Delivery Mechanism. If Participant has any notice or knowledge that the Delivery Mechanism fails to function properly, or that any Participant Data Updates are otherwise not being provided to or received by Data Republic, it will notify Data Republic and rectify the error as soon as possible. If Data Republic has any notice or knowledge that the Delivery Mechanism fails to function properly, or that any Participant Data Updates are otherwise not being provided to or received by Data Republic, it will notify Participant in addition to promptly rectifying the error.
Delivery Mechanism. The First Homes shall be marketed for sale and shall only be sold (whether on a first or any subsequent sale) as First Homes to a person or person(s) meeting: the Eligibility Criteria (National); and the Eligibility Criteria (Local) (if any). If after a First Home has been actively marketed for three (3) months (such period to expire no earlier than three (3) months prior to Practical Completion of that First Home) it has not been possible to find a willing purchaser who meets the Eligibility Criteria (Local) (if any), paragraph 1.2 above shall cease to apply. Subject to paragraphs 6 to 10 below, no First Home shall be First Home Disposed of (whether on a first or any subsequent sale) unless not less than fifty percent (50%) of the purchase price is funded by a first mortgage or other home purchase plan with a First Home Mortgagee. No First Home shall be First Home Disposed of (whether on a first or any subsequent sale) unless and until: The District Council has been provided with evidence that: the intended purchaser meets the Eligibility Criteria (National) and unless paragraph 2 applies meets the Eligibility Criteria (Local) (if any) the Dwelling is being First Home Disposed of as a First Home at the Discount First Homes Market Price and the transfer of the First Home includes: a definition of the “Council” which shall be the District Council
Delivery Mechanism. 5.1 The First Homes shall be marketed for sale and shall only be sold (whether on a first or any subsequent sale) as First Homes to a person or person(s) meeting:
5.1.1 the First Homes Eligibility Criteria (National); and
5.1.2 the First Homes Eligibility Criteria (Local) (if any).
5.2 If after a First Home has been actively marketed for 3 months (such period to expire no earlier than three (3) months prior to Practical Completion) it has not been possible to find a willing purchaser who meets the First Homes Eligibility Criteria (Local) (if any), paragraph 5.1.2 shall cease to apply.
5.3 Subject to paragraphs 5.6 to 5.10, no First Home shall be Disposed of (whether on a first or any subsequent sale) unless not less than 50% of the purchase price is funded by a first mortgage or other home purchase plan with a First Home Mortgagee.
Delivery Mechanism. 2.1. Payments to the Municipality shall not be made unless Nova Scotia is in receipt of CCBF funds from Canada.
2.2. If Canada does not provide sufficient Funds for any Fiscal Year during which this MFA is in effect, Nova Scotia may terminate this MFA and is not liable for any effects this action may cause Municipalities nor is Nova Scotia obligated to compensate the Municipality for the loss of funding.
2.3. Nova Scotia will distribute CCBF funding received from Canada to the Municipality, in accordance with this MFA and the Administrative Agreement. The distribution of said CCBF funds to the Municipality will be subject to the Municipality meeting terms and conditions of this MFA.
2.4. The Municipality agrees that CCBF funding shall be used only for Eligible Projects as identified in Schedule B of this MFA, and Eligible Expenditures as identified in Schedule C of this MFA.
2.5. Any CCBF allocation will be treated as federal funds with respect to other federal Infrastructure programs. CCBF funding may be used to pay up to 100 per cent of Eligible Expenditures of an Eligible Project.
Delivery Mechanism. NCSD shall be responsible for constructing and operating an interconnection with City’s retail distribution system. The location, plans and specifications of such connection shall be subject to prior approval by City, which approval shall not unreasonably be withheld or delayed. City shall provide easements on its property at no charge to NCSD and waive normal permit fees. NCSD shall also be responsible for obtaining any and all regulatory and environmental permits, licenses or other approvals necessary to construct and operate the interconnection. City will deliver the Supplemental Water to NCSD at the interconnection upon a mutually agreeable delivery schedule, subject to the provisions of Section
Delivery Mechanism. Two complementary component programs will be established and an Innovations Fund may be established to support the achievement of the outcomes in Section 4.2. A full explanation of the delivery mechanism in British Columbia is detailed in Schedule C of this Agreement.

Delivery Mechanism. Clips constituting T-Mobile Sourced Programming shall be delivered via the procedures set forth in Company’s Jukebox Provider Support document attached as Appendix B to this Amendment or otherwise mutually agreed to by the parties. T-Mobile shall, at all times, be responsible for sorting and organizing such clips into appropriate folders and playlists. In the event of any conflict between this Agreement and Company’s Jukebox Provider Support Document, this Agreement shall control.

Delivery Mechanism. 2.1 Subject to the provisions of Section 1.2 and 1.1.1 (Municipal Allocations), Newfoundland and Labrador will allocate directly to Local Governments, excluding Regional Service Boards, a portion of any GTF funding that may be transferred to it from Canada annually,
2.1.1 Newfoundland and Labrador will enter into an agreement with each Local Government, and will require Ultimate Recipients to comply with the Ultimate Recipient requirements as outlined in Schedule A of this Administrative Agreement, and to submit to it a Capital Investment Plan.
2.1.2 Newfoundland and Labrador will review and consider Capital Investment Plans, and will confirm the eligibility of a range of Eligible Projects included therein.
2.1.3 Local Governments will decide which Eligible Projects will receive GTF funding in accordance with the Ultimate Recipient’s allocation. Local Governments may spend their GTF allocation in the year received, accumulate the allocation for use by March 31, 2024 or obtain a loan from a financial institution to undertake Eligible Projects provided the loan and interest charges are paid by March 31, 2024.
2.1.4 Local Government will inform Newfoundland and Labrador of proposed changes, including cancellations, of any Eligible Project that receive GTF funding.
2.2 Subject to the provision of Section 1.1.2 (Provincial Waste Management Strategy), Newfoundland and Labrador will allocate GTF funding to Eligible Projects based on regional needs and regional priorities. Regional Service Boards, acting as Ultimate Recipients, will enter into an Agreement with Newfoundland and Labrador and will receive allocations on a project-by-project basis.
2.3 Subject to the provision of Section 1.1.3 (Provincial Water and Wastewater Initiative), Newfoundland and Labrador will allocate GTF funding to Eligible Projects based on applications received. Ultimate Recipients, will enter into an Agreement with Newfoundland and Labrador and will receive funding on a project-by-project basis.
2.4 Newfoundland and Labrador may develop and implement capacity building projects of regional and provincial scope, acting as Ultimate Recipient. These Eligible Projects will assist all Local Governments to improve asset management and asset management planning objectives, in accordance with Section 1.3 a (Allocation Formula) above.
2.5 Any GTF funding that may be received by Newfoundland and Labrador from Canada may be withheld by Newfoundland and Labrador until such time as Ultimate Recipient...
