Customer Disputes. Agency agrees to maintain records of any disputes, threats of lawsuits or actual lawsuits involving any Referred Accounts. Agency agrees to provide access to Client to copies of any written complaint received from the obligor concerning the Agency’s handling of a Referred Account as well as the response made or action taken by Agency. Client reserves the right to recall any Referred Account as a result of a customer complaint.
Customer Disputes. There are no written disputes commenced by the Company’s customers relating to the performance or quality of the Company’s products or services or refusal to pay by customers on the basis of dissatisfaction with the Company’s products or services.
Customer Disputes. Builder shall be solely responsible for the resolution of any and all disputes between Builder’s customers and Builder. Failure to resolve disputes associated with the Florida Water StarSM features may result in removal of Builder from the Program.
Customer Disputes a. Where a Customer or potential Customer has a dispute with the Service Provider which the Customer or potential Customer has attempted to resolve with the Service Provider and the dispute has not been resolved after thirty (30) days of it being referred to the Service Provider, then either of the parties to the dispute may refer it to the Licensee for esolution
b. The Licensee shall develop procedures and shall nominate staff for resolving such dis- putes in Accordance with Regulatory Board guidelines and shall inform the Service Pro- vider of the staff and procedures within three (3) month of the signing of this SPA. The Licensee will act as an investigator and mediator towards resolving disputes between the parties and may order the party found at fault to compensate the other for the losses caused
c. Decisions made by the Licensee will be binding on both the Service Provider and the other party to the dispute, unless an appeal is lodged with the Water Appeals Board. The deci- sion of the Water Appeal Board on the appeal will be final and binding on the parties.
Customer Disputes. If any litigation, arbitration or mediation proceeding is pending or threatened by or between Buyer and its customer or another third party relating to the subject matter of the Agreement, Seller will consent to and submit to the jurisdiction of and be joined in that litigation, arbitration or mediation proceeding upon the request of Buyer, and will agree to be bound by all orders, rules and awards entered in that proceeding, which, in the case of arbitration, will be final and binding on the parties.
Customer Disputes. (a) If any Customer brings any legal proceedings in any court against any party to this Agreement (the Defendant Party) and the Defendant Party wishes to make a third party claim (as defined in clause 14.7(b)) against the other party to this Agreement, then the parties agree that the third party claim can be dealt with in the legal proceedings brought by the Customer rather than being dealt with under this clause 14.
(b) For the purposes of clause 14.7(a), third party claim shall mean:
(1) any claim by a Defendant Party against the other party (whether or not already a party to the legal proceedings) for any contribution or indemnity; or
(2) any claim by a Defendant Party against the other party for any relief or remedy relating to or connected with the subject matter of the legal proceedings and substantially the same as some relief or remedy claimed by the Customer; or
(3) any requirement by a Defendant Party that any question or issue relating to or connected with the subject matter of the legal proceedings should be determined not only as between the Customer and the Defendant Party but also as between either or both of them and the other party (whether or not already a party to the legal proceedings).
Customer Disputes. Debtor will promptly advise Bank of any dispute ----------------- with a customer in any case where the dispute involves (i) an account or accounts receivable aggregating $500,000.00 or more, or (ii) one of Debtor's ten (10) largest customers by average monthly revenue and the customer has threatened to terminate Debtor's services.
Customer Disputes. If a Customer dispute arises, Payment Guarantee payments from Company are suspended until the dispute is resolved. Disputes include any chargebacks initiated by the customer.
Customer Disputes. In the event (a) there is an arbitration, legal, or other equitable action or proceeding involving Buyer and its Customer in a jurisdiction and venue that is not the jurisdiction and venue under Sections 28.1 or 28.2, as applicable (each, an “Alternative Jurisdiction”) and (b) such arbitration, action, or proceeding relates to the Goods or this Contract, then, at Buyer’s option, (i) Seller agrees to submit to the Alternative Jurisdiction, (ii) the Parties agree that the sole and exclusive forum and venue for any legal or equitable action or proceeding arising out of, or in connection with, this Contract will lie in the Alternative Jurisdiction; or (iii) both.
Customer Disputes. Franchisee will take Customers’ calls and respond to Customers’ correspondence with respect to disputes regarding billing or otherwise, or resolving disputes. Franchisee acknowledges that County is not responsible for handling Customer disputes.
