Emergent Circumstances. If a facility remains operational but an employee is unable to report to work due to inclement weather or other emergent circumstances, the employee is entitled to use any combination of the employee’s available paid leave and leave without pay. Within the Criminal Justice Centers and Prison and Work Release program, if a work location is inaccessible through no fault of the employee, the employee will be release from work with no loss in pay. Conversely, within the Criminal Justice Centers and Prison and Work Release program, if an employee is unable to leave the work location due to lockdown status, meals and other provisions will be provided in accordance with DOC policy.

Emergent Circumstances. The employer can contract out or lease current services without reference to the EB7 Implementation Group in cases where any delay would cause immediate risks to patients and/or detriment to the delivery of public health services to the Queensland public. In all cases information must be provided to the next EB7 Implementation Group for review in relation to these cases and to assist in determining strategies to resolve any issues that arise. These circumstances would include: • in the event of critical shortages of skilled staff; or • extraordinary or unforeseen circumstances.

  • Special Circumstances An employee shall be entitled to extend the maternity leave by up to an additional six (6) consecutive weeks' leave without pay where a physician certifies the employee as unable to return to work for medical reasons related to the birth. An employee shall be entitled to extend the parental leave by up to an additional five (5) consecutive weeks' leave without pay where the child is at least six (6) months of age before coming into the employee's care and custody and the child is certified as suffering from a physical, psychological or emotional condition. Provided however, that in no case shall the combined maternity and parental leave exceed fifty-two (52) consecutive weeks following the commencement of the leave.
