecipient shall maintain records including, but not be limited to, the following: 1. Client profiles identifying household income, head of household, ethnicity, race and gender. 2. An outreach plan, which insures equitable participation by all eligible City residents. c) The Subrecipient shall maintain a citizen participation mechanism, which will include, but not be limited to the following: 1. Logging of citizen comments or complaints when received, pertaining specifically to services provided under this Agreement. 2. Copies of comments and/or complaints received in writing referenced in 1 above, and all responses. d) The Subrecipient shall abide by the Federal requirements of 24 CFR 570.600-612, Subpart K, Other Program Requirements, the U.S. Office of Management and Budget (OMB) Circulars A-122, Cost Principles for Non-profit Organizations, and OMB A-110, Grants and Agreements with Institutions of Higher Education, Hospitals and Other Non-Profit Organizations, as applicable, and all other federal, state and local laws and requirements. e) The Subrecipient acknowledges and accepts the conditions set forth in the letter submitted by the City to Subrecipient, a copy of which is attached hereto as Exhibit “B” and made a part of this Agreement.

CONDITION OF SERVICES. You shall not permit any person other than an Authorized User to use or access the Services. You shall cause each Authorized User to comply with the terms and conditions of this Agreement. The rights granted to you pursuant to this Agreement are conditioned upon your compliance with the terms of this Agreement.
CONDITION OF SERVICES. The Grantee agrees to the following: a) Repairs shall be limited to owner-occupied, single-family homes in the City of Pahokee occupied by “low income” residents as defined by Palm Beach County. b) Maintenance of records including, but not be limited to, the following: 1. Information identifying household income, head of household, ethnicity, race and gender, to the extent allowed by law; 2. Other documentation that may be required by the City. c) The Grantee shall not, for a period of two (2) years from the execution of this agreement, rent or otherwise convey or transfer title to the property or any portion of the property. d) Allow City of Pahokee officials on the premises and give access to inspect the site to identify and confirm eligibility of requested home repairs. An appointment shall be scheduled in advance between the homeowner and the City to review existing conditions identified home repair item prior to approving the requested repairs. e) The Grantee shall, to the extent permitted by law, allow all necessary personal and financial background investigations to be conducted by the City. Grantee shall provide City with any consents or authorization required by any third party who has such information. f) The Grantee shall not use the Premises, or any portion thereof, or permit the same to be used for any illegal, immoral or improper purposes, nor to make, or permit to be made, any disturbance, noise or annoyance whatsoever detrimental to the premises or the comfort and peace of the inhabitants living within the vicinity of the demised premises. Any violation of this provision within three (3) years from the execution of this Agreement shall result in the entire grant becoming due and payable by the Grantee to the City notwithstanding the City’s agreement to discharge a portion of the debt each year. g) The City’s Program shall be performed by general contractors and other tradesmen licensed to perform construction work by the State of Florida who also possess valid local business licenses. h) As part of applying for funds from the Program, the Program Grantee provided satisfactory documentation to the City evidencing their eligibility, including, but not limited to, the following:
CONDITION OF SERVICES. The Board agrees to the following: a) The Services shall benefit economically challenged City of North Miami residents. b) The Board shall establish an enrollment period starting fifteen (15) days prior to the start of the semester and ending thirty (30) days after the beginning of each semester. The application is referenced in Exhibit “A” in addition to the Mutual Consent Form referenced in Exhibit “B” c) Eligible students shall be: 1. Economically challenged students are individuals identified as low- to moderate-income, living below the 80% of the Area Median Income (AMI) based upon the income limits for the Miami-Dade County Metropolitan Statistical Area (MSA) and as determined by the U. S. Department of Housing and Urban Development (HUD) as amended from time to time with adjustments for household size; and 2. Enrolled at the North Miami Adult Education Center; and 3. Submit a City of North Miami program application (Exhibit “C”) during the enrollment period and provide valid proof of eligibility including but not limited to: Driver’s License with North Miami address, Lease Agreement or Deed showing North Miami address, recent paystub, W-2 or last filed Income Tax Form; and

Other documentation that may be required by the City. c) Allow City of West Park officials on the premises and give access to inspect the site to identify and confirm eligibility of requested tree trimming services. An appointment shall be scheduled in advance between the homeowner and the City to review existing conditions identified home repair item prior to approving the requested repairs. d) The Grantee shall, to the extent permitted by law, allow all necessary personal and financial background investigations to be conducted by the City. Grantee shall provide City with any consents or authorization required by any third party who has such information. f) The Grantee shall not use the Premises, or any portion thereof, or permit the same to be used for any illegal, immoral or improper purposes, nor to make, or permit to be made, any disturbance, noise or annoyance whatsoever detrimental to the premises or the comfort and peace of the inhabitants living within the vicinity of the demised premises.

Other documentation that may be required by the City. c) The Grantee shall, to the extent permitted by law, allow all necessary personal and financial background investigations to be conducted by the City. CONDITION OF SERVICES. The Grantee agrees to the following: 1) Rent, mortgage and utility assistance funds may be provided to eligible City of West Park residents upon providing proof of income source prior to COVID-19 and proof of income suspension as a result of to COVID-19. 2) The following documentation shall be provided for funding consideration: a. Proof that Grantee is a City of West Park resident; b. Proof of employment income prior to COVID-19 in the form of pay stubs or tax returns (Note: For the purpose of this agreement, proof on income must include validation of income earned on or after the date of the State of Florida’s Declaration of Emergency in accordance with Executive Order 20-52; c. Proof in income suspension from employer as a result of COVID-19 or proof of a COVID-19 positive diagnosis from a practicing health care physician;

Related to CONDITION OF SERVICES

  • Inspection of Services Subcontractor shall make the Services accessible at all reasonable times for inspection by the Contractor. Subcontractor shall, at the first opportunity, inspect all material and equipment delivered to the job site by others to be used or incorporated in the Subcontractor’s Services and give prompt notice of any defect therein. Subcontractor assumes full responsibility to protect the work done hereunder until final acceptance by the Contractor or any authorized third (3rd) party.

  • Completion of Services (a) The Customer must: (i) notify Deswik in writing as soon as the Customer becomes aware of any defects in the Services; or (ii) provide Deswik with an email confirming successful completion of any Services Deswik advises the Customer have been completed. (b) If the Customer does not notify Deswik of any defects under clause 5.4(a)(i) or provide Deswik with an email confirming successful completion of the Services within 14 days of Deswik notifying the Customer that the relevant Services are complete, the Customer is deemed to have accepted the Services. (c) If the Customer notifies Deswik of any defects under clause 5.4(a)(i), Deswik will, as soon as possible investigate and (where applicable) undertake rectification of the defects. Upon completion of any defect rectification the Customer must promptly provide an email notification of the successful completion of the services, unless further defects exist. In this case, the Customer is further required to notify Deswik of such defects.

  • Termination of Services 6.2. To promote a non-discriminatory work environment based on the principle of equality, employers and the trade union should adopt appropriate measures to ensure that employees with HIV and AIDS are not unfairly discriminated against and are protected from victimisation through positive measures such as: (i) preventing unfair discrimination and stigmatisation of people living with HIV or AIDS through the development of HIV/AIDS policies and programmes for the workplace; (ii) awareness, education and training on the rights of all persons with regard to HIV and AIDS; (iii) mechanisms to promote acceptance and openness around HIV/AIDS in the workplace; (iv) providing support for all employees infected or affected by HIV and AIDS; and (v) grievance procedures and disciplinary measures to deal with HIV-related complaints in the workplace. 7. HIV TESTING, CONFIDENTIALITY AND DISCLOSURE

  • Location of Services Subcontractor will provide the Services at the following address(es): _________________________________________________________________________________________________________________________________________________________.

  • Cessation of services The delegation or assignment of CONTRACTOR’s services, operation or administration to another entity without the prior written consent of COUNTY.

  • Duration of Services The obligation of GGP to perform any individual Service described in or contemplated by this Section E shall terminate upon the earliest to occur of (a) 18 months following the Distribution Date, (b) five days following written notice of termination of such Services by Spinco to GGP and (c) the applicable termination date pursuant to Article IX of the Agreement. GGP agrees to use appropriate and reasonable efforts, as mutually agreed upon by the parties and at Spinco’s cost, to (i) ensure that any terminated Service is integrated into Spinco’s broader business processes and/or (ii) complete any individual Service in this Section E requested by Spinco prior to the termination described in the prior sentence.

  • Modification of Services Credit Union reserves the right to modify the Service from time to time without making prior notice to Member, provided, however, that Credit Union will give you at least thirty (30) days notice prior to making any modifications to the Service that would materially alter their functionality.

  • Suspension of Services We have the right to suspend the benefit of any Credit Union service at any time for reasonable cause. At Our discretion, We also have the right to pay any share draft presented for payment from Your Account after Your Account is closed or suspended and to recover such amount paid from You.

  • Coordination of Services Consultant agrees to work closely with City staff in the performance of Services and shall be available to City’s staff, consultants and other staff at all reasonable times.
