Environmental Compliance Plan. The Manager will prepare an Environmental Compliance plan for all Operations consistent with the requirements of applicable Laws or contractual obligations and will include in each proposed Program and Budget sufficient funding to implement the Environmental Compliance plan and to satisfy the financial assurance requirements of applicable Laws and contractual obligations pertaining to Environmental Compliance. To the extent practical, the Environmental Compliance plan will incorporate concurrent reclamation of Properties disturbed by Operations.
Environmental Compliance Plan. Defendant agrees to develop, adopt, establish, implement, and fund the environmental remedial measures set forth in the Environmental Compliance Plan (“ECP”), attached hereto as Attachment B, during the term of probation, consistent with sentencing policies set forth in U.S.S.G. § 8D1.4. As set forth in greater detail in the ECP, which is part of this Agreement and intended to be part of the Special Conditions of Probation, Defendant and Carnival Corporation and Carnival plc (collectively, “Carnival Corporation & plc” or “Defendant’s parent”) have agreed to fully fund and implement the ECP across all related entities with vessels that carry a Certificate of Financial Responsibility, issued pursuant to the Oil Pollution Act of 1990, as well as those vessels themselves. As set forth therein, Defendant and Defendant’s parent have agreed to retain the services of an outside independent Third Party Auditor and fund a Court Appointed Monitor acceptable to the government to perform the duties set forth in the ECP and to report to the Court and Office of Probation. As set forth in the Agreement, Defendant and Defendant’s parent understand and agree that the ECP will be included in the Special Conditions of Probation and that any violation of its terms by Defendant or Defendant’s parent, or any of its related entities and vessels covered by the ECP, may be grounds for the revocation of probation as to Defendant.
Environmental Compliance Plan. Requirements for the ECP are included in Exhibit 6 Article 5 (Environmental Management).
Environmental Compliance Plan. The Engineer shall review typical components of an environmental compliance plan including, as applicable, ambient air monitoring program, visible emission observations, and visual or laboratory testing of soils and water; and shall verify compliance with the specifications and regulatory requirements.
Environmental Compliance Plan. The following standards and requirements for an Environmental Compliance Plan (“ECP”) have been prepared pursuant to the Plea Agreement dated this same date between Defendant, Princess Cruise Lines, Ltd. (“Defendant”), and the United States Attorney’s Office for the Southern District of Florida and the Environmental Crimes Section of the United States Department of Justice (collectively, “Government”). Pursuant to Paragraph 5(e)(3) of the Plea Agreement, Carnival Corporation and Carnival plc (collectively, “Carnival Corporation & plc”) have agreed to fully fund and implement this ECP with respect to the vessels and personnel described below.
Environmental Compliance Plan. The Phase Developer is responsible for achieving and maintaining commitments, permits and authorizations through a strong ECP and partnering with MDOT. Prepare an ECP and submit to the IQF. The ECP shall detail methodologies to achieve and maintain environmental commitments and permit conditions throughout the term of the Section P3 Agreement. The ECP is an overall guidance document making reference to other Plans needed to carry out the Work. The ECP will be a living document and shall be updated continuously as commitments are made and met, the NEPA process is finalized, and permits/approvals are procured. The ECP must contain all permit authorizations and modifications, environmental commitments, Inspection reports, and checklists. At a minimum, the ECP must include the following information: the Phase Developer’s Environmental Compliance Team structure including staff positions, qualifications, roles and responsibilities, and an organizational chart reflecting all members of the Environmental Compliance Team; a discussion of the Plan for further avoidance and minimization of impacts including how and where the Phase Developer’s Environmental Compliance Team can further avoid and minimize both temporary and permanent impacts to sensitive natural and cultural resources; a discussion of the Plan for water quality monitoring identifying how and where the Phase Developer expects to monitor water quality during construction as well as how data shall be provided through a web-based system on a real-time basis; Inspection protocols, including the methodology and frequency of Inspections, and proposed Inspection forms and checklists to be used; response protocols in the event of any violations of permit conditions; a Spill Prevention Control and Countermeasures Plan and a Stormwater Pollution Prevention Plan in accordance with Applicable Law; a Plan for air quality including off-road diesel emissions reductions; a Plan for maintaining access and mobility; the Phase Developer’s strategies for environmental communication, Emergency response and environmental risk management; a discussion of the construction noise and the proposed work hours to be used to meet the construction noise limits; a discussion of the Phase Developer’s approach to vibration monitoring and mitigation; implementation and reporting requirements (e.g., daily/weekly/monthly reports), commitment checklists, and details on how the Phase Developer proposes to maintain the ...
Environmental Compliance Plan. 5.22.1 Where required by the Special Conditions, the Contractor shall prepare and submit to the Engineer an environmental compliance plan for the execution of the Contract Works.
5.22.2 The environmental compliance plan shall address the means by which the Contractor intends to meet its obligations under 5.11 and any other requirements for environmental compliance set out in the Contract or in any licences obtained or to be obtained by the Principal or the Contractor under 5.11.
5.22.3 Within 5 Working Days of receipt of the Contractor's environmental compliance plan, or revised environmental compliance plan, the Engineer shall notify the Contractor in writing whether or not he or she accepts the plan. Such acceptance shall not be unreasonably withheld. Where the Engineer does not accept the plan, the notice shall include the Engineer's reasons, and the Contractor shall submit a revised environmental compliance plan.
5.22.4 The Contractor shall not commence any part of the Contract Works unless the Engineer has accepted the environmental compliance plan or revised environmental compliance plan.
5.22.5 Compliance with the environmental compliance plan shall not relieve the Contractor from any of its duties, obligations, and liabilities under the Contract.

Del Toro shall prepare an Environmental Compliance plan for all operations consistent with applicable Laws or contractual obligations and shall include in each work plan and budget sufficient funding to implement the Environmental Compliance plan and to satisfy the financial assurance requirements of any applicable Law or contractual obligation pertaining to Environmental Compliance. To the extent practical, the Environmental Compliance plan shall incorporate concurrent reclamation of Real Property disturbed by operation of the Claims.
Environmental Compliance Plan. Design-Builder shall prepare and submit an Environmental Compliance Plan to VPRA within sixty (60) days after Phase 1 NTP that details all necessary approvals and permits required to complete the Project and how all environmental commitments and permit or authorization conditions that will be maintained throughout Construction. Contractor shall update the Environmental Compliance Plan throughout the Project as environmental requirements change or are added.
