Environment and Social Safeguards. 1. The Recipient shall carry out the Project in accordance with the Environmental and Social Safeguards Framework and the Environmental Management Plan. 2. Except as the Administrator shall otherwise agree, the Recipient shall not amend or waive any provision of the Environmental and Social Management Framework and the Environmental Management Plan if, in the opinion of the Administrator, such amendment or waiver may materially and adversely affect the implementation of the Project. 3. The Recipient shall ensure that activities financed under the Project shall not involve any land acquisition or involuntary resettlement of the local population and/or businesses. In the event that any land is required for the Project or any resettlement is to be carried out, the Recipient shall, in consultation with the Administrator, ensure that such land shall be obtained and such resettlement carried out in accordance with plans agreed with the Administrator.

Environment and Social Safeguards. The Borrower/Recipient shall ensure that: (a) all Project activities are implemented in strict conformity with the Borrower/Recipient’s relevant laws/regulations; (b) all Project activities give special consideration to the participation and practices of ethnic minority population in compliance with IFAD’s Policy on Indigenous Peoples (2009), as appropriate; (c) proposals for civil works include confirmation that no involuntary land acquisition or resettlement is required under the Project. In the event of unforeseen land acquisition or involuntary resettlement under the Project, the Borrower/Recipient shall immediately inform the Fund and prepare the necessary planning documents; (d) women and men shall be paid equal remuneration for work of equal value under the Project; (e) recourse to child labour is not made under the Project; (f) the measures included in the Gender Action Plan prepared for the Project are undertaken, and the resources needed for their implementation are made available, in a timely manner; and (g) all necessary and appropriate measures to implement the Gender Action Plan if any to ensure that women can participate and benefit equitably under the Project are duly taken.

The Project Implementing Entity shall ensure that the Project is carried out in accordance with the Environment Management Framework and the Social Impact Management Framework, and that the implementation of the Environment Management Framework and the Social Impact Management Framework is adequately monitored and supervised throughout Project Implementation.

The Project Implementing Entity shall ensure that no land acquisition is carried out under the Project without prior consultation with the Association, and that any resettlement of people, property or businesses is carried out in accordance with a plan approved by the Association prior to the commencement of such resettlement or the payment of any compensation related thereto.

Environment and Social Safeguards. 1. The Recipient shall, in carrying out the Project: (a) take all necessary actions to minimize, to the extent possible, any involuntary loss by persons of shelter, productive assets or access to productive assets, income or means of livelihood, temporarily or permanently; and (b) for this purpose: (i) prior to the commencement of any works under the Project, implement, or cause to be implemented, the applicable Safeguards Instruments in a manner satisfactory to the Recipient and the Association; and (ii) whenever modification or finalization of any Project activity design or works shall give rise to Displaced Persons, provide to the Association, for its review, a RAP and EMP, prepared in accordance with the principles and procedures set forth in the ESMF and, thereafter, implement such activity in a manner satisfactory to the Recipient and Association. 2. The Recipient, through PMG, shall ensure that the Project, including all Priority Investment Sub-projects to be financed thereunder, is carried out in accordance with the terms, conditions and procedures set forth in the Safeguards Instruments, and shall ensure that no Safeguards Instrument shall be revised, repealed or abrogated except with the mutual agreement of the Recipient and the Association. 3. The Recipient shall: (a) maintain policies and procedures adequate to enable the Recipient to monitor and evaluate, in accordance with guidelines acceptable to the Recipient and the Association, the implementation of all the Safeguards Instruments and the achievement of the objectives thereof; and (b) prepare, under terms of reference agreed between the Recipient and the Association, and furnish to the Association by January 1 of each year, commencing on January 1, 2012, semi-annual reports of the results of the monitoring and evaluation activities with respect to all Safeguards Instruments, together with any revisions proposed to be introduced into said instruments in order to achieve their respective objectives. 4. The Recipient shall, through the SPMGs: (a) ensure that Project sites under Part B of the Project shall be selected according to the Framework Criteria; (b) ensure that said sites shall only consist of land free of claims and/or disputes; (c) until completion of the Project, monitor discovery at the Project sites of all cases of involuntary resettlement, land acquisition and/or adverse impact on income of individuals, including titleholders and non-titleholders, and provide compensation and/or...
