Customer Obligations and Restrictions. 5.1. Customer Data and Network Performance. Customer is solely responsible for the accuracy and content of all Customer Data and entering Customer Data into the Services. Customer represents, warrants, and shall ensure that: (a) Customer has obtained, and will continue to have, all necessary rights, consents, and permissions in Customer Data, and has made and will continue to make all necessary disclosures and notices, in accordance with applicable laws, to grant the rights to Amperity with respect to such Customer Data under the Agreement and to enable Amperity to use and process such Customer Data as contemplated under the Agreement; and (b) that Customer Data, and Amperity’s use or other processing of such Customer Data in accordance with the terms of the Agreement, will not and does not violate the rights of any third party or any applicable laws. Without Amperity’s express prior written consent in each instance, Customer shall not (and shall not allow any User or third party to) send or transmit to Amperity any Customer Data that includes raw credit or bank card information pertaining to any of Customer’s customers. Customer is responsible for procuring and maintaining the network connections that connect Customer to the Services.

Customer Obligations and Restrictions. 3.1 Customer and its Authorized Users will, at all times, comply with all applicable local, state, federal, and foreign laws and regulations in accessing and using the Licensed Products, including without limitation such laws and regulations relating to privacy, protected health information and export/import controls.

Customer will protect the accounts, passwords, and other authentication information Customer uses to access the Service and any NextRequest system, and is responsible for the use of the Service by any Customer User, employee of Customer, any person Customer authorizes to use the Service, any person to whom Customer has given access to the Service, and any person who gains access to Customer Content or the Service as a result of Customer’s failure to use reasonable security precautions, even if such use was not authorized by Customer. Customer’s user names, passwords, other login information or personal information may be stored by NextRequest or its Service Providers in the course of providing Service and may be available to the Service and Service Providers.
