CONTINUATION OF BENEFITS AFTER TERMINATION OF THE PLAN. In the event of the Plan while you are disabled, payments during the period of disability will continue to paid as though the Plan remained in force. The Board will ensure no loss of annual leave for members who, account of illness or injury, are absent work. Such annual leave be paid for by cheque or by rescheduling of the annual leave time at the member’s option and within one (I) week of the member’s return, the member and the Chief of Police or designee shall agree upon when the vacation credit, statutory holidays and float shall he taken within the following (12) months, or in the alternative, the member elect to be paid for same at the current rates of pay. Members who, as a result of absence due to illness or injury. are unable to take vacation, statutory and/or float entitlenient by December of the year of entitlement, shall be paid by cheque for at the rates applicable. Members who have been on long term disability for (12) months or more shall not thereafter be entitled accrue annual or statutory leave for any of absence beyond the (12) months. In the year a member returns to duty he or she will receive leave entitlement for that year. The Board shall authorize sick leave entitlement for those members involved in Infertility Programs, subject to the member providing request and medical substantiation in advance. The issue has been referred to a joint committee of the Board and the Association to work out the details of such a plan. LETTER OF UNDERSTANDING PAY EQUITY B E T W E E N : REGIONAL MUNICIPALITY OF NIAGARA POLICE SERVICES BOARD and NIAGARA REGION POLICE ASSOCIATION The parties agree that the salary schedules in the Collective Agreement shall be updated to comply with the results of the pay equity process completed within the Service. The implementation of a pay equity process and the development of a routine maintenance plan is to be conducted by a joint Service Management/Association Committee. Issues arising out of the pay equity process are to be referred to the joint Committee. The parties shall use their best efforts to complete the pay equity process in accordance with the agreed upon timeline of June, 2007. The pay equity process will comply with Pay Equity Legislation. The pay equity process agreed upon by the joint Committee will not be amended except by a committee of similar composition.   • Termination of Benefits Except as provided in Section 2 above or as may be required by law, Executive’s participation in all employee benefit (pension and welfare) and compensation plans of the Company shall cease as of the Termination Date. Nothing contained herein shall limit or otherwise impair Executive’s right to receive pension or similar benefit payments that are vested as of the Termination Date under any applicable tax-qualified pension or other plans, pursuant to the terms of the applicable plan.

  • Retention of Benefits Union leave under the following four (4) sections will be unpaid. The Employer will maintain regular pay and xxxx the Union for the costs of the employee’s salary and benefits. If the Union member is part-time or casual, and the leave is greater than their normal work hours, the Employer will pay the employee for the full length of the leave requested by the Union.   • Limitation of Benefits (a) Anything in this Agreement to the contrary notwithstanding, in the event it shall be determined that any benefit, payment or distribution by the Company to or for the benefit of the Executive (whether payable or distributable pursuant to the terms of this Agreement or otherwise) (a "Payment") would, if paid, be subject to the excise tax imposed by Section 4999 of the Code (the "Excise Tax"), then the Payment shall be reduced to the extent necessary to avoid the imposition of the Excise Tax. The Executive may select the Payments to be limited or reduced.

  • Restoration of Benefits The correction method should restore the plan to the position it would have been in had the failure not occurred, including restoration of current and former participants and beneficiaries to the benefits and rights they would have had if the failure had not occurred.

  • Effective Date of Benefit Termination Medical, dental and life coverage termination will take effect on the first of the month following the loss of eligible employee or dependent status. Disability benefit coverage terminations will take effect on the day following loss of eligible employee status.

  • Integration of Benefits If you are disabled, the monthly payments under this plan will be reduced by the amount of any Periodic Payments you are entitled to apply for and receive with respect to the disability under any Workplace Safety & Insurance Act, the Canada Pension Plan or the Quebec Pension Plan. The amounts deducted will not include any additional benefits payable for children or subsequent cost of living increases.

  • Continuation of Plan Subject to the continuing approval of the Commissioner of Internal Revenue, to the extent available, and of other cognizant governmental authorities, as more particularly hereinafter specified, and to the provisions of 17.5, a Retirement Plan (hereinafter called the Plan) in the form now in effect as to the employees within the units to which this Agreement relates shall continue to be effective while this Agreement is in effect as to such employees in accordance with and subject to the terms, conditions, and limitations of the Plan.

  • Duplication of Benefits Grantee shall not carry out any of the activities under this Agreement in a manner that results in a prohibited duplication of benefits as defined by Section 312 of the Xxxxxx X. In consideration of Grantee’s receipt or the commitment of CRF funds by Florida Housing, Grantee hereby assigns to Florida Housing all of Grantee’s future rights to reimbursement and all payments received from any grant, subsidized loan or any other reimbursement or relief program related to the basis of the calculation of the portion of the funds committed to the Grantee under this Agreement and determined to be a Duplication of Benefits (DOB). Any such funds received by the Grantee shall be referred to herein as “additional funds.” Grantee agrees to immediately notify Florida Housing of the source and receipt of additional funds received by the Grantee that are determined to be a DOB. Grantee agrees to reimburse Florida Housing for any additional funds received by Grantee if such additional funds are determined to be a DOB by Florida Housing, the Federal awarding agency or an auditing agency.
