Description of the System. (i) Exhibit T to this Agreement sets forth a table for the identification of certain Concessionaire breaches or failures to perform its obligations under this Agreement that may result in the assessment by the Department of Performance Points. The Performance Points system is used by the Department to measure the Concessionaire’s performance levels and the accumulation of Performance Points by the Concessionaire may trigger the remedies set forth or referenced in this Section
Description of the System. The key features of the System are as follows:
Description of the System. 2.1. The System is intended for automated trading based on the implementation of trade signals provided by the provider of trade signals (the System) on the basis of the subscription chosen and paid by the Client of the System.
2.2. The subscription fee need to be paid only if Client of the System is profitable for the month.
2.3. In the event of early termination of the Agreement, the Client will need to pay if there is profit in the account.
2.4. The system automatically implements trade signals in a round-the-clock mode during each trading day (excluding weekends and holidays (non-trading days)).
2.5. The results of implementation of signals for the past trading day are published daily at 23:59 GMT as an indicator of daily yield in percent.
2.6. The result of implementation of trade signals is credited daily to the balance on the Account of the Client of the System immediately after the relevant publication on the Site, as described in clause 2.4 of this Agreement, after deduction of Performance Fee (in accordance with the terms and conditions of the purchased Package).
2.7. On the day with a negative result, the balance of Client of the System remains intact, and the loss is covered by the special-purpose reserve fund formed by the Operator for such cases.
Description of the System. 4.1 The technical details of Eurex Enhanced Broadcast Solution are included in a description of the system ("Enhanced Broadcast Solution - Interface Specifications") and in a description of the network ("Eurex Enhanced Broadcast Solution Network Setup"). The current documentation is available in English for downloading on the Internet under the address xxx.xxxxxxxxxxx.xxx. The details included in the description of the system as well as in the description of the network merely represent a technical description of the interface and the network and do not contain any representations or warranties concerning the Eurex Enhanced Broadcast Solution system.
Description of the System. 4.5 The System shall be a wastewater system comprising a treatment plant, force mains, pumping stations, drainage basin connections and all other such facilities necessary or associated therewith required for the purpose of carrying out the activities specified in Clause 4.1 above and as detailed in Exhibit A.
4.6 The System will include the Treatment Plant, a network of gravity sewers to convey sewage to a central location within each drainage basin and a network of sewage pumping stations and force mains to convey the collected sewage to the Treatment Plant. In connection with the Company’s carrying out this work, the Government agrees to cause Registered Owners of existing septic tanks and cesspits to abandon them and fill them in with sand or other suitable fill material or to pay the Company for doing so at such time as the Company is ready to connect such Registered Owners to the System.
4.7 [Discharge of unused effluent may be by construction of drainage channels or natural watercourses. Disposal of unused effluent may be through a combination of one or more methods including evaporation, percolation, or groundwater recharge. Distribution for reuse shall be through a tanker truck loading station located at the Treatment Plant.]
4.8 The Plan attached to Exhibit A to this Agreement indicates the drainage basins and pumping stations to be constructed for the System.
4.9 The Company shall be responsible for the design, procurement and construction of the System in accordance with [internationally recognised design criteria], the Specifications and the Performance Standards, already reviewed and approved by the Independent Consulting Engineer, as attached at Annex [3].
4.10 The Company and the Government will mutually agree upon and appoint an Independent Consulting Engineer to review the construction of the System and ensure, on behalf of the Government, its compliance with the Specifications and Performance Standards and perform various other duties expressly allocated to the Independent Consulting Engineer in this Agreement.
4.11 The Independent Consulting Engineer shall be entitled and required to monitor the progress and quality of the System and for this purpose the Company shall: Submit to the Government and the Engineer a quarterly report of progress in the construction and development of the System;
Description of the System. All equipment (except the 2.4kv switchgear and feeders) will be owned, operated and maintained by O'Brien. This configuration and ownership is shown on the Functional Diagram to Define Operation of Equipment attached as Exhibit A. O'Brien will supply, design, install, and interconnect the 2.4kv switchgear and feeders, which upon start-up will be conveyed to Du Pont. Upon Du Pont's acceptance of O'Brien's conveyance of the 2.4kv switchgear and feeders, Du Pont shall be responsible for their operation and maintenance and shall indemnify O'Brien against any liability or claims which may arise out of operation thereafter of said equipment. O'Brien shall provide Du Pont with any warranties obtained by O'Brien on such equipment upon conveyance.
Description of the System. As used in this Agreement, the term “System” shall include the solar energy generating equipment and energy storage equipment, including any structural elements to physically support the solar modules incorporated therein, including but not limited to the vertical support poles or upright piers, trellis structures, trusses or purlins on which the modules are mounted, concrete or similar anchors or plugs, and mounting hardware used to attach solar modules and other electrical components to the Premises, as well as overhead and/or underground electrical transmission and communications lines, electric transformers, energy storage facilities, telecommunications equipment, power generation facilities and substations to be operated in conjunction with the solar energy generating equipment installations, roads, and related improvements, facilities and equipment including all necessary and proper foundations, footings, crossarms and other appliances and fixtures for use in connection with said equipment, wires and cables on, along and in the Premises.
Description of the System. Multi-isotope AMS system. The AMS system consists of a low energy (LE) part, a tandem accelerator, and a high energy (HE) part with a detection system. For purposes of this tender, the three parts are described as follows: • LE part in minimal configuration includes ion source, LE magnet with bouncer, and necessary components and ion optics elements allowing selection and monitoring of negative ion beam from ion source with desired mass and charge (in a reproducible way). • Tandem accelerator has a terminal voltage up to 1 MV and a gas stripper. • HE part in minimal configuration is made up from HE analysing magnet, electrostatic analyser, HE low background magnet, necessary ion optics for ion beam shaping and monitoring, and ion detection system. • The LE magnet, accelerator and the HE analysing magnet are in a linear configuration, i.e., the beam exits the accelerator without any designed bending (relative to the direction of the primary beam entering the accelerator) caused by additional device introduced between the stripper and the HE analysing magnet. Other parts of the system, which are not in contradiction to the above-mentioned ones, may be subject to change in order to design the machine that fulfil all requested technical criteria and detection limits.

The Owner further agrees that any changes to the mounting locations will change the system price and time schedule for the installation. The Owner understands that the System is a Grid-Tied Photovoltaic Generating System that is required by state and utility company regulation to disconnect and shut down in the event of a utility or electric grid failure, and will not provide backup power in the event of such a failure.
Description of the System. The PUD’s WiFi network in downtown Xxxxxxx (the “System”) consists of a mesh wireless network and wireless access points that provide the public with access to the WiFi network and then to the internet. Exhibit A to this Agreement contains a list of system assets. Some of those assets are mounted on buildings owned by private landowners and are allowed by leases or licenses.
