Custom Design. (a) Where Mascot or its agent design and/or undertake engineering of a “Special Order” product then:
i. the work remains the property of Xxxxxx who is the rightful intellectual property owner;
ii. Mascot only provides the supplier/manufacturer’s warranties outlined in this Agreement in respect of the Mascot completed product (not the separate design and/or drawings);
iii. Mascot only provides the warranties in ii. and provides no separate warranties in relation to engineering specifications or design;
iv. any design and/or drawings produced with Mascot may not be used, or relied upon, in connection with a supply by any other party of the relevant modification or product; and
v. any professional indemnity insurance in respect of engineering services in respect of the Job is taken out by the relevant third party engineer, unless the Confirmation specifies a further Mascot charge to the Buyer, which has been paid, for the right to use and/or own the design, drawings and/or work produced. Such a right only extends to engineering if engineering services are also specifically stated in the Confirmation and either are included in the stated charge or a separate engineering charge is stated in the Confirmation.
(b) Where Mascot or its agents manufacture a “Special Order” product to the Buyer’s design and engineering specifications, the following terms apply:
i. drawings or other marked specifications must be clear, accurate and complete with respect to all dimensions, cut outs, insertions and other requirements. The Buyer bears sole responsibility for, and cost arising from, any associated ambiguity, error or omission;
ii. Mascot does not provide engineering services and assumes no responsibility in respect of engineering matters or omissions. To the extent the Buyer is relying on engineering matters, the Buyer should obtain its own independent engineering approvals from an appropriately qualified engineer;
iii. Mascot provides no warranties in relation to any drawings and/or engineering specifications or design; and
iv. Mascot warrants that it has made the product to the final specifications and drawings approved by the Buyer but, to the extent permitted by law, provides no warranty in relation to whether the product is fit for purpose for the Job or in respect of the product’s effective life or life-cycle.

Custom Design. You are purchasing a website theme which has a number of design elements that can be customised with a few clicks of a mouse. However, if you require any custom design work (such as banners, icons and custom illustrations), our charges are £60.00 per hour or for specific projects, we can provide a quote. Custom Design. (a) Any production times given to the Buyer are estimates only.
(b) Moulds used for custom design Orders remain the property of MAISON and can or may be used for future manufacture of retail/trade/wholesale Orders.
(c) If the shape/style is not standard for your Order (e.g. cube or rectangular trough) the final product is heavily reliant on any drawings or specifications supplied by you. You are responsible for confirming that your Quote accurately specifies (if applicable) the quantity, dimensions, colours and specifications of the goods and/or services required before accepting any Order. We will not be responsible for any issues with the Order for your non-compliance with this clause or due to you not having provided adequate design instruction.
(d) If you have not provided adequate design instruction and specified details you agree and authorise MAISON DESIGN to provide final design details for your Order
Custom Design. At the CGA's option and issuance of a signed purchase order, the Contractor will redesign some or all of the current website, including but not limited to the homepage, subpages, or representative pages exploring both the stylistic and functional goals for the site’s design. This redesign would include creation of wireframes and page layouts, then presentation of design options. Once the final design is approved, the final website would be developed to feature responsive design to ensure optimal browsing on desktop, tablet, and mobile browsers.
Custom Design. Users confirm that they accept the contents of services and do this of their own accord. Upstream SMS SMS sent from user’s mobile to SMS gateway of Party B. the cost arising from Upstream SMS is the upstream communication fee and shall be paid by users to Party A. SMSend SMSend shall mean SMS sent from SMS access number of Party B to user’s mobile, including SMS in relating to PUSH services. Unbalanced Communication Charge The cost arising from Unbalanced SMS (number of SMSend minus number of Upstream SMS), the Unbalanced Communication Charge shall be paid by Party B to Party A. 7X24 hours It's available 24 hours a day, 7 days a week and even at holidays. Communication Fee The cost arising from which users or SP connects to network resources; Communication Fee shall be paid by users or SP to Party A and owned by Party A. Message Service Fees The costs arise from using the information contents or application services of SP other than Communication Fee. Message Service Fee shall be shared by Party A and Party B according to the percentage. Prior to sharing, it shall be calculated by Account System of Party A, the costs paid by users shall be known as “total message service fees”.As agreed, the message service fees, that the total fees, after deducting a proportional share and charge, paid by Party A to Party B, shall be the settled message service fees. Billing Cycle The billing cycle by Account System of Party A to the total message service fees of Party B is generally by natural month, from 0:00 hrs, month 1 to 24:00 hrs, last day of same month. Company Code “Company Code of SP in Value-Added Services of China Unicom”is called Company Code for short and is as an unique company ID to identify Party B in the system of Party A. Service System of Partners An OA System for routine work, built and maintained by Party A, used to achieve access, Protocol signature, check account, information publishing and feedback. Ranking Based on one or more indicators, such as Message Service Fees, volumes, etc, all SP that carry out a value-added service and enjoy the supported period, from top to low, are ranked by Party A. If there is a decimal in total SP multiplied by the percentage, only integer is kept and the figures after the decimal point shall be considered negligible. Where the message service fees of SP can not be determined as a result of check account, it shall be ranked according to data of Party A before check account. Custom Design. 6.2.1. Kadonation will provide a sample/proof of concept of the custom design (e.g. cards, sleeves, boxes or webpages) to the Customer, if agreed upon in the Agreement. The Customer must send Kadonation written confirmation with the sample/proof of concept at the latest fifteen (15) Business Days before the requested delivery date. Change requests or refusals must be properly substantiated in writing.
6.2.2. The Customer must provide Kadonation with all information/documentation (such as but not limited to logo’s, prior designs, color schemes and messages) and support (deemed necessary by Kadonation) needed to provide the Services or produce the Products. Kadonation is not obligated to verify the accuracy of the information/documentation provided by the Customer.
6.2.3. If the Customer request Services related to custom design, Kadonation shall not commence the production of the Products before it received all information, support and/or approvals of the Customer.
